Fall Back. The setting back of the clock by one (1) hour results in the on-duty employee working one extra hour. The employee will be compensated for this hour as per this Article. In the case of Shift Trade and HCT, the employee who shift traded will receive the extra hour, not the relief employee. These hours are not subject to the two (2) hour minimum in Paragraph 3 of this Section.
Fall Back. The employee will be compensated for any hours worked over the required hours of the shift.

Fall Back a. Employees serving at the discretion of the Committee under the provisions of M.G.L. c.71, s.41 who re-enter the bargaining unit described in Article I, shall be placed on the Seniority List in accordance with their previous service within that unit.

Employees serving at the discretion of the Committee under the provisions of M.G.L. c.71, s. 41 who enter the bargaining unit described in Article I for the first time shall be placed on the Seniority List before those teachers who are not serving at the discretion of the Committee and after those teachers who are serving at discretion.

In addition to the creditable service described above in Section 5.a. and 6.b., said employees who enter or re-enter the bargaining unit described in Article I from Unit C (MCR-2543) shall be credited with the years, months, and days of service to the Committee in which they served in positions requiring greater than fifty percent (50%) of their time in the performance of work generally performed by members of Unit A. Fall Back. Pursuant to this Article, an administrator who is a member of the Association’s Unit B, who had accrued seniority as a member of Unit A, will have fall-back rights equal to the amount of time served as a member of Unit A in the area of their teaching experience.
Fall Back. 1. Employees with professional teacher status under the provisions of M.G.L. Chapter 71, section 41, who re-enter the bargaining unit described in Article 1, shall be placed on the Seniority List in accordance with their previous service within that unit.
2. Employees with professional teacher status under the provisions of M.G. L. Chapter 71, section 41, who enter the bargaining unit described in Article 1 for the first time shall be placed on the Seniority List before those teachers without professional teacher status and after those teachers with professional teacher status.
Fall Back. (a) If (notwithstanding Section 9.19(c)) any Dutch Parallel Debt constitutes the Collateral Agent as a joint creditor with any Secured Party, the Collateral Agent may determine (at its discretion) that that Dutch Parallel Debt and one or more other Dutch Parallel Debts shall be combined into one single Dutch Parallel Debt (a “Combined Dutch Parallel Debt”), whereupon those Dutch Parallel Debts shall be combined into a Combined Dutch Parallel Debt (i) the amount of which shall be equal to the aggregate of the amounts of the Underlying Debts combined into it; (ii) which shall, if the Underlying Debts are expressed in different currencies, be expressed in such of those currencies or euro as the Collateral Agent may determine (and, for this purpose, each Underlying Debt shall be converted into the currency of the Combined Dutch Parallel Debt at the rate of exchange reasonably selected by the Collateral Agent); (iii) which shall, if the Underlying Debts combined into it fall due at different times, fall due in parts corresponding to those Underlying Debts (but otherwise in accordance with Section 9.21); and (iv) to which this Agreement shall otherwise apply as if the Dutch Combined Parallel Debt were a Dutch Parallel Debt.
(b) If any Underlying Debt is avoided or reduced other than (i) as a result of payment to, or recovery or discharge by, the Secured Party to which the Underlying Debt is owed or (ii) otherwise with the consent of that Secured Party, the amount of the Dutch Parallel Debt corresponding to that Underlying Debt shall be equal to the amount which the Underlying Debt would have had if the avoidance or reduction had not occurred.

Fall Back. (1) Employees with professional teacher status under the provisions of M.G.L. c. 71, s. 41, who reenter the bargaining unit described in Article I, shall be placed on the Seniority List in accordance with their total consecutive service within the bargaining unit.
(2) Employees who fall back in accordance with “f” (1) above and who are assigned to a teaching position shall be assigned to the discipline in which they last taught.
Fall Back. If a professional employee not covered by this Agreement shall be laid-off from his/her position, he/she shall have the right to return to the last teaching position covered by this Agreement which he/she held prior to the bargaining unit and shall be credited for seniority purposes with his/her total length of continuous service in the Dedham Public Schools as defined in Section 30.6. above.
