Catastrophes. 12.7.1 No administrator shall suffer loss of pay or reduction of vacation days in the event a general catastrophe (such as severe weather conditions, utility failure, etc) closes down all or portions of the school district. This article is modified for the 2011-2012 and 2012-2013 school years in order to create two (2) furlough days. Members pay will be reduced by the member’s daily rate of pay, calculated in accordance with Article 4.7.1, for two (2) days. This reduction will occur in the form of a deduction, spread out over 20 pay periods. The parties anticipate the furlough days will be taken on the first two days where district wide classes are canceled by the District due to weather conditions, health concerns, or other “Acts of God.” If a member is required by the District to work on a furlough day(s), s/he will take a furlough day(s) on an alternative date, at the discretion of the member. In the event a member’s scheduled sick, personal or vacation day coincides with a furlough day, the member will not be charged the sick, personal or vacation day. If two “Act of God” (furlough) days have not occurred by March 30 of a given year, the parties agree to meet to discuss other options for furlough days. Those members who intend to resign at the end of the 2011-2012 school year and notify in writing their intent to resign to the Human Resources Department by August 15, 2011, will be given an irrevocable option of making a healthcare contribution deduction in lieu of the two (2) unpaid furlough days. This contribution will equal the equivalent of two days pay and will be in addition to the healthcare contribution required under Article 13.
Catastrophes. (hurricane, tornado, earthquake, flood, act of terrorism, etc.) If a catastrophe occurs, the owner is not responsible for any of the following: 1. Finding alternate lodging for the renter. 2. Renter's financial losses related to transportation or alternate lodging. If, on the day that the rental is scheduled to begin, the property is uninhabitable, or the property is not reachable by the renter's usual means of transportation, or access to the property by visitors has been prohibited by authorities, then the owner will at the option of the renter either refund all money paid by the renter for the vacation rental, including any deposit and prepaid rent or hold all funds for a future rental. If renters are required by local authorities to evacuate the area, and actually do so before their stay in a vacation rental is completed, then the owner will refund or hold for future rental a pro-rated portion of the unused rent, plus any deposit.

  • Sabotage Sabotage is of concern to all Parties involved on any work site and may affect safety, and therefore both the physical and mental well being of all persons on site. The Parties to this Agreement will not tolerate sabotage, and will ensure that any person/s responsible for such action is immediately dismissed. It is accepted that the relevant authorities may have to be notified, and provisions of the OH&S Act implemented.

  • DISTURBANCES Tenant and all other occupants will be required to vacate the premises and forfeit the rental fee and security deposit for any of the following: Occupancy exceeding the agreed upon number people, using the premises for any illegal activity, causing damage to the premises rented or to any of the neighboring properties and any other acts which interferes with neighbors' right to quiet enjoyment of their premises. HOLD HARMLESS iTrip or the Owner, does not assume any liability for loss, damage or injury to persons or their personal property. Neither does owner accept any liability for any inconveniences, damage, loss or injury arising from any temporary defects or stoppage in supply of water, gas, cable service, electricity or plumbing, as well as due to weather conditions, natural disasters, acts of God, or other reasons beyond its control.

  • Accidents If a death, serious personal injury or substantial property damage occurs in connection with CONTRACTOR’s performance of this Agreement, CONTRACTOR shall immediately notify Mendocino County Risk Manager's Office by telephone. CONTRACTOR shall promptly submit to COUNTY a written report, in such form as may be required by COUNTY of all accidents which occur in connection with this Agreement. This report must include the following information: (1) name and address of the injured or deceased person(s); (2) name and address of CONTRACTOR's sub-contractor, if any; (3) name and address of CONTRACTOR's liability insurance carrier; and (4) a detailed description of the accident and whether any of COUNTY's equipment, tools, material, or staff were involved.

  • War We do not Cover an illness, treatment or medical condition due to war, declared or undeclared.

  • Explosion Riot or civil commotion.

  • Pandemic An epidemic that spreads over a wide area, crossing borders and defined as a pandemic by the World Health Organisation (WHO) and/or by the competent local authorities of the country where the loss occurred. Isolation of the person, in the event of suspected illness or proven illness, decided by a competent local authority, in order to avoid a risk of spreading said illness in the context of an epidemic or pandemic.

  • Weather User understands and agrees that during the term of this agreement, User will strictly adhere to the Weather Protocols set forth in the Grand Park Emergency Management Plan. The Grand Park Emergency Management Plan is made available on the Grand Park website or by request a copy may be provided by the Commission. In the event of inclement weather, the Commission will retain final determination as to the ability of the facility to support the Event. a. If the facility is unable to support the event due to an "Act of God" the Commission will not provide a refund or credit to the User. User may obtain event insurance through a vendor of their choosing to cover the "Act of God" scenario. b. If the facility is deemed unable to support the event by the Commission, the Commission will work with the User to reschedule such activity as was affected by the facility closure. In such case that the activity may not be rescheduled, Commission will credit the User for such activity as was affected by the closure and allow the credit to be utilized toward a future event. c. If the facility is deemed unable to support the event by the User, the Commission will work with the User to reschedule such activity as was affected within the general time constraints of the User's Event. In such case that the activity may not be rescheduled, Commission will not credit the User.

  • Vandalism Vandalism will result in cancellation of privileges. Vandalism is defined as any malicious attempt to harm or destroy data of another user, Internet, or any of the above listed agencies or other networks that are connected to any of the Internet backbones. This includes, but not limited to, the uploading or creation of computer viruses.

  • Act of God Landlord shall not be required to perform any covenant or obligation in this Lease, or be liable in damages to Tenant, so long as the performance or non-performance of the covenant or obligation is delayed, caused or prevented by an act of God, force majeure or by Tenant.

  • Acts of God In the event either party is unable to perform its obligations under the terms of this Management Agreement, despite having taken commercially reasonable precautions, because of acts of God, interruption of electrical power or other utilities, equipment or transmission failure or damage reasonably beyond its control, or other causes reasonably beyond its control, such party shall not be liable to the other for any damages resulting from such failure to perform or otherwise from such causes. The Manager and the Trust shall notify each other as soon as reasonably possible following the occurrence of an event described in this subsection.
