Appeal of Discharge or Discipline. Should the discharged or disciplined employee consider the discharge or discipline to be improper, a grievance shall be presented in writing as provided in the grievance procedure. In cases of discharge, or discipline resulting in suspension, the grievance shall be filed at Step 2 of the grievance procedure within 10 days of the discharge.

Should the discharged or disciplined employee and the Xxxxxxx consider the discharge or discipline improper, a complaint shall be presented, in writing, through the Xxxxxxx to the Superintendent’s designated representative within three (3) regular scheduled working days of the discharge or discipline. The Superintendent’s designated representative will review the discharge or discipline and give an answer within five (5) regular scheduled working days after receiving the complaint. If the decision is not satisfactory to the Union, the matter shall be referred to Step Three of the grievance procedure.

If the employee desires to appeal the matter further, it shall be referred to the Grievance Procedure at Step 2 within two (2) regularly scheduled working days following such answer by the Employer.

In imposing any discipline on a current charge, the Employer will not take into account any prior infractions which occurred more than two (2) years previously. After the contract year 1985-86, the employer will not take into account any prior infractions which occurred more than three (3) years previously. This Article only applies to non-probationary employees.
