Transfer Committee Clause Samples
The Transfer Committee clause establishes a designated group responsible for overseeing and approving the transfer of interests, shares, or assets within an organization or agreement. The committee shall be comprised of twelve (12) persons, six (6) appointed by the Superintendent and six (6) appointed by the AEA President. The goal of the committee is to make recommendations on changes to the 2020 winter/spring transfer process designed to improve the District. Recommendations of the committee will be issued to the parties on or before June 1, 2020.
Transfer Committee. A. A Transfer Committee shall be established consisting of three members appointed by the District and three members appointed by the Union.
B. Teachers who are having performance problems and are on a Job Target and/or a Plan of Assistance and/or Letter of Deficiency, may be restricted from using the Transfer Article during the time period of the Job Target, Plan of Assistance, or Letter of Deficiency.
C. A teacher under a Job Target, Plan of Assistance or Letter of Deficiency may make a request to the District to be provided the opportunity to utilize the transfer article by requesting the Transfer Committee to meet to discuss the pending situation. A majority of the Transfer Committee shall make a decision on whether or not the teacher shall be able to use the Transfer Article.
D. If the Transfer Committee cannot reach agreement, the superintendent shall decide.
Transfer Committee. Prior to the First Round , the Transfer Committee shall be established consisting of 3 members appointed by the District and 3 members appointed by the Union.
Transfer Committee a) The Transfer Committee shall consist of the Superintendent of Human Resources, representative(s) of the Teachers (assigned by the Association) and other staff as designated by the Superintendent of Human Resources.
b) The Transfer Committee shall make recommendations regarding the assignment of teacher(s). The assignment of teacher(s) shall be done in the following priority:
i. teachers declared surplus as per Article 25:08
ii. teachers returning from system class/system appointments
iii. teachers returning from a leave of absence
iv. teachers accessing absolute transfers
v. teachers seeking a change in contractual status
c) The recommendation of 25:09(b), shall be instituted prior to the placement of any new hires.
d) Notwithstanding b) above, teachers assigned by the Transfer Committee to two different schools shall have the right to accept an equivalent position in one school that may become available prior to the start of the next school year.

Transfer Committee. A transfer committee is a joint committee comprised [sic] of two (2) representatives of the Association and two (2) representatives from the Board. The committee shall review all involuntary transfers. A member who is the subject of an involuntary transfer may make application, within five (5) days of being notified of such transfer, for the committee to review the transfer. The Committee may make recommendations but the Chief retains the right to final decision. The Association submissions indicate the impetus for this proposal arises from recent membership complaints concerning assignments not all of which opportunities were made known to the members. As well, a grievance has been filed recently in regard to the transfer of an Association member. The intention behind its proposal is for transparency, openness and consistency regarding postings and transfers processes.
Transfer Committee. Between February 1 and May 1 the Transfer Committee shall consider requests for transfer to vacant teaching positions. A Transfer Committee shall be comprised of the Superintendent or designee, appropriate building principals and two teachers appointed by Representative. In filling any teaching position by transfer, the criteria to be considered shall include: qualifications and experience; contributions teacher could make to students in vacant position/impact on students in leaving current position; and seniority. Transfers will be approved only when there is consensus among all members of the Transfer Committee. When consensus cannot be reached, the Superintendent or designee shall determine the issue. Upon written request, the Superintendent or designee shall provide a written summary of the Transfer Committee’s decision to any teacher not approved for transfer.
