Scales. All scales referred to herein shall be operated and maintained to be in conformance with the National Institute of Standards and Technology (NIST) Handbook 44, or the applicable Standards of the Association of American Railroads (AAR). Seller shall provide copies of all scale certification test reports to Buyer upon request. Seller shall promptly notify Buyer if Seller believes its scales have experienced a failure or are unavailable, or are inaccurate. Scales. CRRA shall provide and use scales for determining the quantity of Acceptable Solid Waste and Acceptable Recyclables delivered to the Connecticut Solid Waste System by or on behalf of the Municipality. Owner shall maintain (at its expense) the accuracy of such scales and ensure that they are inspected and certified as required by applicable law. Upon Bunge’s request, Producer will promptly provide Bunge with copies of all scale certifications. Bunge may, at its sole expense, test the accuracy of such scales. If the scales at a Delivery Destination are unavailable or inoperable, any scales certified as required by applicable law may be used, at Producer’s sole cost and expense, until the scales at a Delivery Destination are available and operable.

If such test reveals that CRRA’s scales are in compliance with the tolerances permitted by the State of Connecticut Department of Consumer Protection, then the Municipality shall pay CRRA’s reasonable expenses for such tests and the Municipality shall withdraw its dispute. Alternatively, if such test reveals that CRRA’s scales are not in compliance with the aforementioned tolerances (whether such non-compliance has resulted in underweights or overweights), then CRRA shall have its scales recalibrated, and CRRA shall pay the Municipality’s expenses for such tests and recalibration.
Scales. Green Ridge shall operate scales at the Landfill entrance or at such other location as may be determined by Green Ridge to ensure the proper weighing of vehicles entering the Landfill. Scales will be of a type and quality customarily used in the industry and shall be properly maintained and operated. Scales. IP shall maintain Sylvamo’s scales (which shall include calibration) at the Supporting Facilities in a good and workmanlike manner and in accordance with the manufacturers’ specifications such that they are capable of performing all necessary functions and conform to all legal requirements.
