Store Closure. In stores receiving transferred sales in the case of a store closure, the additional hours of work that result will be fully dedicated to the pre-March 17th, 1993 senior employees from the closed store. Additional weekly hours of work will be those that exceed those worked in the previous four (4) weeks of normal operation. Other pre-March 17th, 1993 employees who were working in the closed store will be transferred to a new home store in which they can exercise their seniority to work toward achieving their base hours. When a pre-March 17th, 1993 part-time employee is transferred to another store, seniority will govern in the achievement of the employee’s base hours.
Store Closure. In the event of the closure of a store, employees shall be able to exercise their seniority to transfer to other stores of the Employer within the same division within the same contract area. In the event that employees are unable to maintain employment in another store in the same division, they shall be able to exercise their seniority to transfer outside their division within their contract area. If they are still unable to maintain employment, they shall be able to exercise their seniority to transfer within the total bargaining unit. Employees who exercise their seniority to transfer under this article shall retain their seniority. Employees who remain in the same classification and department shall retain their class hours and rate of pay.
Store Closure. If at any time Retailer sells or closes a Store Location, the parties shall have the rights and obligations set forth on Schedule 7.19 hereto.

Other employees hired prior to March 17th, 1993 who were working in the closed store will be transferred to a new home store in which they can exercise their seniority to work toward achieving their base hours. When a part-time employee hired prior to March 17th, 1993 is transferred to another store, seniority will govern in the achievement of the employee's base hours. Once all the employees hired prior to March 17th, 1993 have achieved their base average of weekly hours worked, the senior employees hired prior to March 17th, 1993 in the scheduling group will receive preference in the formula scheduling of additional new growth hours on a weekly basis.
Store Closure. In the event the Employer closes the majority of its stores in the Bargaining Unit, the Employer agrees to meet with the Union for the purpose of negotiating the severance of the employees thus affected.
Store Closure. If at any time, Retailer sells or closes a Store Location and (i) there is not another Store Location within forty (40) miles of the sold or closed Store Location and (ii) Retailer has not delivered to Bank a written certification that a new Store Location within forty (40) miles of the sold or closed Store Location will be opened within one hundred twenty (120) days of the sale or closure of such Store Location, then with respect of any Account for which at least seventy-five percent (75%) of the Co-Brand Purchases or PLCC Purchases, as the case may be, were made at the closed Store Location in the twelve (12) billing cycles preceding the earlier of the date on which the Store Location was closed or sold or the date upon which notice thereof is given by Retailer to Bank, Bank will have the right (but not the obligation) to liquidate any or all such Accounts in a manner consistent with Bank’s post-termination Account liquidation rights set forth in Schedule 11.4, provided, however, that the foregoing shall not apply to (x) any Account used to finance a purchase at any Retailer Sales Channel or the Retailer Website (to the extent Bank can reasonably determine) during the sixty (60) day period subsequent to the closure of the relevant Store Location and (y) to the extent Bank can reasonably determine, any Account on which ten percent (10%) or more of the Co-Brand Purchases (or prior to the implementation of the Direct Settlement Process for purchases through the Retailer Website in accordance with Section 7.17(e) of the Agreement, ten percent (10%) of the Non-Retailer Purchases made on the Retailer Website) or PLCC Purchases, as the case may be, were made at the Retailer Website in the twelve (12) billing cycles preceding the earlier of the date on which the Store Location was closed or sold or the date upon which notice thereof is given by Retailer to Bank. If with respect to any such Account there is not another Store Location within eighty (80) miles of the sold or closed Store Location, then Bank may request that Retailer waive the sixty (60) consecutive day period contemplated in the preceding sentence, which Retailer may waive in its reasonable discretion. Retailer shall provide to Bank (a) at least 30 days prior written notice of any closure or sale of any Store Location after the date hereof, which notice shall include the location of the nearest Store Location and, if applicable, the certificate referred to in (ii) above, and (b) promptly following ...
Store Closure. Employees who exercise their seniority to transfer under this article shall retain their seniority hours. Employees who remain in the same classification and department shall retain their class hours and rate of pay. Seniority and employment shall be terminated when:
a) An employee voluntarily quits or is terminated for just cause or fails to show up for work for five (5) three (3) consecutive shifts without valid reason and/or without proper prior notice. In the case of the latter, Article 31.3 shall not apply.
d) fails to return to work upon the conclusion of a leave of absence unless their failure to return is for reasonable cause.
e) uses an approved leave of absence for purposes other than those specified to the Employer. Amend Article 30.16, second last paragraph
Store Closure. Should a store in the Bargaining Unit close, the Parties agree that the seniority of all employees in the Bargaining Unit be "dove-tailed" in accordance with each employee's Mid-Island Consumer Co-operative seniority date within the remaining store or stores within their classification for the purpose of any layoffs resulting from the store closure. Recall from layoff will be by seniority within the department as provided for in Section 15 (a).
Store Closure. 23.01 The Union and Employer will meet following the announcement of a store closure to discuss potential options for employees.
Store Closure. Effective as of the Closing Date, Seller shall (A) terminate the employment of all employees working at the Stores (or transfer such employees to other stores or facilities owned or operated by Seller); and (B) terminate all vendor, distribution and supply agreements applicable with respect to the Stores, except for any Service Contracts Buyer has elected to assume pursuant to this Contract or in writing delivered during the Feasibility Period.
