Dayworks. Subject to the guidelines on Variation Order in Annex “E” of the 2016 revised IRR of RA No. 9184, and if applicable as indicated in the SCC, the Dayworks rates in the Contractor’s Bid shall be used for small additional amounts of work only when the Procuring Entity’s Representative has given written instructions in advance for additional work to be paid for in that way.
Dayworks. (a) At its sole discretion the Contractor’s Representative may direct that work the subject of a variation be carried out on a dayworks basis. (b) If directed to carry out dayworks, the Subcontractor, as a precondition to any entitlement to payment, each day must record all resources used in carrying out the work the subject of the variation and provide a copy to the Contractor’s Representative. (c) The Subcontractor’s entitlement to payment for dayworks is limited to: (i) the all-inclusive hourly rate agreed with, or determined by the Contractor’s Representative; and (ii) the actual cost of any plant, materials and equipment approved by the Contractor’s Representative to be used or provided, plus 10% of the actual costs.
Dayworks. When Dayworks are authorized by the Engineer all equipment, labour and materials shall be paid for at the rates listed in the Schedule of Dayworks in the Bill of Quantities. All major materials for Dayworks authorized by the Engineer but not included in the Schedule of Dayworks shall be paid for on a Prime Cost basis. The Contractor shall be paid on the basis of paid invoices showing cost of materials less any discount, paid receipts for transportation and handling charges and paid receipts for insurance on materials and delivery of materials. Before authorizing the use of materials in Dayworks the Engineer may require the Contractor to supply estimates of the costs of the materials. The Contractor shall be compensated for his expenses, overhead, labour and profit involved in procuring and delivering the materials by an amount equal to a percentage of the actual cost of the Prime Cost Sum.
Dayworks. 61.1 If applicable, the Dayworks rates in the Contractor’s bid shall be used for small additional amounts of work only when the Project Manager has given written instructions in advance for additional work to be paid for in that way. 61.2 All work to be paid for as Dayworks shall be recorded by the Contractor on forms approved by the Project Manager. Each completed form shall be verified and signed by the Project Manager within two days of the work being done. 61.3 The Contractor shall be paid for Dayworks subject to obtaining signed Dayworks forms.
Dayworks. (i) During the period of this Agreement the Network Rail’s Representative may require the Supplier to undertake Services reimbursed on a Daywork basis. Such Services shall be initiated using an instruction. The Services shall be priced using the rates set out in the Schedule of Rates. (ii) All Network Rail instructions shall be in writing. Verbal instructions from Network Rail’s Representative shall be of no effect unless confirmed in writing. (iii) Where instructions are issued for the supply of Services on an rates basis, the management of time-based costs shall be as follows:-
Dayworks. 4.2.8.1 If the Engineering Manager issues a Site Instruction on the condition that a Variation is to proceed on a Dayworks basis, the Contractor shall immediately proceed with the Variation so directed and shall record the resources utilised on the first day, on the Dayworks sheets (Appendix 5/L) which are issued with the Site Instruction. 4.2.8.2 At the conclusion of the first days Work, the Contractor shall present to the Area Manager the completed Dayworks sheet for verification and approval, whereupon the Area Manager shall issue the Dayworks sheet for the following day’s Work. This procedure shall be repeated until completion of the Variation ordered. 4.2.8.3 Under no circumstances will the Area Manager verify or approve a Dayworks sheet other than an original Dayworks sheet issued for Dayworks on that day. 4.2.8.4 LGL shall not be liable to pay the cost of any Variation executed pursuant to a Site Instruction issued on the condition that the Variation is to proceed on a Dayworks basis, unless the Work is recorded, verified and approved as set out above. 4.2.8.5 Dayworks shall be priced as follows: i) LABOUR shall be priced at the unit labour rates for Variations and Dayworks (Tender Form Appendix 10/B sheet 2) applicable to the class of labour engaged on the Work (excluding superintendence and administration). ii) PLANT AND EQUIPMENT shall be priced at the unit plant and equipment rates for Variations and Dayworks (Tender Form Appendix 10/B sheet 3).

Dayworks. 9.1 We will not carry out works on a day work basis. Any variation to our contract must be on a quotation/acceptance basis with a formal written variation to the contract provided by the Main Contractor. 9.2 We would clarify that any additional works charged on a daily rate will be charged at our rate appertaining at the time – currently (June 2024) £850.00 per day (ex vat)
Dayworks. Add the following section to the standard specifications: “Contents B1801 Scope B1802 General Requirements B1803 Measurement and Payment This section covers the listing of daywork items, for the use in determining payment for work which cannot be quantified in specific units in the schedule of quantities, or work ordered by the Service Manager during the maintenance period which was not foreseen at tender stage and for which no applicable rate exists in the schedule of quantities. Work will be classified as daywork only if the Service Manager considers no other rate in the Bill of Quantities appropriate for payment purposes. An instruction regarding all work to be carried out under daywork will be issued at the discretion of the Service Manager. Some or all the items priced under daywork in the Bill of Quantities may possibly not be required for this Contract. The Contractor and the Service Manager will agree on the method of recording the working hours prior to the commencement of the work. Any long period of idling at any one time which in the opinion of the Service Manager or his representative is beyond that required for normal operating conditions will not be paid for as working time. Non-working hours for any reason shall not be measured for payment. Before ordering any material, the Contractor shall submit quotations to the Service Manager for his approval and shall submit such receipts or vouchers to the Service Manager as may be necessary for proving the amount claimed.
