After Leave of Absence. X. Xxxxxxxxx employees who have been granted leaves of absence shall notify the Superintendent in writing of their intention to resume work at the beginning of the ensuing semester. Such notice shall be given by the following dates: B. Except where otherwise required by Civil Service Law or Regulation, or sick leave, or child-related leave, no absence without pay granted to School Related Personnel shall exceed three (3) months’ duration. Notification of intent to return to employment upon the expiration of such leave of absence shall be received in writing by the Assistant Superintendent for Business and Administration no later than fourteen (14) days prior to the expiration date of said leave. C. If the School District has, prior to the end of a leave, sent a written reminder by certified or registered mail, return receipt requested, to an employee on leave of his/her obligation to give notice of intent to return to work as provided in Paragraphs A and B above, an employee who fails to give the required notice by the later of (i) the applicable date set forth in Paragraphs A and B above or (ii) seven (7) days after the written reminder from the School District shall be conclusively presumed to have abandoned his/her employment. An employee who claims to have been incapacitated from giving such notice may challenge this presumption through the grievance and arbitration procedure. D. To the extent possible, all employees returning from leaves of absence shall be restored to the same position they held at the time leave was granted.
After Leave of Absence a. A unit member is expected to return from his or her unpaid leave of absence on the first day of work of the semester following the end of the approved leave period. Unit members must confirm their return before November 1 when the approved leave period ends the first semester of a school year. Unit members must confirm their return before April 1 when the approved leave period ends the second semester of a school year. Unit members failing to confirm their return in accordance with this provision will lose their rights of seniority for assignment purposes. b. Unit members who wish to return earlier than the originally approved leave date may make such a request to the District. The District will attempt to accommodate the request if in the best interest of the District. c. Unit members returning from leave shall be reassigned to their former posi- tion or a position of equal status in their area of certification, tenure and interest, consistent with applicable law. (1) A tenured unit member returning from a leave of absence shall retain his or her tenured status. (2) Upon the return of a tenured unit member from a leave of absence, the District may recommend to the Teacher’s Retirement Board the granting of retirement credit for the duration of the aforesaid leave, provided that the unit member executes an agreement to reimburse the District for any pay- ment to the Retirement Board in full if he or she leaves the District within one (1) year and fifty percent (50%) thereof if he or she leaves before the end of the second year.

  • LEAVE OF ABSENCE 14.01 An employee requesting a leave of absence shall apply to his Supervisor and if such leave is granted it shall be authorized in writing but shall not exceed one hundred eighty (180) days, provided, however, that if an emergency arises which prevents the employee on leave from returning at the end of the leave granted, he may apply for an extension. (a) Not withstanding the above, an employee with fifteen (15) years of more of service may apply once for a special leave of absence at the time vacations are being scheduled for the following year subject to the following conditions: (i) The employee's leave of absence must be taken in conjunction with the employee's remaining vacation entitlement in excess of two (2) week’s vacation. An employee may request that the leave of absence be taken in conjunction with full vacation entitlement and, (ii) Leaves of absence and vacation may only be taken during the period October 1st to June 21st and, (iii) The employee must apply in writing to the Operations Manager. It is understood that the granting and scheduling of such leave of absence will be subject to the needs of operations and an assessment of the reasons for the request for leave. 14.02 Upon written application to the Manager, the Company will grant extended leaves of absence, without pay, to not more than one (1) member of the Union to enable him to attend to the affairs of the Union. During any such leave of absence all service rights shall be retained except that service rights shall not be counted for the period of such leave of absence. Any such leave of absence shall not exceed six (6) months and not more than two (2) leaves of absence shall be applied for or granted in any calendar year regardless of the duration thereof. 14.03 Upon written application to the Manager at least two (2) weeks prior to the event, the Company will grant leave of absence to not more than two (2) employees from any one (1) division to attend to the business of the Union. Notwithstanding the provisions of Clause 14.03, the Company shall be under no obligation to grant any leave of absence to attend to the business of the Union for more than: (a) One (1) employee from any of the following areas: Die Room Welders Utilities Electrical Annealers, or (b) Two (2) employees from any of the following areas:

  • Unpaid Leave of Absence If an employee is on an unpaid leave of absence, then vacation leave, compensatory time, or sick leave cannot be used for the purpose of maintaining eligibility for an Employer Contribution by keeping the employee on a State payroll for one (1) working day per pay period.

  • General Leave of Absence a) Leave of absence without pay may be granted to employees for valid reasons as set out by Company policy. b) An employee on general leave of absence shall not accumulate sick leave credits, or earn vacation but shall retain the seniority, sick leave credits, and vacation credits earned prior to commencing leave of absence. c) Employees do not have the option of continuing their benefit coverage during the leave. d) Employees on leave of absence shall be required to apply for any extension.

  • Extended Leave of Absence ‌ A. The Committee agrees that one teacher, on professional status, designated by the Association, per contract year, may at the discretion of the Committee be granted a leave of absence for no more than two (2) years without pay for the purpose of engaging in Association (local, state or national) activities. Upon return from such leave, the teacher may be considered as if he/she were actively employed by the Committee and may be placed on the salary schedule at the level he/she would have achieved if he/she had not been absent on such leave. B. A leave of absence, without pay, of up to two (2) years, will be granted to one teacher, on professional status, per school year, for the purpose of joining the Peace Corps, or serving as a teacher in an exchange program approved by the Superintendent, and, provided further that said teacher is a full-time participant in either of the above described programs. Upon return from such leave, a teacher will be considered as if he/she were actively employed by the Committee during the leave and will be placed on the salary schedule at the level he/she would have achieved if he/she had not been absent on such leave. C. Military leave without pay will be granted to a teacher upon such teacher's enlistment or induction in the armed forces of the United States, to extend through such teacher’s initial enlistment or tour of duty. On return from such leave, the teacher will be placed on the salary schedule at the level he/she would have achieved had he/she remained actively employed by the Cohasset Public Schools during the period of his/her absence. If the teacher should voluntarily remain in the armed forces beyond the expiration of his/her enlistment or first tour of duty, his/her place on the salary schedule shall be determined at the discretion of the Committee. D. A maternity/paternity/adoption leave of absence without pay of up to one (1) year will be granted upon request to a teacher who has been employed on active duty for his/her full schedule for a minimum of three (3) consecutive months prior to the start of the leave period. A request for maternity/paternity/adoption leave must be submitted under ordinary circumstances in writing to the Superintendent of Schools at least eight (8) weeks before the requested anticipated date of departure, and the anticipated date of return must be specified. A teacher who takes an extended leave unpaid in excess of eight (8) weeks for the purpose of child-rearing must submit notification in writing to the Superintendent of Schools at least eight

  • Personal Leave of Absence The Administrator may grant a request for leave of absence for personal reasons without pay provided that he receives at least one (1) month's clear notice, in writing, unless impossible, and provided that such leave may be arranged without undue inconvenience to the normal operations of the Nursing Home. Employees when applying for such leave shall indicate the proposed date of departure and return. Such leave shall not be unreasonably withheld.
