Unpaid Leave - Public Office. Employees shall be granted unpaid leave of absence to enable them to run for elected public office and if elected, to serve their term(s) of office subject to the following provisions:
(a) Employees seeking election in a Municipal, Provincial or Federal election shall be granted unpaid leave of absence for a period up to ninety (90) calendar days.
(b) Employees elected to public office shall be granted unpaid leave of absence for a period up to five (5) years.

(1) for employees to seek election in Municipal, Provincial, Federal Office, for a maximum period of ninety (90) days;
(2) for employees elected to a Municipal, Provincial or Federal Public Office up to a maximum of five (5) years. In any event, if any employee is elected as a Member and Director of the Gitxsan Health Society, such employee will resign as an employee of the Society when he/she takes such office.

(1) for employees to seek election in Municipal, Provincial, Federal or Skidegate Band Council, for a maximum period of ninety (90) days;
(2) for employees elected to a Municipal, Provincial Federal or Skidegate Band Council up to a maximum of five (5) years. Provided however this Article is subject to the Conflict of interest Rules of the Skidegate Band Council. In any event, if any employee is elected as a Member and Director of the Skidegate Band Council such employee will resign as an employee of the Board when he/she takes such office. It is understood that if there is any conflict between the provisions of this Article and the provisions of the Skidegate Band Council Regulations the Regulations will prevail to the extent of such conflict.

(1) for employees to seek election in Municipal, Provincial, Federal, Nisga’a Village Government, Nisga’a Lisims Government election or an election under the Nisga’a Elections Act for a maximum period of ninety (90) days;
(2) for employees elected to a Municipal, Provincial Federal or Nisga’a Village Government or Nisga’a Lisims Government Public Office up to a maximum of five (5) years. Provided however this Article is subject to the Conflict of interest Rules of the Nisga’a Lisims Government and the Nisga’a Elections Act and Regulations. In any event, if any employee is elected as a Member and Director of the Employer such employee will resign as an employee of the Employer when he/she takes such office. It is understood that if there is any conflict between the provisions of this Article and the provisions of the Nisga’a Elections Act and Regulations, the Act and Regulations will prevail to the extent of such conflict.

Such leave will be granted on the understanding the employee shall relinquish their position with the Employer, permitting it to be posted permanently as staffing requirements dictate. Upon making him/herself available for reinstatement upon expiry of their term of office, provided the employee has all of the qualifications, knowledge, education, abilities, experience and personal suitability as determined by the Employer to perform the full scope of the work required, the employee shall be permitted first to exercise their seniority in any vacancy that exists, or, if no vacancies exist, to exercise their seniority over the most junior employee in the job they previously worked in. In exercising seniority, the returning employee may displace only another employee working the same (or fewer) hours as the returning employee was working at the time leave was granted.
