ACCIDENTS OR BREAKDOWNS. 11.1 Explore WA offroad Camper Hire provides no breakdown cover. We recommend RACWA & NRMA in the event of a breakdown situation for towing services. We will assist you when you alert us of a problem. 11.2 If you are hired through the Camplify Platform, hire provides all Equipment Rental with breakdown cover via the NRMA. 11.3 If the Explore WA Offroad Camper Hire Equipment breaks down because of a Mechanical Breakdown You must contact Explore WA offroad Camper Hire on 0406108480 or by sending an email to Explore WA offroad Camper Hire xxxxx@xxxxxxx-xx.xxx. Hires through Camplify come with nation wide roadside assistance through the NRMA. The NRMA can assist with: tyre changing; lost keys; basic problems, or keys locked in the Camplify Equipment, however please note that extra charges will apply if any of these services are provided at your request above any inclusions in your hire. RAC WA also offer similar services. 11.4 We will provide all practical assistance including making available a replacement Equipment subject to it’s availability. 11.5 If the NRMA need to be engaged to retrieve the Owners Equipment the following is the maximum that Camplify will cover if hires of Explore WA Offroad Camper Hire Equipment has been hired using the platform. All additional costs will be at the Owner cost where the Owners Equipment is at fault, or the Hirer where the Hirer has caused the incident; (a) up to 50km towing in metro and country areas, (b) 100km in remote areas, (c) or up to $3000 in towing cover in a major breakdown. 11.6 If You or an Authorised Driver has an Accident or if the Explore WA offroad Camper Hire Equipment is stolen You must report the Accident or theft to the Equipment owner within 12 hours of it occurring and fully complete an Accident/Theft report form ( Provided on request ) . If the Explore WA offroad Camper Hire Equipment is stolen or if You or an Authorised Driver has an Accident where: any person is injured; the other party has failed to stop or leaves the scene of the Accident without exchanging names and addresses; or the other party appears to be under the influence of drugs or alcohol, You or the Authorised Driver must also report the theft or Accident to the Police. ACCIDENTS OR BREAKDOWNS. 9.1 We will provide You with a Vehicle that is of acceptable quality and in good working but breakdowns do occur. You must notify Us as soon as practical of any accidents or damages to the vehicles. Twenty four hour roadside assistance is provided and if You require assistance You must contact Us on 9.2 We are not responsible for: (a) Damage as a result of use of the incorrect fuel type; (b) a flat battery because the lights or accessories have been left on; (c) tyre changing, tyre replacement, punchers, blowouts or associated damage from blowouts; (d) brake pad wear, bearing collapse, clutch burnout or any other rotating part failure; (e) lost keys or remote control device; or (f) keys or remote control device locked in the Vehicle, and extra charges will apply if any of these services are provided at Your request. 9.3 If You or an Authorised Driver has an Accident or if the Vehicle is stolen You must report the Accident or theft to Us within 24 hours of it occurring and fully complete an Accident/Theft report form. 9.4 If the Vehicle is stolen or if You or an Authorised Driver of the Vehicle has an Accident where: (a) any person is injured; (b) the other party has failed to stop or leaves the scene of the Accident without exchanging names and addresses; or (c) the other party appears to be under the influence of drugs or alcohol, You or the Authorised Driver must also report the theft or Accident to the Police. 9.5 If You or an Authorised Driver has an Accident You and the Authorised Driver must: (a) exchange names and addresses and telephone numbers with the other driver; (b) take the registration numbers of all vehicles involved; (c) take as many photos as is reasonable showing: (i) the position of the Vehicles before they are moved for towing or salvage; (ii) the Damage to the Vehicle; (iii) the damage to any third party vehicle or property; and (iv) the general area where the Accident occurred, including any road or traffic signs; (d) obtain the names, addresses and phone numbers of all witnesses; (e) not make any admission of fault or promised to pay the other party's claim or release the other party from any liability; (f) forward all third party correspondence or court documents to Us within 7 days of receipt; and (g) co-operate with Us in the prosecution of any legal proceedings that We may institute or defence of any legal proceedings which may be instituted against You or Us as a result of an Accident, including attending Our lawyer's office or...
ACCIDENTS OR BREAKDOWNS a. We will provide You with a Vehicle that is of acceptable quality and in good working order taking into account the age of the Vehicle. b. Twenty four hour roadside assistance is provided free of charge and in the event You require assistance You must contact Our roadside assistance provider RAC on 13 11 11 to arrange that assistance. They will supply all practical assistance as soon as practicable. c. In case of a breakdown or mechanical issue and the vehicle or trailer needs to go to the mechanic overnight the following compensation will be provided: Option 1: Compensation and Resumption of trip i. We will pay for up to 3 nights' accommodation in a caravan park or hostel, at a value of up to $250 per night, for up to 3 nights, for the group; ii. We will organise a taxi/s to the mechanic and/or accommodation; iii. We will supply a temporary vehicle rental for up to 3 days, to be returned to the same location; and iv. You will be additionally reimbursed for $26.00 per person for each night You are not able to use the Vehicle or trailer. Option 2: Cancellation of the remaining days of trip. i. We will organise transport to the nearest city; and ii. We will refund you for the remaining rental days and inclusions not yet used, but not for the days and fuel already used. d. We are not responsible for: i. Damage as a result of use of the incorrect fuel type; ii. a flat battery because the lights or entertainment systems have been left on; iii. tyre changing;
ACCIDENTS OR BREAKDOWNS. 30.1 Trailer2You will provide the Hirer with a Trailer that is of acceptable quality and in good working condition taking into account the age of the Trailer but does not warrant that breakdowns will not occur. If the trailer breaks down during the Hire Period the Hirer must contact Trailer2You to arrange assistance. Trailer2You will recover and repair the Trailer as soon as possible but if it cannot be repaired Trailer2You will use its best endeavours to provide a replacement Trailer when one is available. If the cause of the breakdown is attributable to the actions of the Hirer or conduct or preventative actions the Hirer failed to take, the Hirer is liable for all damage to the trailer and any costs incurred to recover the Trailer. 30.2 Subject to the Australian Consumer Law, Trailer2You is not responsible for: (a) loss of enjoyment; or (b) consequential or economic loss. 30.3 Trailer2You is also not responsible for tyre changing.

