Selection of Bidder.  Bidder has to qualify in Technical Bid (submitted in Envelope 1). Envelope 2 i.e. price bid of bidder will be opened only if found eligible in Technical Bid.  Selection will be based on Grand Total quoted at the price bid by the bidder.  If two or more bidders quote the same amount, the bid will be evaluated on the basis of their average annual turnover of the last three years or experience . In such case, the decision of NABARD will be final and binding to all the bidders.  Conditional bid will summarily be rejected.

Selection of Bidder. 3.3.1 Subject to the provisions of Clause 2.16.1, the Bidder whose BID is adjudged as responsive in terms of Clause 3.1.6, and who quotes the lowest price shall be declared as the selected Bidder (The “Selected Bidder”) 3.3.2 In the event that two or more Bidders quote the same BID Price (the "Tie BIDs"), the Authority shall identify the Selected Bidder by draw of lots, which shall be conducted, with prior notice, in the presence of the Tie Bidders who choose to attend. 3.3.3 In the event that the Lowest Bidder is not selected for any reason except the reason mentioned in Clause 2.1.12 (b) (4), the Authority shall annul the Bidding Process and invite fresh BIDs. 3.3.4 After selection, a Letter of Acceptance (the “LOA”) shall be issued in the format set forth in Appendix-VIII, in duplicate, by the Authority to the Selected Bidder, and the Selected Bidder shall, within 7(seven) days of the receipt of the LOA, sign and return the duplicate copy of the LOA in acknowledgment thereof. In the event the duplicate copy of the LOA duly signed by the Selected Bidder is not received by the stipulated date, the Authority may, unless it consents to an extension of time for submission thereof, appropriate the BID Security of such Bidder as Damages on account of the failure of the Selected Bidder to acknowledge the LOA. 3.3.5 After acknowledgment of the LOA as aforesaid by the Selected Bidder, it shall cause the Bidder to submit Performance Security and Additional Performance Security (if any) within the period prescribed/extended by Authority and then execute the Agreement within the period prescribed in Clause 1.3. The Selected Bidder shall not be entitled to seek any deviation, modification, or amendment in the Agreement. 3.3.6 The authority shall return the Bid Security of all bidders except L-1 and L-2 within 7 working days from the opening of the financial Bid subject to the provision of Clause
Selection of Bidder. 2.19.1. Only the Techno-commercial Bids will be opened first. 2.19.2. The Techno-Commercial Bid Proposals will be evaluated as per the criteria mentioned in 2.18.1 and annexure. 1. Bidders qualified in the Techno- Commercial Bid Evaluation only will be eligible for their Price Bid(s) opening. 2.19.3. The competent authority may also blacklist the bidder. 2.19.7. The bidder shall be issued the Contract order immediately. However, for the purpose of this tender, the date of signing of Contract shall be the date of commencement of the Contract and the Bidder / Contractor shall commence the work immediately as per table 2.13.

If any terms & Conditions are stipulated in the tender document, the tender shall summarily be rejected. • Selection will be based on Grand Total quoted at the price bid by the bidder. • Preference shall be given to Public Sector Enterprises (PSEs), where quoted rates of PSEs are within 10% of the rates quoted by L1 bidder, other things being equal. Purchase preference may be granted to the Public Sector Enterprise at the lowest valid price bid. • The decision of NABARD will be final in selection of bidder.
Selection of Bidder. The Ministry anticipates that it will select a Bidder within the irrevocable period. Notice of selection by the Ministry will be in writing. The Preferred Bidder shall execute the Agreement in the form attached to this RFB and satisfy any other applicable conditions of this RFB within the period of time set out to do so in Section 1.1 - Procurement Details of the Qualification Envelope of this RFB. This provision is solely to the benefit of the Ministry and may be waived by the Ministry at its sole discretion. Bidders are reminded that there is a question and answer period available if they wish to ask questions or seek clarification about the terms and conditions set out in the Form of Agreement. The Ministry will consider such requests for clarification in accordance with its right to do so under this RFB.

The bidder should have experience in maintenance and operation of air conditioning system/plant and must have executed similar work and should provide documentary evidence in this regard. • The PART-I (Technical Bid) of the tender shall contain Pre-Qualification bid, along with proof of having submitted EMD and terms & conditions in prescribed tender document.
