Used aircraft. 5.2.2.1. For a used aircraft for which a design approval was granted by the Importing Party, the Exporting Party through its Competent Authority responsible for the oversight of the Certificate of Airworthiness of that aircraft shall issue an Export Certificate of Airworthiness certifying that the aircraft: (a) conforms to a type design approved by the Importing Party in accordance with this Procedure; (b) is in a condition for safe operation, including compliance with all applicable airworthiness directives of the Importing Party, as notified by that Party; (c) has been properly maintained using approved procedures and methods during its service life, as evidenced by logbooks and maintenance records; and (d) meets all additional requirements prescribed by the Importing Party, as notified by that Party. 5.2.2.2. For used aircraft manufactured under its jurisdiction, each Party agrees to assist upon request the other Party in obtaining information regarding: (a) the configuration of the aircraft at the time it left the manufacturer; and (b) subsequent installations on the aircraft that it has approved. 5.2.2.3. The Parties shall also accept each other’s Export Certificates of Airworthiness for used aircraft manufactured and/or assembled in a third country when the conditions of subparagraphs 5.2.2.1(a) to (d) of this Procedure have been met. 5.2.2.4. The Importing Party may request inspection and maintenance records that include, but are not limited to: (a) the original or certified true copy of an Export Certificate of Airworthiness, or its equivalent, issued by the Exporting Party; (b) records which verify that all overhauls, major changes, and repairs were accomplished in accordance with the requirements approved or accepted by the Exporting Party; and (c) maintenance records and log entries which substantiate that the used aircraft has been properly maintained throughout its service life in accordance with the requirements of an approved maintenance program.

Used aircraft. 4.6.3.1. For a used aircraft for which a Design Certificate was granted by the Importing Party, the Competent Authority of the State of Registry from which the product is exported shall issue an Export Certificate of Airworthiness certifying that the aircraft: (a) conforms to a type design approved by the Importing Party in accordance with this Annex; (b) is in a condition for safe operation, including compliance with all applicable airworthiness directives of the Importing Party, as notified by that Party; (c) has been properly maintained using approved procedures and methods during its service life, as evidenced by logbooks and maintenance records; and (d) meets all additional requirements prescribed by the Importing Party, as notified by that Party. 4.6.3.2. Used aircraft may be exported only if a holder of either a type certificate or a restricted type certificate/type certificate for restricted category exists to support continued airworthiness of that aircraft. 4.6.3.3. For used aircraft manufactured under its production oversight system, each Party agrees to assist, upon request, the other Party in obtaining data and information regarding: (a) the configuration of the aircraft at the time it left the manufacturer; and (b) subsequent changes and repairs applied to the aircraft, that it has approved. 4.6.3.4. The Importing Party may request inspection and maintenance records as detailed in the Technical Implementation Procedures. 4.6.3.5. If, in the process of assessing the airworthiness status of a used aircraft considered for export, the Competent Authority of the Exporting Party is unable to satisfy all of the requirements specified in point 4.6.3.1 or 4.

Used aircraft. 3.2.5.5.1 Used aircraft for which there has been a design approval granted by the IAC-AR The IAC-AR will recognize used aircraft for import into its own country for airworthiness certification and operation when the CTA-IFI certifies, by the issuance of an Export Certificate of Airworthiness, that: (a) The used aircraft has been found to conform to the originally approved type design/type certificate of the IAC-AR; (b) The used aircraft has complied with all pertinent safety issues and concerns (e.g., airworthiness directives, mandatory service bulletins etc.) issued by the exporting and importing airworthiness authority for that model and series aircraft; (c) The used aircraft has. been properly maintained and operated using approved procedures and methods acceptable to the importing airworthiness authority during its service life (evidenced by logbooks and maintenance records); (d) The used aircraft meets all the special requirements of the importing country; and, (e) The used aircraft is presently in a condition for safe operation. 3.2.5.5.2 Used aircraft for which there has been a design approval granted by the CTA-IFI Reserved. 3.2.5.5.3 Used aircraft exported from a Third Party Reserved.

  • Lease of Aircraft Lessor agrees to lease the Aircraft to Lessee pursuant to the provisions of FAR Section 91.501(b)(6) and Section 91.501(c)(1) and this Agreement, and to provide a fully-qualified and credentialed flight crew for all flights to be conducted hereunder during the Term (as defined in Section 13) hereof. The parties acknowledge and agree that this Agreement did not result in any way from any direct or indirect advertising, holding out or soliciting on the part of Lessor or any person purportedly acting on behalf of Lessor.
