Service Seniority Defined. ‌ (a) Service seniority for regular employees" shall be defined as the length of continuous service, at the earliest start date, as a regular employee with the Employer, previous maintenance contractors within the service area covered by this Agreement and the Public Service of BC. Seniority shall be maintained except as specified in Clause 11.3 below. (b) Service seniority for auxiliary employees" shall be defined as follows: (1) For the purpose of all provisions of the Agreement, "service seniority" shall be defined as the length of continuous service as an auxiliary employee at the earliest start date with the Employer, previous maintenance contractors within the service area covered by this Agreement and the Public Service of BC. Seniority shall be maintained except as specified in Clause 11.4 below. (2) All incumbent auxiliary employees as of March 1, 1995 shall have a service seniority date for the purpose of (b)(1) above established. The method used will be to assign March 1, 1995 as the service seniority start date for the auxiliary having the highest seniority credits on March 1, 1995 within his respective seniority block. One day will be added to each subsequent auxiliary in descending order of seniority within the employee's respective seniority block. (3) All auxiliary employees hired after March 1, 1995 will have their service seniority date established as their start date. However, no auxiliary employee hired after March 1, 1995 can have a service seniority start date earlier than an incumbent auxiliary. (c) When two or more regular employees have the same service seniority date, previous auxiliary seniority, as defined in (b) above, shall be the determining factor. Where none of the affected regular employees have previous auxiliary seniority as defined in (b) above, or where two or more auxiliary employees have the same service seniority date, then seniority shall be determined by chance as mutually agreed to by the Employer and the Union.

The following method shall be used to determine a service seniority date for each auxiliary employee who was hired between August 29, 2007 and March 31, 2019: (i) Total straight-time seniority hours accumulated to April 1, 2019 will be used for the calculation; (ii) Divide the straight-time hours (accumulated to April 1, 2019) of each employee by 7.5 to determine the number of days for that employee to be used in (iii) below; (iii) Using the number of days calculated in (ii), count backwards by calendar days from April 1, 2019 to determine a service seniority date. That date will become the permanent service seniority date for the employee. (3) Employees hired on or after April 1, 2019 will have their service seniority as of their date of hire. (c) When two or more regular employees have the same service seniority date, previous auxiliary seniority, as defined in (b) above, shall be the determining factor. Where none of the affected regular employees have previous auxiliary seniority as defined in (b) above, or where two or more auxiliary employees have the same service seniority date, then seniority shall be determined by chance as mutually agreed to by the Employer and the Union.

Where the service start dates are equal, their relative seniority will be determined by chance as mutually agreed to between the employees and the Union.

(b) Service seniority for auxiliary employees shall be defined as the total number of straight-time hours worked with unbroken service with the Employer plus all accumulated straight-time hours with unbroken service accrued with the Public Service of BC prior to November 1, 1988, plus all accumulated straight-time hours accrued with previous maintenance contractors in Highway Maintenance Service Area 3. (c) When two or more employees have equal seniority, the order of establishing their relative seniority shall be determined by their auxiliary seniority. Should this not result in a break in the tie, the order of establishing their relative seniority shall be determined by the employees uninterrupted service start date with the Province of BC or the Employer, whichever the earlier. This clause will not apply to equal seniority situations that have been already resolved and recorded.

(3) Subject to Clause 11.4, an auxiliary employee shall retain their seniority if they are moved by the Employer from one (1) seniority block or classification series to another. When two (2) or more employees have equal seniority, the order of establishing their relative seniority shall be determined by their auxiliary seniority. Service Seniority Defined. (a) Service seniority for regular employees shall be defined as the length of regular unbroken service with the Employer and shall include: (1) unbroken service as a regular employee with previous contractors in Contract Area 28 provided they accepted regular employment with successive contractors in Contract Area 28; and (2) unbroken service as a regular employee with the Ministry of Transportation and Highways provided they accepted regular employment with the successive contractor in Contract Area 28. (b) For the purpose of layoff and recall, an auxiliary employee who has worked in excess of thirty (30) work days shall accumulate service seniority within a work group on the basis of the total number of straight-time hours worked with the Employer. Accumulated straight-time hours worked with previous contractors in Contract Area 28 will be included provided they accepted auxiliary employment with successive contractors in Contract Area 28. (c) When two (2) or more employees have the same start date their relative seniority will be determined by chance.

(c) When two (2) or more employees have equal seniority, the order of establishing their relative seniority shall be determined by their auxiliary seniority, except as specified in Article 11.1(d). Should this not result in a break in the tie, the order of establishing their relative seniority shall be determined by the employee's service start date in Contract Area 10 with the Province of B.C. or with a maintenance contractor. Where the service start dates are equal, their relative seniority will be determined by chance as mutually agreed to between the employees and the Union. (d) Any resolve to service seniority made prior to date of ratification of this Agreement will remain in effect. (e) Seniority will not accrue during general leaves of absence in excess of forty-five (45) working days.
