DUTIES OF THE LESSEE. The Lessee hereby agrees to comply with the following duties and conditions:
1. Do the payments on the exact dates established in this Agreement and comply with the duties established hereto.
2. Keep the Leased Areas in excellent conditions, the Lessee shall provide the periodic maintenance needed.
3. In the event the Lessee requires to perform an improvement to the Leased Areas of the Properties, the Lessee must notify via email to Lessor such circumstance and must have the approval of the Lessor prior to perform the improvement needed. The Lessee will be solely responsible for the employees hired to work at the Leased Areas and therefore, release the Lessor of further liabilities regarding the Lessee's employees. The Lessee must register its own employees before the Costa Rican Social Security Board (CCSS) and shall execute the Labor Risk Insurance for their employees before the Insurance Board (INS). This last condition will not apply to subcontractors hired by the Lessee. Lessee shall not perform any of the following activities at the Leased Areas, without the prior consent of the Lessor:
DUTIES OF THE LESSEE. 7.01 The Lessee shall during the Lease Period in respect of each Bus:
(i) use its reasonable endeavours to procure that the Buses are operated by drivers who at all times hold valid driving licences in the appropriate classes;
(ii) indemnify each Owner against fines, penalties and liabilities imposed on such Owner arising as a result of any non-compliance or contravention of any transport, traffic or other law or regulation by the Lessee or any wrongs done or accidents caused by the Lessee’s drivers (save where such breach or wrong done or accident is caused by or attributable to the act, omission or default of such Owner, their employees, agents or contractors), together with any cost or expense relating thereto which may be reasonably incurred by such Owner;
(iii) be responsible for the cost of service and maintenance (including but not limited to materials, oil, grease and lubricants) in accordance with the manufacturer’s recommendations, together with the cost of any necessary repairs and for all fuels and lubricants for the proper running of the Buses;
(iv) provide and pay for all tyres required to be replaced through fair wear and tear or otherwise (i.e. the standard tread pattern shall be with a depth of at least 1mm throughout at least 3/4 of the breadth of the tread and round the entire outer circumference of the tyre or at the minimum standard as prescribed by the Road Traffic Ordinance (Chapter 374 of the Laws of Hong Kong) or any subsidiary legislation thereof from time to time);
(v) bear the cost of the repair or rectification of any damage to the Buses (fair wear and tear excepted) and keep the relevant Owner fully indemnified against all losses, liabilities or damages as a result of or in connection with the aforesaid (except for any loss, liability or damage arising out of the default, negligence or omission of such relevant Owner, their employees, agents or contractors); and
(vi) at its own expense arrange for the Buses to be road tested and obtain the vehicle test certificates in respect of the Buses at such time and in such manner as required by laws.
DUTIES OF THE LESSEE. Xxxxxx agrees to, in addition to other duties as specifically set forth herein, perform the following:
A. Acquire necessary permits and licenses associated with the lawful operation of its business upon the Premises.
B. Comply with all Airport Minimum Standards and Regulations, all City and County regulations and ordinances, all State and Federal regulations and laws, and all applicable sales and use tax requirements, effective at the time of this Lease and throughout the Primary and Renewal Terms hereunder.
X. Xxxxxxxx and provide, as requested by Xxxxxx, accurate records of its gross sales together with all tax returns of Lessee relative to Xxxxxx’s gross sales. All car rental fees shall be attributed to the Premises, unless written documentation sufficient to demonstrate otherwise is provided. Lessor or its authorized agent shall have the right to inspect, examine and audit Xxxxxx’s records, books and accounts, including the right to retain an independent certified public accountant of Lessor’s choosing and at Lessor’s expense to do so. If such audit reveals a deficiency in payment to Lessor greater than 5% (five percent), Lessee shall, in addition to payment of the deficiency, be liable for all costs associated with the audit. Xxxxxx’s records shall be open to review by Lessor or Xxxxxx’s authorized agent for three (3) years after the end of the termination or expiration of this Lease for purposes of determining accuracy of the financial information.
D. In the Ready/Return Paved Lot, Concessionaires are responsible for signage, markings, painting, snow removal between vehicles, and towing of any vehicles that do not belong in their assigned area. The County will provide snow removal in the driving lanes. This area is secondary priority and will be completed after the streets and sidewalks in front of the Airport Terminal are completed.
E. In the overflow gravel lot, it is the responsibility of the Concessionaire to assure the spaces are utilized properly including signage, markings, towing of any unauthorized vehicles and all snow removal. All vehicles in the overflow gravel lot must remain operational at all times.
DUTIES OF THE LESSEE. The LESSEE shall:- Pay all charges for electricity and water supplied to the property. Pay all amounts due in terms of this lease free of exchange. Not cede or assign the lease. Not sub-let the whole or any part of the property to anyone other than his immediate family in occupation thereof without the written consent of the LESSOR, which consent shall not be unreasonably withheld. Keep the property clean, habitable and tidy.
(i) Not make structural or other alterations, additions to or improvements in the property without the written consent of the LESSOR;
(ii) Not be entitled to compensation for any structures erected on or any improvements made to the property upon restoration thereof to the LESSOR. Permit the LESSOR or his duly authorised Agent to inspect the property at all reasonable times. Be responsible for the maintenance, repair, upkeep and/or decoration of the property including all ceilings, all wall and floor coverings, all doors and windows, all other fixtures, fittings, furnishings and any machinery and equipment in or on the property. Not cause any noise or nuisance which would in any way disturb the quiet and peaceful occupation of his neighbours. Pay to the LESSOR a damages deposit in the sum of ___________________ ( R_________ ) on date of signature of this agreement.
