Section 1 - Overtime. (a) All hours worked in excess of the regular eight (8) hour day or any normal work schedule shall be compensated for at the rate of time and one-half. It shall be understood that a work schedule shall be considered to be an average of thirty-seven and one-third (37 1/3) hours. Any overtime worked in excess of fifteen (15) minutes shall be compensated for as one (1) full overtime hour, and any overtime thereafter, up to one (1) hour shall be compensated for as a full overtime hour. All overtime shall be assigned through the Jamestown Police Department on a rotating basis. If no one accepts available overtime, then the most junior employee available shall be ordered into work. Police officers may be assigned to work Public Safety Clerk Dispatcher overtime when all Public Safety Clerk Dispatchers have been offered and refused the overtime and in those instances when there is no Public Safety Clerk Dispatcher available to work the overtime. Police officers will not be ordered to work Public Safety Clerk Dispatcher overtime if they have been offered and have refused the overtime and there is a Public Safety Clerk Dispatcher available to work the overtime. Probationary Police Officers may be used to replace Permanent Police Officers only when the Chief of Police deems it acceptable and when all employees have refused the assignment. (b) All overtime worked on the following holidays: New Year‟s, Thanksgiving and Christmas, shall be compensated for at the rate of double time and one-half (2 1/2) the employee‟s regular rate of pay. It is understood that the Christmas holiday will start at 3:00 p.m. on December 24th and end at 11:00 p.m., December 25th. New Years Day shall commence 3:00 p.m. December 31st and end at 11:00 p.m. on January 1st. (c) The sole and exclusive remedy for misassignment of overtime or details shall be that the officer wrongfully denied overtime or details shall be afforded the next overtime opportunity for which he/she is qualified. Under no circumstances shall back-pay be awarded for a misassignment of overtime or details. The only exception to the foregoing shall be if the Chief deliberately or in bad faith selects an employee out of rotation or ignores the overtime rotation. (d) Whenever an officer calls in sick within twenty-four (24) hours before or after an overtime shift, the officer will be compensated only at the straight-time rate of pay for that overtime shift.

  • Overtime Meal Allowance Employees required to work more than two (2) hours overtime consecutive with a shift shall be provided with a meal by the Employer.

Except as provided in 2.C.3., below, for all regular, limited-term and probationary employees, overtime may be converted to compensatory time or paid for at the option of the agency/department. Consideration shall be given to effectuating the wishes of employees. The maximum number of CTO hours which may be accrued by any employee is eighty (80). If an employee accrues 80 hours of CTO, he/she cannot accrue additional CTO until he/she uses some of the hours in his/her bank; instead, employees will be paid for all overtime work performed in excess of that amount. 3. Overtime hours worked by extra help employees shall be paid. 4. Compensatory time earned and accrued by an employee in excess of thirty-two (32) hours may be scheduled off for an employee by his or her agency/department; however, consideration shall be given to effectuating the wishes of those employees requesting specific compensatory time off periods. 5. No scheduled compensatory time off will be cancelled except in cases of emergency. 6. In no case may an employee's work schedule be changed during the workweek when the purpose of such change is to avoid overtime compensation. 7. Time worked as overtime shall not be used to earn fringe benefits or to serve out probation or merit increase periods. Compensatory time off may be used as part of the established workweek to earn fringe benefits and to serve out probationary and merit increase periods. 8. An employee separating from the County service shall be paid for accumulated compensatory time in a lump sum payment.

  • Overtime Payments Full-time and Part-time Employees

  • Mandatory Overtime a. Mandatory Overtime is overtime that an employee is assigned and required to work involuntarily, and will only be required in operational emergencies when sufficient voluntary overtime cannot be secured to maintain the Company’s operation. Mandatory overtime will be limited to the number of employees and hours required to cover the emergency as determined by local management. b. Mandatory overtime will not exceed 4 hours past an employee’s scheduled shift in any 24 hour period. Employees will not be required to work mandatory overtime until the opportunity to work the additional hours has been offered to all qualified employees who are currently at work, and if there are an insufficient number of volunteers, then to otherwise eligible employees whose names remain on the overtime call sign up list. c. Mandatory overtime will be assigned in reverse bid seniority order according to shift time, except that employees already working overtime will be assigned last. d. Every attempt will be made to notify employees on duty of mandatory overtime at least 1 hour in advance. If 1 hour’s advance notice is not provided, the employee will receive 1 ½ hours’ pay as a penalty in addition to the pay earned for any mandatory overtime hours actually worked. e. Employees will not be assigned mandatory overtime during their vacation periods. For this purpose, the vacation period is defined as the period beginning 24 hours after the commencement of the employee’s last regularly scheduled shift before the vacation commenced. An employee may be assigned to mandatory overtime on the last regularly assigned shift prior to a vacation or DAT day, but will be placed at the bottom of the mandatory overtime list. f. If any mandatory overtime causes a rest period violation to occur, every attempt will be made to adjust the employee’s shift to provide the minimum 8 hours rest. g. All mandatory overtime hours will be paid at the applicable rate of pay but not less than the time and one half (1.5X) rate of pay regardless of work status or hours worked. If an employee is required to work mandatory overtime on two or more consecutive days, the minimum payment for all mandatory overtime hours worked will be at the double-time (2X) rate of pay.
