Times of Use. 4.1 The parties acknowledge that the Operator is entitled to use the Cafe and Kitchen Area during the Library Opening Hours as specified in Item 5 of the Schedule, or as otherwise agreed between the Operator and the Principal. The Principal shall advise the Operator of any changes to the Library Opening Hours that are agreed between the College Council and CoGG. 4.2 During School Hours, the Operator shall operate a Canteen for students from the serving window located in the northern wall of the kitchen area within the Cafe and Kitchen Area. The Operator shall operate a Cafe for members of the public from the Cafe area shown on Plan 1 at such times as it determines during the Library Opening Hours, negotiated with the College. 4.3 The Operator shall inform the Principal of its proposed operating hours for the Cafe business, within the Library Opening Hours, on an annual basis and must inform the Principal of any changes to those operating hours. 4.4 The College Council shall advise CoGG and the Operator in writing at the commencement of the school year of the school term times for that year and shall give the Operator 4 weeks (or as much notice as possible) written notice of Student Free Days. 4.5 The Operator is entitled to access (on a non-exclusive and shared basis) the Shared Lounge and the Shared Amenities at the times that it is entitled to use the Cafe and Kitchen Area. 4.6 The College Council shall provide the Operator with keys to access the Cafe and Kitchen Area. The Operator must secure the Cafe and Kitchen Area at the close of business each day.

Times of Use. Dates and times shall be mutually agreed to with SMSU’s Athletic Director or designee and the MISD 413 designee. Anticipated use is for Marshall High School home varsity football and varsity soccer games, the one-day marching band competition referred to as “Pursuit of Excellence”, and an evening marching band performance referred to as “Thank You Xxxxxxxx”. Limited practice times for the above activities may also be scheduled at dates and times that are mutually agreed to by SMSU’s Athletic Director or designee and MISD 413 representatives. If additional activities are added by MISD 413 in the future, they will be afforded the same accessibility and terms as prescribed in this agreement. Once dates and times are determined MISD 413 will schedule all times through the SMSU Scheduling Office. Minnesota State will issue MISD 413 keys for entry to the facility to the MISD Athletic Director and to the Head Coaches of the relative sports. The keys shall not be duplicated and shall not be used by anyone except an identified MISD 413 professional staff member who will be held responsible for the safekeeping of the key. Parking arrangements shall be agreed upon in writing between MISD 413 and the SMSU Athletic Department outside the scope of this agreement. Use of the suites in The Xxxxxx Regional Event Center when used as a conference facility will be allowed for MISD 413 events on a space available basis at mutually agreeable times. Use of conference facilities will be coordinated by the SMSU Scheduling Office. MISD 413 use of The Xxxxxx Regional Event Center for home varsity football and varsity soccer games as well as marching band performance events will include use of the suites by those individuals who have paid SMSU for this use. General admission ticket sales revenue at varsity football and soccer games will be the only direct source of revenue that MISD 413 will be entitled to. Suite revenue, which includes the cost of admission to regularly scheduled events, will be solely the property of Minnesota State. Twenty four or more tickets to the University Suite will be made available to MISD 413 to use for all MISD 413 events as long as the Suite has not been leased to others. After use of the SREC, MISD 413 maintenance staff will pick up large items of garbage and debris and leave said bags of garbage on the concourse.
