DISQUALIFICATION OF BIDDERS. Any one or more of the following causes may be considered as sufficient for the disqualification of a bidder and the rejection of his proposal or proposals:
a. More than one proposal for the same contract from an individual, firm, or corporation under the same or different names.
b. Evidence of collusion among bidders.
c. Unsatisfactory performance record as evidenced by past experience.
d. If the unit prices are obviously unbalanced either in excess or below reasonable cost analysis values.
e. If there are any unauthorized additions, interlineation, conditional or alternate bids or irregularities of any kind which may tend to make the proposal incomplete, indefinite, or ambiguous as to its meaning.
f. Non-attendance of mandatory pre-bid meetings may be cause of disqualification.
DISQUALIFICATION OF BIDDERS. The Department may disqualify any bidder and reject the bidder’s proposal or proposals for any of the following reasons:
DISQUALIFICATION OF BIDDERS. 5.3.1 An agency shall determine that each Bidder on any Public Works Contract is responsible before awarding the Contract. Factors to be considered in determining the responsibility of a Bidder include:
A. The Bidder’s financial, physical, personnel or other resources including Subcontracts;
B. The Bidder’s record of performance on past public or private construction projects, including, but not limited to, defaults and/or final adjudication or admission of violations of the Prevailing Wage Laws in Delaware or any other state;
C. The Bidder’s written safety plan;
X. Xxxxxxx the Bidder is qualified legally to contract with the State;
X. Xxxxxxx the Bidder supplied all necessary information concerning its responsibility; and,
F. Any other specific criteria for a particular procurement, which an agency may establish; provided however, that, the criteria be set forth in the Invitation to Bid and is otherwise in conformity with State and/or Federal law.
5.3.2 If an agency determines that a Bidder is nonresponsive and/or nonresponsible, the determination shall be in writing and set forth the basis for the determination. A copy of the determination shall be sent to the affected Bidder within five (5) working days of said determination.
5.3.3 In addition, any one or more of the following causes may be considered as sufficient for the disqualification of a Bidder and the rejection of their Bid or Bids.
5.3.3.1 More than one Bid for the same Contract from an individual, firm or corporation under the same or different names.
5.3.3.2 Evidence of collusion among Bidders.
5.3.3.3 Unsatisfactory performance record as evidenced by past experience.
5.3.3.4 If the Unit Prices are obviously unbalanced either in excess or below reasonable cost analysis values.
5.3.3.5 If there are any unauthorized additions, interlineation, conditional or alternate bids or irregularities of any kind which may tend to make the Bid incomplete, indefinite or ambiguous as to its meaning.
5.3.3.6 If the Bid is not accompanied by the required Bid Security and other data required by the Bidding Documents.
5.3.3.7 If any exceptions or qualifications of the Bid are noted on the Bid Form.
DISQUALIFICATION OF BIDDERS. Any of the following reasons may be considered as sufficient for the disqualification of a bidder and the rejection of its bid: • Submission of more than one bid for the same work from an individual, firm, or corporation under the same or different name. Evidence that the bidder has a financial interest in the firm of another bidder for the same work. • Evidence of collusion among bidders. Participants in such collusion will receive no recognition as bidders for any future work of the County until such participant has been reinstated as a qualified bidder. • Uncompleted work which in the judgment of the County might hinder or prevent the bidder’s prompt completion of additional work if awarded. • Failure to pay or satisfactorily settle all bills due for labor and material on contracts in effect at the time of issuing the invitation to bid or default under previous contract. • Listing of the bidder by any Local, State or Federal Government/Agency on its debarred/suspended vendor list.
DISQUALIFICATION OF BIDDERS. If a bidder or offeror who otherwise would have been awarded a contract is found non-responsible, a written determination of non-responsibility setting forth the basis of the finding shall be prepared by the Procurement Services Office Manager. The unreasonable failure of a bidder or offeror to promptly supply information in connection with an inquiry with respect to responsibility may be grounds for a determination of non-responsibility with respect to such bidder or offeror. The final determination shall be made part of the solicitation contract file.

DISQUALIFICATION OF BIDDERS. No person, firm or corporation shall be allowed to make, file, or be interested in more than one bid for the same work unless alternate bids are called for. (A person, firm or corporation who has submitted a sub-proposal to a Bidder, or who has quoted prices or materials to a Bidder, is hereby disqualified from submitting a bid in their own behalf).
DISQUALIFICATION OF BIDDERS. Any or all of the following reasons may be deemed by Owner in its sole discretion as being sufficient for the disqualification of a bidder and the rejection of his proposal: • More than one proposal for the same work from an individual, firm, or corporation under the same or different name; • Evidence of collusion among bidders; • Failure to submit all required information requested in the bid specifications; • Lack of competency or of adequate machinery, plant or other equipment, as revealed by the statement of bidders qualification or otherwise; • Uncompleted work which, in the judgment of the owner, might hinder or prevent the prompt completion of additional work if awarded; • Failure to pay, or satisfactorily settle, all bills due for labor and materials on former contracts; • Default or unsatisfactory performance on previous contracts; or • Such disqualification would be in the best interests of the Owner.
