Initial Appointments. The Company appoints the Trustee as the initial Paying Agent, the initial Registrar and the initial Conversion Agent.

In acting in such capacities under this Indenture and in connection with the Notes, the Trustee in such capacities will act solely as an agent of the Company and will not thereby assume any obligations towards, or relationship of agency or trust for or with, any Holder.
Initial Appointments a. Head coaches shall, at the option of the President, be offered either an athletic appointment of three (3) to ten (10) years duration or a probationary appointment.
b. Assistant coaches may be offered an athletic appointment of up to three (3) years duration.
c. Nothing in this Agreement shall preclude the award of a fixed-term contract consisting primarily of coaching and/or athletic related duties.
Initial Appointments. At the time of a formal offer of employment, Western shall advise the faculty member, in writing, of the terms and conditions of the appointment as follows: the type of appointment; salary; credit for prior service toward tenure, promotion, and sabbatical (if any is granted); and length of the tenure probationary period (if appropriate for the appointment). If a visa or other approval by U.S. Citizenship and Immigration Services is required for the prospective faculty member to work for Western, the letter of appointment shall also state the reimbursement of fees, expenses, and/or costs pertaining to relocation (if any are granted). Under extraordinary circumstances, tenure may be awarded at the time of the initial appointment with the recommendation of the department and bargaining unit faculty members. Western shall provide the prospective faculty member with a copy of this Agreement and a copy of the appropriate Department Policy Statement. Western shall also inform the prospective faculty member that the Chapter is the exclusive bargaining agent for the faculty (see Witnesseth of the Agreement; see also: Article 17, Tenure Policy and Procedures).

The initiation and coordination of search activities for prospective new appointees to the library shall be the responsibility of the Director or his or her designee, who shall keep the Personnel Committee informed of these activities. The Director may discuss with the Personnel Committee the professional criteria to be fulfilled by any candidates, and may request that the Personnel Committee interview candidates.
2. If the Committee is requested by the Director to interview candidates, the Committee and the Director shall cooperate in arrangements for personal interviews. No travel expenses will be authorized without the prior approval of the College/University official responsible for such matters in the normal course of College/University procedures.
3. If the Committee is requested to review the pool of candidates, the Committee shall transmit its recommendations to the Director who shall transmit the Committee's recommendations, along with the Director's own recommendation, to the appropriate Vice President and the President for ultimate recommendation to the Board of Trustees.
Initial Appointments. (a) An offer of an appointment has been made to the successful applicant when it is given in writing and signed by the appropriate Xxxx. An employee will normally not commence service at the College until the employee has accepted in writing his/her offer of appointment.
(b) Initial appointments may be term (full-time or part-time) or continuing (full- time or part-time - over 50%). Appointments will be subject to a probationary period for the equivalent of two (2) years.
(c) Whenever possible, the offer of appointment shall be made at least two weeks prior to the date of commencement of appointment. This clause shall not apply to appointment of substitute instructors.
(d) The College will ensure that the Union is fully aware of the criteria and procedures for salary placement.

Initial Appointments a. Head coaches shall, at the option of the President, be offered either a four (4) year athletic or a probationary appointment.
b. Nothing in this Agreement shall preclude the award of a fixed-term contract including head coaching duties in any category in accordance with Article 21, Section E., Subd. 1.
