DEFINITION AND COVERAGE a. This article sets forth the criteria and comprehensive procedures by which the Employer shall impose discipline upon bargaining unit employees. For the purposes of this Agreement, disciplinary action is defined as those actions within 5 U.S.C. 7512 and lesser penalties, such as an oral admonishment and a written reprimand. b. Discipline is the responsibility and the right of the Employer. The Employer agrees that disciplinary actions shall be based on just cause and in accordance with applicable laws. The Employer further agrees to effect disciplinary actions in an efficient and timely manner. In this respect, when an employee is subject to discipline, the Employer will strive to effect disciplinary action within either 45 days of the offense, the Employer’s awareness of the offense, or the completion of an investigation of the matter by other than the supervisor, whichever occurs later. If, for reasons of significantly changed circumstances, further delay in taking the action is anticipated, a written notice from the Employer to the employee advising that disciplinary action is being considered, the general basis for the action, reason for the delay, and that the employee will be informed when a decision has been made satisfies the requirements of this section.

(b) The term “ supermarket” or “ supermarkets,” “ store" or “ stores” as herein used includes supermar­ kets, stores, shops, concessions, leased departments and establishments contained herein.
