Change Proposals. If The Owner requests the Design/Builder to submit a Change Proposal which would entitle the Design/Builder to an increase in the GMP for costs of preparation of such Change Proposal pursuant to the provisions of this Section 6.3, the Design/Builder shall first estimate the costs of preparing such Change Proposal and inform The Owner in writing of such costs. The Owner shall then direct the Design/Builder either to proceed with the Change Proposal or cancel the Change Proposal. If The Owner directs the Design/Builder to proceed with the Change Proposal and then elects not to proceed with the Change Order contemplated therein, a Change Order shall be issued to reimburse the Design/Builder for any costs incurred by the Design/Builder on account of such Change Proposal, but only to the extent the Change Order contemplated by such Change Proposal involves a material change to the scope of the Work requiring modification to one or more systems which have been designed and approved in accordance with the standards set forth in Section 2.4.3. To the extent the preparation of such Change Proposal impacts the Schedule (e.g., other Work is suspended pending a decision on such Change Proposal or the Design Work is delayed due to the preparation of the Change Proposal), an equitable adjustment in the Schedule shall be made.
Change Proposals. Within the time limits set out in this Section 7.6, after receipt of a Request For Change Order Proposal or a Construction Change Directive, the Contractor shall submit to the Owner and the Architect a written Change Order Proposal setting out any proposed adjustment in the Contract Sum or Contract Time, or both, to which the Contractor believes it (1) would be entitled as a result of the change in the Work proposed in the Request For Change Order Proposal or (2) is entitled as a result of the change in the Work directed by the Construction Change Directive. Such Change Order Proposal may be in the form of a lump sum proposal (with adequate cost substantiation as required by the Owner and calculations showing the amount of markups on costs), or a unit price proposal, or a combination thereof, for a proposed increase in the Contract Sum, and in similar form for a proposed extension of the Contract Time, and otherwise shall be in such form and in such detail as the Owner or the Architect may require. Such Change Order Proposal shall be submitted as soon as practicable after the Contractor’s receipt of the Request For Change Order Proposal or the Construction Change Directive, but in no event later that thirty (30) days after the Contractor’s receipt of the Request For Change Order Proposal or the Construction Change Directive.
Change Proposals. 10.1 Each variation of this Agreement must commence with a proposal made in accordance with the provisions of this Clause 10 (a Change Proposal).
Change Proposals. A proposal to change this Agreement (a Change Proposal) may only be made by a party to this Agreement (the Proposer).
Change Proposals. Material changes in scope, rush delivery, rework of items already approved or requests for additional revision cycles, services and/or deliverables beyond those listed herein hereafter known as change orders, shall not be effective until authorized representatives of both Parties execute a mutually acceptable written change order to this Agreement.
Change Proposals. A. Submit a Change Proposal (CP) to the Designer for Contractor initiated changes in the Contract Documents or in response to a Request for Change Proposal.
1. Use the Change Proposal form provided.
2. Assign a number to the Change Proposal when issued.
3. Include with the Change Proposal:
a. A complete description of the proposed Modification if Contractor initiated or proposed changes to the OPT’s description of the proposed Modification.
b. The reason the Modification is requested, if not in response to a Request for a Change Proposal.
c. A detailed breakdown of the cost of the change if the Modification requires a change in Contract Price. The itemized breakdown is to include:
1) List of materials and equipment to be installed;
2) Man hours for assification;
3) Equipment used in construction;
4) Consumable supplies, fuels, and materials;
5) Royalties and patent fees;
6) Bonds and insurance;
7) Overhead and profit;
8) Field office costs;
9) Home office cost; and
10) Other items of cost.
d. Provide the level of detail outlined in the paragraph above for each Subcontractor or Supplier actually performing the Work if Work is to be provided by a Subcontractor or Supplier. Indicate appropriate Contractor mark-ups for Work provided through Subcontractors and Suppliers. Provide the level of detail outline in the paragraph above for self-performed Work.
e. Submit Change Proposals that comply with Article 15 for Cost of Work.
f. Provide a revised schedule. Show the effect of the change on the Project Schedule and the Contract Times.
B. Submit a Change Proposal to the Designer to request a Field Order.
C. A Change Proposal is required for all substitutions or deviations from the Contract Documents.
D. Request changes to products in accordance with Article 25.
Change Proposals. Upon receipt of proposal from SPL to change the terms of an Order for Additional Services (a “Change Proposal”), RTU shall promptly provide (i) any information requested in such proposal, and (ii) its written acceptance or rejection of the proposal. RTU may not reject any Change Proposal that does not materially shorten the delivery or performance schedule or materially alter the Additional Services or Deliverables, and may not unreasonably reject any other Change Proposal. The Order shall be revised accordingly and authorized by the parties involved, including any change in fees and costs caused by or resulting from such Change Proposal.
Change Proposals. A. Submit a Change Proposal to the OAR to:
1. Request an adjustment in the Contract Price or Contract Times;
2. Appeal an initial decision by OPT concerning the requirements of the Contract Documents or relating to the acceptability of the Work under the Contract Documents;
3. Contest a set-off against payment due; or
4. Seek other relief under the Contract Documents.
B. Notify the OAR immediately if a Change Proposal is to be submitted. Submit each Change Proposal to OAR no later than 30 days after the event initiating the Change Proposal. Submit the following as part of the Change Proposal:
1. Any proposed change in Contract Price, Contract Times, or other relief, accompanied by a statement that the requested Change Order is the entire adjustment to which Contractor believes it is entitled;
2. The reason for the proposed change; and
3. Supporting data, accompanied by a statement that the supporting data is accurate and complete.
C. OAR is to advise OPT regarding the Change Proposal. OPT is to review each Change Proposal and Contractor’s supporting data, and within 30 days after receipt of the documents, direct the OAR to either approve or deny the Change Proposal in whole or in part. OAR is to issue a Change Order for an approved Change Proposal. The Contractor may deem the Change Proposal to be denied if OAR does not take action on the Change Proposal within 30 days and start the time for appeal of the denial under Article 13.
Change Proposals. Any changes to the term, deliverables, price or scope of a Sales Order will be documented in a “Change Request” to be signed by both Customer and Osprey within an amended Sales Order.
Change Proposals. Each variation of this Agreement must commence with a proposal made in accordance with the provisions of this Clause 10 (a Change Proposal). A Change Proposal may be made by any of the following:
10.2.1 a Party;
10.2.2 the Consumer Body;
10.2.3 the National Electricity Transmission System Operator;
10.2.4 any person or body that may from time to time be designated in writing by the Authority for the purpose of this Clause 10.2 (which may include, in respect of a Charging Methodology, any person whose interests are materially affected by that Charging Methodology); and
10.2.5 the Authority or a DNO/IDNO Party acting at the direction of the Authority (in each case only in relation to Authority Change Proposals).
