FIRE MARSHAL’S OFFICE. Individuals working in the Fire Marshal’s office shall not be included on the overtime rotation list while they are part of the Fire Marshal’s Office. They shall only work overtimes that are specific to the Fire Marshal’s Office. If an individual returns to the “line” they shall be placed in the same column as the farthest back person for the rank they are returning to (Lieutenant, Paramedic, or Fire Fighter).

FIRE MARSHAL’S OFFICE. Section 1. Fire Marshal a. The Fire Chief shall appoint the Fire Marshal. b. Candidates for appointment shall be currently employed by the Galveston Fire Department, and be an officer for at least five (5) years. c. The position shall be equal in rank and pay to an Assistant Chief. d. It is agreed that section 143.014 (g) and (h) of the Texas Local Government Code shall apply to the appointment and removal of the Fire Marshal. No other section shall apply to such appointment or removal and the Union specifically waives any requirements other than stated in this article. e. The individual serving as Fire Marshal may request to be removed after two (2) years from date of appointment or until a qualified candidate is available. The Fire Chief shall grant such request within thirty (30) days. Any employee appointed to such position shall retain all rights and privileges afforded the employee’s previous position including testing for and receiving promotions. f. The City agrees to hire one new Firefighter within ninety (90) calendar days of the appointment to fill the vacancy created by such appointment.

FIRE MARSHAL’S OFFICE. In regards to the promoted positions of Fire Marshal and Assistant Fire Marshal, initial posting requirements will require at least two (2) fully qualified candidates within the Fire Marshal’s Office with a minimum of one (1) year of cleared assignment within the office. If there are not two (2) candidates within the Fire Marshal’s Office, the Commission shall open the process to the entire Fire Department and follow the procedures relating to eligibility for promotional examinations outlined in Section 143.030(d) until at least two (2) qualified candidates sit for the examination. If two (2) qualified candidates do not exist to sit for an exam, then the next lower rank within the Fire Marshal’s office will become eligible. If two (2) candidates are not eligible within the Fire Marshal’s Office, the Civil Service Commission shall open the process to the entire Fire Department and follow the procedures relating to eligibility for promotional examinations outlined in Texas Local Government Code Section 143.030(d) until at least two (2) qualified candidates sit for the examination. a. Five (5) points are to be applied to any current Assistant Fire Marshal’s overall score after the completion of the outline process of this article. b. Three (3) points are to be applied to any current Deputy Fire Marshal’s overall score after the completion of the outline process of this article. In the event of leaving the Fire Marshal’s division, any assigned employees to the Fire Marshal’s Office will retain their last position held in the suppression division.

Vacation will reflect Civilian maximums. Refer to Article 8.

  • New Hampshire Specific Data Security Requirements The Provider agrees to the following privacy and security standards from “the Minimum Standards for Privacy and Security of Student and Employee Data” from the New Hampshire Department of Education. Specifically, the Provider agrees to: (1) Limit system access to the types of transactions and functions that authorized users, such as students, parents, and LEA are permitted to execute; (2) Limit unsuccessful logon attempts; (3) Employ cryptographic mechanisms to protect the confidentiality of remote access sessions; (4) Authorize wireless access prior to allowing such connections; (5) Create and retain system audit logs and records to the extent needed to enable the monitoring, analysis, investigation, and reporting of unlawful or unauthorized system activity; (6) Ensure that the actions of individual system users can be uniquely traced to those users so they can be held accountable for their actions; (7) Establish and maintain baseline configurations and inventories of organizational systems (including hardware, software, firmware, and documentation) throughout the respective system development life cycles; (8) Restrict, disable, or prevent the use of nonessential programs, functions, ports, protocols, and services; (9) Enforce a minimum password complexity and change of characters when new passwords are created; (10) Perform maintenance on organizational systems; (11) Provide controls on the tools, techniques, mechanisms, and personnel used to conduct system maintenance; (12) Ensure equipment removed for off-site maintenance is sanitized of any Student Data in accordance with NIST SP 800-88 Revision 1; (13) Protect (i.e., physically control and securely store) system media containing Student Data, both paper and digital; (14) Sanitize or destroy system media containing Student Data in accordance with NIST SP 800-88 Revision 1 before disposal or release for reuse; (15) Control access to media containing Student Data and maintain accountability for media during transport outside of controlled areas; (16) Periodically assess the security controls in organizational systems to determine if the controls are effective in their application and develop and implement plans of action designed to correct deficiencies and reduce or eliminate vulnerabilities in organizational systems; (17) Monitor, control, and protect communications (i.e., information transmitted or received by organizational systems) at the external boundaries and key internal boundaries of organizational systems; (18) Deny network communications traffic by default and allow network communications traffic by exception (i.e., deny all, permit by exception); (19) Protect the confidentiality of Student Data at rest; (20) Identify, report, and correct system flaws in a timely manner; (21) Provide protection from malicious code (i.e. Antivirus and Antimalware) at designated locations within organizational systems; (22) Monitor system security alerts and advisories and take action in response; and (23) Update malicious code protection mechanisms when new releases are available.

  • Legal Action; Utilization of Special Receivership Powers The Assuming Institution shall notify the Receiver in writing (such notice to be given in accordance with Article V below and to include all relevant details) prior to utilizing in any legal action any special legal power or right which the Assuming Institution derives as a result of having acquired an asset from the Receiver, and the Assuming Institution shall not utilize any such power unless the Receiver shall have consented in writing to the proposed usage. The Receiver shall have the right to direct such proposed usage by the Assuming Institution and the Assuming Institution shall comply in all respects with such direction. Upon request of the Receiver, the Assuming Institution will advise the Receiver as to the status of any such legal action. The Assuming Institution shall immediately notify the Receiver of any judgment in litigation involving any of the aforesaid special powers or rights.
