Usage of Term Employment. SPEA recognizes that short-term situations may arise which result in peaking resourcing demand, or requirements for special skills and expertise not otherwise available. In such situations, the Company may employ professional employees for specified terms for an identified scope of work, subject to the following: (i) The Company undertakes to keep the number of term employees to the minimum necessary to meet its operational commitments; (ii) A term employee may be recalled/hired into skills with active recall lists only in the circumstances and under the conditions outlined in Article 22.07. (iii) The term of such arrangements shall be related to the scheduled length of the work requirement, but shall not exceed thirty- six (36) months. In calculating the thirty-six (36) month period, employment gaps of less than two months will not reset the clock (nor will the gap be counted towards the thirty-six 36 month period). If the term employment is renewed or extended beyond the maximum of thirty- six (36) months, the term employee will automatically become a permanent employee. Otherwise employment ceases at the end of any term. The provisions set out in Article 22.07 apply with respect to term employees recalled/hired into skills with active recall lists. (iv) There shall be at least a six month gap between terms, where the cumulative length of term employment exceeds 36 months. The cumulative length of term employment shall not exceed 60 months. These limits may be waived with SPEA’s agreement. (v) On a monthly basis, SPEA will be notified of any term employees hired, specifying their name, length of contract, PG grade, skill category and department; (vi) No permanent employee may be offered term employment. (vii) The number of term employees shall be limited as follows: Term employees in the combined SPEA-SE (scientists and engineers) and SPEA-TT (technicians, technologists and trades) bargaining units cannot exceed 20% of the combined bargaining unit membership or 160 (SPEA-SE and SPEA-TT combined), whichever is less; and Term employees cannot exceed 25% of the SPEA-SE bargaining unit or 150 SPEA-SE term employees, whichever is less

In such situations, the Company may employ professional employees for specified terms for an identified scope of work, subject to the following: (i) The Company undertakes to keep the number of term employees to the minimum necessary to meet its operational commitments; (ii) Prior to hiring a term employee, the Company will first rehire employees on the recall list if they are capable of performing the required work. In cases of an assignment to a client, the individual must be accepted by the client, the Company shall contact the client to ascertain whether the employee on the recall list is acceptable to the client. If that employee is not acceptable to the client, the term employee may be hired; (iii) The term of such arrangements shall be related to the scheduled length of the work requirement, but shall not exceed twenty-four (24) months. If the term employment is renewed or extended beyond the maximum, the term employee will automatically become a permanent employee. Otherwise employment ceases at the end of any term. (iv) On a monthly basis, SPEA will be notified of any term employees hired, specifying their name, length of contract, PG grade, skill category and department; (v) No permanent employee may be offered term employment.

  • Fixed Term Employment A fixed term employee is an employee engaged for specific period, project or task on an hourly basis and their rate of pay shall be 1/38th of the weekly rate prescribed by the Agreement. A fixed term employee will accrue leave entitlements (annual, personal/carers, long-service) on a pro-rata basis.

  • Effect of Termination of Employment (a) Upon the effective date of termination of the Employee's employment pursuant to Section 6, Section 7(a) or Section 7(c) hereof, neither the Employee nor the Employee's beneficiaries or estate shall have any further rights under this Agreement or any claims against the Corporation arising out of this Agreement, except the right to receive, within 30 days of the Termination Date: (i) the unpaid portion of the Base Salary provided for in Section 5(a), computed on a pro rata basis to the Termination Date; (ii) reimbursement for any expenses for which the Employee shall not have theretofore been reimbursed, as provided in Section 5(d); and (iii) the unpaid portion of any amounts earned by the Employee prior to the Termination Date pursuant to any Benefit Arrangement; provided, however, unless specifically provided otherwise in this Section 8, the Employee shall not be entitled to receive any benefits under a Benefit Arrangement that have accrued during a fiscal year if the terms of such Benefit Arrangement require that the beneficiary be employed by the Corporation as of the end of such fiscal year. (b) Upon the termination of the Employee's employment pursuant to Section 7(b), neither the Employee nor the Employee's beneficiaries or estate shall have any further rights under this Agreement or any claims against the Corporation arising out of this Agreement, except the right to receive: (i) the unpaid portion of the Base Salary, computed on a pro rata basis, for the period from the Commencement Date until the first anniversary of the Termination Date, payable in such installments as the Base Salary was paid prior to the Termination Date; and (ii) the payments, if any, referred to in Sections 8(a)(ii) and (iii). (c) The Employee's obligations under Sections 9, 10 and 11 of this Agreement, and the Corporation's obligations under this Section 8, shall survive the termination of this Agreement and the termination of the Employee's employment hereunder.