DUTIES OF THE LESSEE. 1. The Lessee shall use the Leased Premises with due care. He shall use them only for the purposes mentioned under Section 2. 8.
2. The Lessee shall give due consideration for other occupants and he shall not impair in any way the Lessor's business and research activities.
DUTIES OF THE LESSEE. Room set-up, clean-up and reset is the responsibility of the LESSEE. Room should be returned to condition it was found in. If different person is doing the clean-up the LESSEE should discuss room reset with that person(s).
DUTIES OF THE LESSEE. The Lessee, for and in consideration of the letting and the covenants and agreements herein contained to be kept and observed by the Lessor, agrees and binds itself, for the term hereof, (a) to pay the rent reserved at the time and in the manner aforesaid; (b) not to make or suffer to be made any additions or alterations in or to the Premises without the written consent of Lessor which permission shall not be unreasonably withheld, (c) not to make or suffer any unlawful, improper or offensive use of the Premises; (d) except as otherwise described herein, that any lighting apparatus which may be installed on the Premises or is already on the Premises shall be the responsibility of the Lessee; (e) not to make, sell or keep for sale upon or in said demised Premises, or any part thereof, any spirituous or intoxicating liquors; (f) to permit Lessor's agent or employees at all reasonable times to enter upon and examine the Premises and make such repairs as he or his agents may think necessary for the protection thereof; (g) not to assign this Lease or to underlet the whole or any part of the Premises to any person without the prior consent in writing of Lessor; (h) to obtain and pay for all utilities including electric, gas, sewer, and water for the demised Premises; (i) to obtain and pay for all trash removal, janitorial services, and pest control for the demised Premises; 0) to pay for telephone service of the demised Premises; (k) at the end of the term herein to yield up the Premises to Lessor in the same condition of cleanliness, sightliness and repair as at the effective date of this Lease, loss by fire or other casualty, and ordinary wear and tear excepted.
DUTIES OF THE LESSEE. Lessee agrees to, in addition to other duties as specifically set forth within this Agreement, perform the following:
A. Acquire all necessary permits and licenses associated with the lawful operation of its business upon the Premises; including but not limited to a license to operate a retail food establishment and a license to sell malt/vinous/spirituous liquor-hotel and restaurant for consumption on premises.
B. Comply with all Airport Minimum Standards and Regulations, all City ordinances, all State and Federal regulations, including, but not limited to all FAA or other Federal non- discrimination regulations and all state or local regulations for the provision of food or restaurant services, and all applicable sales and use tax requirements, effective at the time of this Agreement or hereafter established or amended.
C. Lessee shall also perform all routine or minor maintenance to keep drains and sinks sanitary, clean, and free flowing.
D. Accept customer payment in the form of cash, credit and/or debit card, according to Lessee’s proposal. Lessee shall have the right to establish a minimum purchase amount if such policy is permitted by the credit and/or debit card issuer and if the minimum does not exceed five dollars ($5.00).
E. The Lessee's records shall be open to review by the Lessor or Lessor's authorized agent throughout the lease term and for six (6) years after the end of the termination or expiration
DUTIES OF THE LESSEE. Lessee agrees to, in addition to other duties as specifically set forth within this Agreement, perform the following:
A. Acquire all necessary permits and licenses associated with the lawful operation of its business upon the Premises; including but not limited to a license to operate a retail food establishment and a license to sell malt/vinous/spirituous liquor-hotel and restaurant for consumption on premises.
B. Comply with all Airport Minimum Standards and Regulations, all City ordinances, all State and Federal regulations, including, but not limited to all FAA or other Federal non- discrimination regulations and all state or local regulations for the provision of food or restaurant services, and all applicable sales and use tax requirements, effective at the time of this Agreement or hereafter established or amended.
C. Keep at all times, the Premises, and all improvements thereon, including equipment and furniture, in a clean, sanitary, and and orderly condition and appearance. Lessee shall be responsible for janitorial service to clean the kitchen area of the Premises. Lessee shall be responsible to maintain in good working order all Lessee owned equipment (stoves, ovens, refrigerator, microwaves, beverage dispensers, etc.) for the provision of food and beverage services. Lessee shall also perform all routine or minor maintenance to keep drains and sinks sanitary, clean, and free flowing.
D. Accept customer payment in the form of cash, credit and/or debit card, according to Lessee’s proposal. Lessee shall have the right to establish a minimum purchase amount if such policy is permitted by the credit and/or debit card issuer and if the minimum does not exceed five dollars ($5.00).
E. The Lessee's records shall be open to review by the Lessor or Lessor's authorized agent throughout the lease term and for six (6) years after the end of the termination or expiration of the Lease as necessary for purposes of enforcing any obligation under this Agreement. For such purposes, Lessor or authorized agent shall have the right to inspect, examine and audit the Lessee's records, books and accounts including the right to retain an independent certified public accountant of the Lessor's choosing and at the Lessor's expense to do so.
DUTIES OF THE LESSEE. 11.1. The Lessee must:
11.1.1. Keep the Property clean and tidy;
11.1.2. Use the Property for private dwelling only:
11.1.3. Take care of the Property (and other items belonging to the Lessor);
11.1.4. Protect the Property from abuse, damage, destruction, and theft;
11.1.5. Respect the Property’s neighbours;
11.1.6. Not be a nuisance, or cause annoyance or discomfort to the Property’s neighbours or the public;
11.1.7. Leave refuse in the refuse bins provided;
11.1.8. Enable the Lessor to carry out his duty of maintenance and repair;
11.1.9. Prevent blockages and obstructions in the drains, sewerage pipes and water pipes on the Property; and
11.1.10. Provide light bulbs when required on the Property.
