Section 10.13. 30 An employee shall forfeit rights to reemployment as provided in Section 10.10 if the employee does 31 not comply with the requirements of Section 10.11, or if the employee does not respond to the offer of 32 reemployment within fifteen (15) days.

The issue of 41 justifiable cause shall be resolved in accordance with the grievance procedure hereinafter provided. If 42 the District has reason to reprimand an employee, it shall be done in a manner which will not 43 embarrass the employee before other employees or the public. 44
Section 10.13. 13 For purposes of layoff and recall, seniority lists for minority groups shall be maintained in accordance
Section 10.13. 5 The seniority of a substitute who meets the criteria in Section 1.5 shall be established when the 6 substitute fulfills the criteria. These substitutes shall accrue seniority on the basis of one (1) day 7 of seniority for each day of work commencing on the referred thirty-first (31st) day. The 8 seniority of such substitute shall be expressed as the number of days worked and may be 9 utilized for jobs posted under Section 10.9 (and its subsections).
Section 10.13. 15 The District will provide the Association with advance notice and reasonable opportunity to discuss 16 layoffs and/or reduction in hours including alternative options to layoff and/or reductions. In emergent 17 situations, as currently provided by law, the District will negotiate these matters with the Association 18 as soon implementation as is possible. It is the responsibility of those in layoff status to apply for 19 available new or open positions. Employees on layoff status shall file their address, phone number and 20 email address (if applicable) in writing with the Human Resources office of the District and shall 21 thereafter promptly advise the District in writing of any change of address. The District shall send a 22 certified letter to the last address on file for the employee or obtain the signature and date of an 23 employee being offered re-employment.
Section 10.13. 29 For a period of one year following layoff, the applicant pool for all KAEOP open positions shall first be 30 restricted to KAEOP members only. Open positions will be posted and application and interviews will 31 occur for KAEOP members only in order that opportunity is given for restoration of lost time. 34 35 A R T I C L E X I 36 37 DISCIPLINARY ACTION AND SEPARATION OF EMPLOYMENT 38 39 Section 11.1. 40 Each employee has the right, during an investigatory interview which the employee reasonably believes 41 may result in discipline, to request the presence of an Association representative, if the Association 42 representative is available. If that representative is not available, the employee may request the presence of 43 another immediately available Association representative. The Association representative shall not obstruct 44 or interfere with the interview. 45
