Breaks between periods of duty. (a) An employee will be entitled to a minimum break of 10 consecutive hours between the end of one period of duty and the beginning of the next. This applies in relation to both ordinary hours and where overtime is worked. (b) Where an employer requires an employee to continue or resume work without having a 10-hour break off duty, the employee is entitled to be absent from duty without loss of pay until a 10-hour break has been taken, or be paid at 200% of the ordinary rate of pay until released from duty. (c) The entitlements in sub-clauses 26.6(a) and (b) do not apply to: (i) an employee who is provided with accommodation on the employer’s premises or in the vicinity of the employer’s premises; (ii) an employee who is attending a school camp or excursion; or (iii) an employee working a broken shift.

Where the School requires a Lutheran School Officer to continue or resume work without having a ten-hour break off duty, the Lutheran School Officer is entitled to be absent from duty without loss of pay until a ten-hour break has been taken, or be paid at 200% of the ordinary rate of pay until released from duty. The entitlements in Clauses 80.1 and 80.2 do not apply to: boarding house supervisors, where the periods of duty are continuous with a sleep over;

Breaks between periods of duty. A professional staff member who has worked overtime but has not had a break of at least ten (10) consecutive hours, between the cessation of one period of duty and the commencement of the next ordinary period of duty, will be released for a minimum rest period of ten (10) consecutive hours plus reasonable travel time (based on the time normally required for the staff member to travel from home to/ from work). Such release will be without any loss of pay for scheduled ordinary duty occurring during such absence.

(b) Where the employee does not get a 10 hour rest:‌ (i) The following conditions apply to an employee, who on the instructions of the employer, resumes or continues work without having had 10 consecutive hours off duty in accordance with clause 4.3(a) of this Schedule: A. the employee is entitled to be absent from duty without loss of pay until a 10 hour break has been taken; or B. the employee is entitled to be paid 200% of the minimum hourly rate until released from duty.
