Child Care Facility.
(a) The Employer and the Union agree to establish a joint committee to facilitate the establishment of community based child care centres.
(b) The Joint Committee shall be composed of four union representatives and four employer representatives. The designates of each party shall be gender balanced. Employees representing the Union on this joint committee shall be on leave of absence without loss of basic pay for time on this committee.
(c) The Joint Committee may facilitate the establishment of community based child care facilities where viable.
(d) The Joint Committee may establish sub-committees where appropriate to facilitate objectives of this clause.
(e) The Joint Committee shall include representation and participation from interested community based groups or organizations. The Committee shall determine which community based groups or organizations shall be represented.
(f) The Joint Committee may seek the advice and support of other Public Service program areas including but not limited to the Ministry of Women's Equality, the Ministry for Children and Families, BCBC and the Employee Benefit Trust.
(g) Where suitable space is available in a government owned or leased facility without major or structural modification, the space may be made available for the purpose of establishing the community based child care facility. The Employer's sole financial responsibility is limited to the provision of such space.
Child Care Facility. (a) The Commission and the Union understand the importance of having adequate community based child care centres available. The Joint Committee can be used to discuss proposals for providing assistance in facilitating the establishment of community based child care centres where viable.
(b) Where suitable space is available in a Commission owned or leased facility without major or structural modification, the space may be made available for the purpose of establishing the community based child care facility. The Commission's sole financial responsibility is limited to the provision of such space.
Child Care Facility. Within ten (10) Business Days after Tenant’s written request, Landlord agrees to cooperate with Tenant in order to assess the feasibility of locating a child care facility in a portion of the retail area of the Project. Landlord’s cooperation shall consist of the following: (i) Landlord shall assess the strategic relocation, termination or other arrangements to create space in the retail area of the Project for the child care facility, (ii) Landlord shall support Tenant’s efforts with state and local government jurisdictions to secure any necessary approvals for the operation of a child care facility at the Project, and (iii) Landlord shall cooperate with Tenant in order to make rooftop space available (to the extent allowed by Law) on the selected retail area building for an outdoor play area, to the extent the foregoing is feasible. In the event Tenant is able to retain all necessary permits and approvals and Landlord is able to relocate and/or terminate the retail tenants in order to provide space for the child care facility, then Landlord agrees to lease to Tenant the child care facility for an initial term coterminous with the Phase I Premises, and Tenant shall pay rental for such space equal to the then prevailing market rate for comparable retail space in the Financial District of San Francisco without taking into account the use of such space as a childcare facility, and taking into further account the size of the Lease, the length of the term, market escalations and the credit of Tenant. In such event the parties shall agree to enter into an amendment to this Lease documenting the addition of the child care facility, which shall thereafter be included in the definition of “Premises” hereunder and subject to the terms and conditions relating to the Premises. Such amendment shall provide that Tenant shall be responsible for all costs associated with the construction, operation, and maintenance of the child care facility, Tenant shall acquire any insurance required by Landlord for the child care facility and, upon the termination of the term with respect to such child care facility, Tenant shall be responsible for restoring the space to its original condition prior to such space’s use as a child care facility. If the parties cannot agree upon the rent for the child care facility the rent shall be determined pursuant to an arbitration in accordance with Addendum 1 hereof. Child Care Facility. If a density bonus is requested for construction of a child care facility meeting the requirements of Section 10-12-7 of this Chapter, the application shall show the location and square footage of the proposed facility.
Child Care Facility. A project (whether a housing, commercial, or industrial project) is eligible for a density bonus for a child care facility when in compliance with Section 18.26.080 of this chapter and California Government Code Section 65917.5.

Lessee acknowledges that Lessor is contemplating the development, construction and/or operation of a child care facility which is to be located within Continental Park of which these Premises comprise one portion. Lessee agrees that since such a facility would confer a benefit on Lessee, as well as other Lessees of Continental Park, Lessee will make all reasonable efforts to cooperate with Lessor to accommodate the development and construction of such facility. These efforts shall include but are not limited to the taking of reasonable steps to comply with all local state and federal laws and other regulations which apply to Lessees operation of its business with regard to the placement of a child care facility in close proximity to the Premises or to reasonably modify Lessee's operations so as not to prohibit such placement so long as such action does not materially interfere with Lessee's business operation.
