EMERGENCY WAIVER. In the event of circumstances beyond the control of the City, such as acts of God, fire, flood, insurrection, civil disorder, national emergency, or similar circumstances, as determined by the City, the provisions of this Memorandum of Understanding which restrict the City’s ability to respond to these emergencies shall be suspended for the duration of such emergencies. After the emergency is over, the Xxxxxx City Employees’ Association shall have the right to meet with the City regarding the impact on employees of this suspension of these provisions in this Memorandum of Understanding.
EMERGENCY WAIVER. In the event an emergency is proclaimed by the Township Administrator, the Chief of the Fire Department may, after the declaration of an emergency, make such work assignments within the recognizable scope of the employee’s skills, as he deems necessary, without regard to employee classification, overtime limitations, seniority.
EMERGENCY WAIVER. In cases of an emergency declared by the President of the United States, the Governor of the State of Ohio, the Xxxxx County Sheriff, the Federal or State legislature, where such as acts of God affect the safety and health of the citizens of Xxxxx County, the following conditions of this Agreement shall automatically be suspended: Time limits for Management's or the Union's replies on grievances; All work rules and/or agreements and practices relating to the assignment of all employees. Upon the termination of the emergency, should valid grievances exist, they shall be processed, in accordance with the provisions outlined in the grievance procedure, and shall proceed from the point in the grievance procedure to which they (the grievance(s)) had properly progressed.

In the event an emergency is proclaimed by the City Manager as set forth by the Codified Ordinances, the Chief of the Division may, after the declaration of an emergency, make such work assignments within the recognizable scope of Fire Division skills, as he deems necessary, without regard to employee classifications, overtime limitations, or seniority.
B. Upon termination of the emergency, grievances that occurred during the emergency will be processed in accordance with provisions outlined in the Grievance Procedure in Article 22. This will include the declaration of the emergency itself.
EMERGENCY WAIVER. In the event of circumstances beyond the control of the City, such as acts of God, fire, flood, earthquake, insurrection, civil disorder, national emergency, or similar circumstances, provisions of this MOU or the Personnel Rules and Regulations of the City, which restrict the City's ability to respond to these emergencies, shall be suspended for the duration of such emergency. After the emergency is declared over, this MOU will be reinstated immediately. The Association shall have the right to meet and confer with the City regarding the impact on Unit members of the suspension of provisions in the MOU during the course of the emergency. Any rights and benefits suspended by virtue of the emergency shall be restored as soon as practicable at the conclusion of the emergency.

In the event of circumstances beyond the control of the City, such as acts of God, fire, flood, insurrection, civil disorder, national emergency, or similar circumstances, as determined by the City, the non-economic provisions of this MOU which restrict the City’s ability to respond to these emergencies shall be suspended for the duration of such emergencies. After the emergency is over, the Union shall have the right to meet with the City regarding the impact on employees of this suspension of these provisions in this MOU.
EMERGENCY WAIVER. In cases of emergency impacting the Goshen Township Police Department jurisdiction and/or operations declared by the President of the United States, the Governor of the State of Ohio, the Township Administrator, the Director of Homeland Security, the Federal or State Legislature, the Federal Emergency Management Agency/(FEMA), or local Emergency Management Agency, for things such as, but not limited to, acts of God or civil disorder, the following conditions of this Agreement may be temporarily suspended by the Township:
A. Time limits for the processing of grievances; and
B. All work rules and/or agreements and practices relating to the assignment of employees. Upon termination of the emergency, grievances filed prior to the emergency shall be processed in accordance with the provisions outlined in the grievance procedure of this Agreement, and shall proceed from the point in the grievance procedure to which the grievance(s) had properly progressed, prior to the emergency.
EMERGENCY WAIVER. In cases of an Emergency declared by the President of the United States, the Governor of the State of Ohio, the Fairfield County Sheriff, the Federal or State legislature, where, such as acts of God affect the safety and health of the citizens of Fairfield County, the following conditions of this Agreement shall automatically be suspended:
A. Time limits for Management’s or the OPBA’s replies on grievances;
B. All work rules and/or agreements and practices relating to the assignment of all employees. Upon the termination of the emergency, should valid grievances exist, they shall be processed, and shall proceed from the point in the grievance procedure to which they (the grievances(s)) had properly progressed. Any employees reassigned for the emergency shall be returned to their regular assignment.
EMERGENCY WAIVER. In the event of circumstances beyond the control of the City, such as acts of God, fire, flood, insurrection, civil disorder, national emergency, or similar circumstances, if the City Manager or his designee so declares, any provisions of this MOU or the Personnel Rules or Resolutions of the City, which restrict the City's ability to respond to these emergencies, shall be suspended of the duration of such emergency. After the emergency is declared over, the Association shall have the right to meet and confer with the City regarding the impact on employees of the suspension of these provisions in the MOU and any personnel rules and policies.
