Applicable to Home Care. The parties to this Agreement recognize the uniqueness of the Home Care Program and recognize the need for guaranteed hours of work to assist in providing quality care. Where the Employer and the Union have Letters of Understanding in place in respect to any portion or all of the provisions of Article 13.02, such agreements shall be maintained unless the parties agree otherwise.
Applicable to Home Care. Payment for call back shall commence from the time the employee receives the call and will continue until the time the employee returns to their home.
Applicable to Home Care. An OTFT Employee reporting for work shall receive a minimum payment of two (2) hours at their regular rate of pay. Wherever practical, the Employer will consolidate work into shifts of four or more hours.
Applicable to Home Care. An Employee's hours of work shall be confined within a twelve (12) hour period in any one
(1) day beginning with the start of the shift, however, an Employee may be required to report for duty on different occasions in such twelve (12) hour period.
Applicable to Home Care. 1) Hours of Work Applicable to PPT, OTFT, and Casual Employees
a) In order to maximize hours and in accordance with Article 13.02 2), employees may be required to work irregular hours within the following restrictions:
i) An employee shall not work more than twelve (12) hours per day;
ii) An employee shall not work more than one hundred and twelve (112) hours averaged over a three (3) week period, calculated from November 7, 1999;
iii) An employee's hours of work shall be confined within a twelve (12) hour period beginning with the first (1st) hour worked. However, an employee may be required to report for duty on different occasions in such twelve (12) hour period, provided the hours do not conflict with the hours previously agreed upon under Article 13.02 2) c). At least eleven point five (11.5) consecutive hours must separate the last hour worked and the first (1st) hour of the next work period. Nothing shall preclude the Employer and the Union from establishing an extended shift agreement.
iv) No employee shall be required to work more than seven (7) consecutive days without receiving days off, except by mutual agreement between the Union and the Employer;
v) Employees shall not be required to work more than two (2) weekends in four (4) unless there is mutual agreement between the Union and the Employer. A weekend shall be defined as the consecutive hours between 0001 hours Saturday and 2400 hours Sunday. Wherever possible, notice of weekend assignment will be given at the beginning of each month to the affected employee.
b) If the employee is required to work beyond the preceding restrictions overtime pay shall be paid for all such hours worked.
c) Payment For Work-Related Duties All time spent performing authorized work-related duties including but not limited to charting, maintaining supplies, or communicating client information shall be considered as time worked.
d) Minimum Pay
i) Effective July 1, 1999, on each occasion an employee reports for work, he/she shall receive a minimum of two (2) hours at their regular rate of pay;
ii) An employee who arrives at a client's residence for work and who is unable to perform such work due to client absence or refusal shall receive pay as if they had worked;
iii) In i) or ii), wherever possible, employees shall contact the Home Care office immediately for assignment to other duties.
Applicable to Home Care. An Employee on OTFT status shall not be required to work more than one (1) weekend in two (2) unless there is mutual agreement as in 6.15 above. Rural Employees may be required to work a maximum of two (2) weekends in any four (4) weekends, only when a relief Employee is not available to work; otherwise, rural Employees shall have one (1) weekend off in two (2) weekends. If the relief Employee is not made available and the Employee has to work more than two weekends in four, then the Employee shall receive double times (2x) her regular rate of pay for all hours so worked. It is understood that the Employee has the responsibility of bringing to the attention of the Employer that she has worked the previous weekend(s) and that her being required to report for duty would violate the intent of this provision. Failure to do so would result in waiver of any claim to a violation of this Article.
Applicable to Home Care. Employees shall be provided with an unpaid meal break of at least one-half (1/2) hour during a work day. Where presently established Employees shall retain the option of up to a one (1) hour unpaid meal break with the option of reducing the unpaid meal break to one-half (1/2) hour at the request of the Employee and with the approval of the Employer.
Applicable to Home Care. An Employee on OTFT status shall not be required to work more than one (1) weekend in two (2) unless there is mutual agreement. Rural Employees may be required to work a maximum of two (2) weekends in any four (4) weekends, only when a relief Employee is not available to work; otherwise, rural Employees shall have one (1) weekend off in two (2) weekends. Applicable to Home Care. The Employer is not responsible for transportation costs for reporting to or returning from a shift, unless the employee’s residence is her home base.
Applicable to Home Care. OTFT-JS shall mean one (1) of no more than two (2) Employees who share a full time position.