ACCIDENTS OR BREAKDOWNS. 15.1 Twenty four hour roadside assistance is provided free of charge for breakdowns (but not for Accidents) and You must contact the service provider, 365 Assistance Pty Ltd, on 1300 302 500 to arrange that assistance. Provided there has not been a Major Breach Our roadside assistance provider will supply all practical assistance as soon as practicable. 15.2 We are also not responsible for and there is no roadside assistance for: (a) damage as a result of use of the incorrect fuel type; (b) a flat battery because the lights, accessories or entertainment system have been left on without the engine running; (c) a flat battery where the Vehicle has not been used for more than 3 consecutive days; (d) tyre changing or replacement as a result of a puncture or damage to the wheel; (e) lost keys or remote control device; or (f) keys or remote control device locked in the Vehicle. 15.3 If the Vehicle needs to be towed to another location for repair or work on the Vehicle, We reserve the right to have the Vehicle towed to Our facility in Xxxxx where the distance is not greater than 50 kilometres. Where the towing distance exceeds 50 kilometres, the Vehicle will be towed to the nearest practicable preferred partner of 365 Assistance Pty Ltd. 15.4 You will be responsible for any charges incurred for roadside assistance. You must submit a request for reimbursement for any roadside assistance costs incurred by providing a valid receipt to Us in writing, where the costs are not attributable to clause 15.

  • Accidents If a death, serious personal injury or substantial property damage occurs in connection with CONTRACTOR’s performance of this Agreement, CONTRACTOR shall immediately notify Mendocino County Risk Manager's Office by telephone. CONTRACTOR shall promptly submit to COUNTY a written report, in such form as may be required by COUNTY of all accidents which occur in connection with this Agreement. This report must include the following information: (1) name and address of the injured or deceased person(s); (2) name and address of CONTRACTOR's sub-contractor, if any; (3) name and address of CONTRACTOR's liability insurance carrier; and (4) a detailed description of the accident and whether any of COUNTY's equipment, tools, material, or staff were involved.

  • Shortages Claims for shortages in the amount of Products shipped by Patheon will be dealt with by reasonable agreement of the parties.

  • Act of God Landlord shall not be required to perform any covenant or obligation in this Lease, or be liable in damages to Tenant, so long as the performance or non-performance of the covenant or obligation is delayed, caused or prevented by an act of God, force majeure or by Tenant.

  • Accident INVESTIGATIONS Whenever an accident occurs involving the equipment or personnel of a Supporting Party, the Protecting Party shall take immediate steps to notify the Supporting Party that an accident has occurred. As soon as practical, the Protecting Party shall initiate an investigation of the accident. A team made up of appropriate representatives from all affected agencies shall conduct the investigation. Costs for investigation personnel are Party-specific and will be borne by the sending Party. Other accident or incident investigation costs are the fiscal responsibility of the Party (ies) that has jurisdiction and/or investigative responsibility. The sharing of information between Parties on accident investigations and their findings and probable causes is a valuable tool for safety and must be encouraged.

  • Explosion Riot or civil commotion.

  • Fire a. Driver to park vehicle in safe location and turn off engine. b. Driver to remove client(s) to closest safe area. c. Driver to call 911. d. Driver to call the Dispatcher. e. Driver to attempt to contain fire (If safe to do so) using fire extinguisher located in the vehicle. f. TC to notify OoA of incident and file written report.

  • Breakdown The failure of a COVERED PART under normal service and usage of the VEHICLE. A COVERED PART has failed when it can no longer perform the function for which it was designed solely because of its condition.

  • Sabotage Sabotage is of concern to all Parties involved on any work site and may affect safety, and therefore both the physical and mental well being of all persons on site. The Parties to this Agreement will not tolerate sabotage, and will ensure that any person/s responsible for such action is immediately dismissed. It is accepted that the relevant authorities may have to be notified, and provisions of the OH&S Act implemented.

  • Earthquake including land shock waves or tremors before, during or after a volcanic eruption;

  • Vandalism Or Malicious Mischief This peril does not include loss to property on the "residence premises", and any ensuing loss caused by any intentional and wrongful act com- mitted in the course of the vandalism or malicious mischief, if the dwelling has been vacant for more than 60 consecutive days immediately before the loss. A dwelling being constructed is not consid- ered vacant.