  • EMPLOYMENT TERM AND COMPENSATION A. The Board hereby employs the Employee with such powers and duties as may be fixed by the Board. B. The Board shall pay to the employee a salary of $1,924 per bi-weekly pay period ($50,017 Annualized), for the term commencing on 10/11/2021 and ending on 6/30/2022, in installments less any legally authorized deductions as the DBM B32, Social Media Coordinator, Public Relations and Marketing. C. Employee agrees to fulfill the aforesaid position for the period above mentioned. D. The Board shall designate eight and one-half (8.5) percent of the compensation paid to the Employee as the Board contribution on behalf of the employee in satisfaction of the Employee's required contribution to the Illinois State Universities Retirement System. The purpose of this section is to allow such Board contribution for retirement to be tax sheltered after the qualifying period of time has been met and to the extent allowed by the appropriate statutes and regulations. Both parties acknowledge that the Employee did not have the option of choosing to receive the contributed amounts directly, instead of having such contributions paid by the Board to the State Retirement System, and that such contributions are made as a condition of employment to secure the Employee's future services, knowledge and experience.

  • Outside Employment Employees may engage in other employment outside of their State working hours so long as the outside employment does not involve a conflict of interest with their State employment. Whenever it appears that any such outside employment might constitute a conflict of interest, the employee is expected to consult with his/her appointing authority or other appropriate agency representative prior to engaging in such outside employment. Employees of agencies where there are established procedures concerning outside employment for the purpose of insuring compliance with specific statutory restrictions on outside employment are expected to comply with such procedures.

  • During Employment During Employee’s employment hereunder, Employee shall not engage, directly or indirectly, as an employee, officer, director, partner, manager, consultant, agent, owner (other than a minority shareholder or other equity interest of not more than 1% of a company whose equity interests are publicly traded on a nationally recognized stock exchange or over-the-counter) or in any other capacity, in any competition with the Company or any of its subsidiaries.

  • Fixed Term Employees The only terms of this Agreement that apply to employees who are not regular employees are those that are set out in Articles 31A, 32, 33 and 34. 31A.1 Articles 31A.2 to 31A.16 apply only to fixed-term employees other than seasonal, student and GO Temp employees.

  • Duration of Employment 5.1 A seafarer shall be engaged for the period specified in Appendix 1 to this Agreement and such period may be extended or reduced by the amount shown in Appendix 1 for operational convenience. The employment shall be automatically terminated upon the terms of this Agreement at the first arrival of the ship in port after expiration of that period, unless the Company operates a permanent employment system.

(ii) In the event the Company elects not to extend the Employment Term pursuant to Section 1 and Executive’s employment has not been earlier terminated pursuant to Sections 7(a), (b), (c), or (e), the Employment Term shall expire and Executive’s employment hereunder shall terminate as of the end of the day immediately preceding the commencement of a subsequent Renewal Term, and Executive shall be entitled to receive the payments and benefits applicable to a termination of Executive’s employment without Cause pursuant to Section 7(c) or Section 7(e), as applicable. Except as set forth in this Section 7(d)(ii) and for any rights to indemnification and claims for liability insurance coverage under officer and director policies, Executive shall have no further rights to any compensation or any other benefits under this Agreement.
