Delivery, Installation and Removal. 6.1 The Equipment is hired to the delivery address advised by the Hirer and is not transferable to any other site or Hirer. The Hirer shall be required to inspect the Equipment as soon as practicable after it is delivered and to immediately notify the Owner (by facsimile or email) of any objection to or defect in the quantity or the type of Equipment supplied within twenty-four (24) hours of the Owner attending the Hirer’s site. The Hirer’s failure to report any discrepancies in the quantity or type of Equipment supplied or the condition of the Equipment, shall constitute deemed acceptance that the quantity and type and condition of the Equipment has been supplied in accordance with the Owner’s Installation Docket and shall be conclusive and irrefutable evidence of the information recorded therein and may be produced by the Owner as evidence in order to enforce its rights under this Agreement.
6.2 Cancellation of an order will, at the Owner’s discretion, be denied if the Owner has taken specific steps to satisfy that specific order.
6.3 Prior to the installation, it is the responsibility of the Hirer to inform the Owner about the position of any services or obstacles on the site that may hinder the installation process. However, upon the Owner attending the Hirer’s site, the Hirer acknowledges that the Owner may need to alter the position of the Equipment not in accordance with the Hirer’s instructions if there are any obstacles
6.4 If the Hirer requires the installation of additional Equipment after the initial installation, or the removal of some Equipment prior to the expiration of the Hire Term (‘part pickup’), then additional charges may apply.
6.5 If there is any delay in the delivery or removal of Equipment and such a delay is beyond the control of the Owner, additional charges may apply.
6.6 The Hirer shall not under any circumstances, move, reposition, modify or tamper with (or attempt to do so) the Equipment, unless the Hirer obtain the prior written approval of the Owner. If the Owner’s approval is given, the Owner shall in its discretion, either authorise the Hirer to undertake such relocation or modifications or alternatively, the Owner shall arrange to attend the Hirer’s site to undertake such relocation or modification to the Equipment at an additional charge payable by the Hirer.
6.7 All Equipment installed, serviced and dismantled from site may be photographed as proof of action. The Hirer should be aware that these photographs may be used...

Delivery, Installation and Removal. Upon receipt of a fully executed contract, the Contractor will arrange to deliver all units based on Rental Periods listed in Section C. The Contractor will verbally notify the CDFW Contract Manager by telephone at least twenty-four (24) hours prior to any Contractor-initiated delivery, removal, transfer, or new delivery of any units. The Contractor will install all portable toilet units securely to the ground with stakes, or as agreed upon by the CDFW Contractor Manager and Contractor, to prevent tipping due to high winds or vandalism. a) Delivery and Removal Contractor will deliver portable toilets to EWR Wildlife Area within 48 hours of Request by the CDFW Contract Manager or designee and will remove portable toilets from EWR Wildlife Area within five (5) working days of request by the CDFW Contract Manager or designee. Contractor will verbally notify the CDFW Contract Manager 24 hours prior to any Contractor-initiated removal, transfer, or new delivery of any units.
Delivery, Installation and Removal. (i) Licensee agrees that it shall be responsible for the shipment, installation and promptly following the end of the Term, the removal, of the Equipment at its sole cost and expense except as specifically set forth herein.
(ii) Park Management shall have the right, but not the obligation to test and inspect the Equipment and the installation and operation of the Equipment during the Term. Licensee agrees, at its sole cost and expense, to remedy any problems with the Equipment and installation thereof, upon Park Management's request, including, without limiting the foregoing, problems associated with defective design, engineering, workmanship, failure of factory construction, materials or any components.

(i) Licensee agrees that it shall be responsible for the shipment, installation and, promptly following the end of the Term, the removal, of the Equipment, including parts therefor and/or Replacement Equipment (as hereinafter defined), at its sole cost and expense. Licensee agrees that time is of the essence with respect to this Agreement and the business of the Park is significantly affected by Licensee's ability to have the Equipment installed and operating on schedule and that the business, revenues and profits of the Park will be affected in a materially adverse manner if the Equipment is not ready (in good working order) for operation on the Commencement Date. Licensee agrees to ship to and install the Equipment in the Park by March 19, 1999.
(ii) Six Flags shall have the right, but not the obligation, to test and inspect the Equipment and the installation and operation of the Equipment during the Term. Licensee agrees, at its sole cost and expense, to remedy any problems with the Equipment and installation thereof, upon Six Flags' request, including without limiting the foregoing, problems associated with defective design, engineering, workmanship, failure of factory construction, materials or any component parts.
Delivery, Installation and Removal a. Company shall deliver the Product to Customer in the manner set forth in the Purchase Order, described in Section 3 below.
b. Initial installation of the Product(s) shall be performed by the Company, or an authorized agent of Company, or an authorized representative of the customer at Customer’s premises. A representative of Customer must be present during installation.
c. If a Customer wants to return any Product(s) prior to or at the conclusion of the Trial Period Program, Customer shall provide the Company written notice of Customer’s intention to terminate this Agreement, and Company shall schedule the return of the Product(s) in accordance with its business demands and available work force.

IMI (in association with HOST and shipment carrier) agree to provide, oversee, and deliver, unpack, install, repack and remove TUT to and from exhibition site as outlined in ITEM 1 (DATES and VENUES) and ITEM 11 (SHIPPING). IMI agrees to have all TUT displays prepared for installation and exhibition on or before the first day of public exhibition to be . Removal of TUT by IMI will take place on the last day of exhibition immediately after closing hour and continue throughout the following days as necessary to prepare shipment for delivery to next destination. IMI reserves the right to omit, add to, or replace any TUT item.
(a) If for any reason IMI is unable to deliver and install TUT after the signing of this agreement or should withdraw the collection prior to the first day of exhibition, IMI agrees to immediately return the exhibition deposit fee ($ ).
