SUSPENSION OF TEACHERS. Whenever the superintendent of a school district has reason to believe that cause exists for the dismissal of a teacher and is of the opinion that the immediate suspension of the teacher would be in the best interests of the children in the district, the superintendent or the local board of education upon receiving recommendation for suspension from the superintendent may suspend the teacher without notice or hearing. However, the suspension shall not deprive the teacher of any compensation or other benefits to which otherwise entitled. Within ten (10) days-time after such suspension becomes effective; the local board of education shall either initiate a hearing for dismissal pursuant to law or reinstate the teacher. However, in a case involving a criminal charge or indictment, such suspension may extend to such time as the teacher’s case is finally adjudicated at trial. Provided, however, such extension shall not include any appeal process.

SUSPENSION OF TEACHERS. All suspensions of teachers shall be in accordance with state law, which is currently set forth in Section 132 of the 2013 School Law Book and which is attached as Appendix E for information purposes.
SUSPENSION OF TEACHERS. The Superintendent shall have the authority to suspend a teacher from his/her position when the teacher’s conduct is seriously detrimental to the school system. Such teacher shall have the right to request a review of the Superintendent's decision by the Board of Education. Such a review must be requested by the employee in writing, filed with the Superintendent within ten (10) days after receipt of notice of suspension without pay or dismissal. The Board shall conduct a hearing on the matter within twenty-five (25) days of the request for the hearing. At the hearing, the employee may be represented by the Association and/or counsel of the employee’s choice. Any suspended teacher shall have the right to legal counsel and Association representation at said hearing. Nothing herein shall be construed to limit the authority of the Board to suspend a teacher in accordance with applicable law nor does any suspension limit the authority of the Board to discharge a teacher according to law. In no event shall a teacher be precluded from instituting legal action in a court of competent jurisdiction. If the complaint(s) which provided a basis for the suspension or discharge of a certified teacher is (are) found to be unjustified and unsubstantiated in the course of due process, the teacher will be reinstated and will be retroactively compensated for all salary, fringe benefits, and emoluments withheld from the teacher during the suspension or discharge period. In addition, all written records of the suspension or discharge period will be immediately removed from the teacher’s personnel file. A notarized letter will be presented to the teacher whose suspension or discharge was unjustified, exonerating him/her from those complaints that led to the suspension or discharge. This letter will not appear in his/her personnel file. This procedure shall be in addition to any and all rights conferred upon the teacher under the School Code of the State of Illinois. Teachers shall not be suspended without justification. Such justification shall not be arbitrary, discriminatory or unreasonable.
SUSPENSION OF TEACHERS. The superintendent may suspend any employee of the school district subject to the provisions of this section. The principal of a school may suspend any teacher or other employee assigned to the school subject to the provisions of this section. Any employee shall have seven (7) days written notice of the intent to suspend and the grounds upon which the suspension is to be imposed; provided, however, that the superintendent may, for good cause, require the immediate suspension of any employee, in which case the employee shall receive written notice of the immediate suspension and the cause therefor at the time the suspension is imposed. The employee shall be entitled (I) to review the decision to suspend with the superintendent or principal if said decision to suspend was made by the principal; (II) to be represented by counsel in such meetings; (III) to provide information pertinent to the decision and to the employee's status. No teacher or other employee shall be suspended for a period exceeding one (1) month, except with the consent of the teacher or other employee, and no teacher or other employee shall receive compensation for any period of lawful suspension. No teacher shall be interrogated prior to any notice given to him relative to the suspension unless the teacher or other employee is notified of his right to be represented by counsel during any such investigation. A suspended teacher or other employee may seek review of the suspension by following the arbitration procedures set forth in section forty-two (42). Nothing in this section shall be construed as limiting any provision of a collective bargaining agreement with respect to suspension of teachers or other employees.

However, the suspension shall not deprive the teacher of any compensation or other benefits to which otherwise entitled. Such suspension shall extend to such time as the teacher's case is adjudicated at a trial de novo for a career teacher but such extension shall not include time for any further appeal process. Within ten (10) days' time after such suspension becomes effective, the local board of education shall initiate a hearing for dismissal pursuant to law. However, in a case involving a criminal charge or indictment, such suspension may extend to such time as the teacher's case is finally adjudicated at trial. Provided, however, such extension shall not include any appeal process. (70-6-101.29)
