Claim of Unjust Suspension or Discharge. A claim by a Nurse that such Nurse has been unjustly suspended or discharged shall be treated as a grievance and shall commence at Step 2 of the grievance procedure provided that the notice of appeal is delivered to the Chief Administrative Officer or designate within ten (10) working days of notice of the suspension or discharge. The Chief Administrative Officer or designate shall have the authority to confirm the Employer’s actions or respond by any manner which may be deemed just and equitable. Thereafter, the grievance procedure shall proceed as prescribed above.

Claim of Unjust Suspension or Discharge. A claim by an employee who has completed the probation period and holds seniority that such employee has been unjustly suspended or discharged, shall be treated as a grievance commencing at Step Two of the Grievance Procedure, provided that the grievance is mailed to the Administrator within ten (10) calendar days after the employee has received the notice of suspension or discharge. The notice of suspension or discharge shall be given to the employee in the presence of a Union Xxxxxxx provided, however, that if the employee is not at work and it is not possible to deliver the notice of suspension or discharge personally to such employee, such notice shall be sent to the employee by registered mail, and a copy shall be delivered to the Union Xxxxxxx. Thereafter, the grievance may be processed to arbitration in accordance with Article 8.04.

  • Unjust Suspension or Discharge Should it be found upon investigation that an employee has been unjustly suspended, discharged or disciplined, such employee shall be immediately reinstated in his/her former position, without loss of seniority, and shall be compensated for all time lost in an amount equal to his/her normal earnings plus interest, or by any other arrangement as to compensation which is just and equitable in the opinion of the parties or in the opinion of the arbitrator if the matter is referred to such arbitrator.
