Landfill Site a) First Party acknowledges that the availability of the Landfill Site for the purposes of disposal of Rejected Waste and Residual Inert Matter are critical for the continued operations of the Plant in a viable manner. b) The Parties agree that First Party has no independent Landfill Site of its own, but uses the Landfill Sites of First Party to dispose the MSW generated within its jurisdiction. First Party shall be primarily responsible for ensuring the availability of a Landfill Site for accepting the Residual Inert Matter and Rejected Wastes generated from First Party MSW Quantity, under the arrangements that it reaches with First Party or any other Person for disposal of MSW generated within the First Party Supply Area. c) The Residual Inert Matter shall be accepted by Landfill made available by First Party at no cost to Corporation and/or to First Party. However, if such Landfill is not made available by First Party due to any reasons whatsoever, or at a later date First Party refuses to accept Residual Inert Matter generated due to First Party MSW Quantity, then First Party shall cause the Landfill Site to be made available for the purposes of this Agreement at its own cost and expense (including payment of all levies, charges and taxes whatever) and as per the requirements and conditions as prescribed under Applicable Law. Any Tipping Fee ("Tipping Fee" means any charges, fees or levies, etc… by whatsoever name called, paid by First Party/Corporation to First Party/any other agency for use of Landfill site for disposal of Residual Inert Matter and Rejected Waste due to First Party MSW Quantity) or other charges that are imposed by First Party for making the Landfill Site available shall be borne by First Party and if Corporation has to pay any such tipping fee or charges, it shall be charged to First Party.
Landfill Site. The appropriate exempt supervisor, together with the permanent employees usually involved and a Union Xxxxxxx or a Union Official, shall determine the schedule of hours to be worked as established by City Council.
Landfill Site. Modine responded on April 26, 1999 that it had no record of disposal of materials at that site and requested the USEPA to provide any information relevant to Modine's alleged involvement. Modine has not received any information subsequent to that request from the USEPA, other governmental agencies or from any PRP groups representing this site. The State of Washington informed Modine of its potential liability at the Yakima Railroad Area in connection with a waste shipment to that site. The State proposed a settlement offer, of which Modine's share would have been approximately $14,000. The site's de minimis PRP group counter-proposal was rejected by the State. A proposed consent decree was being circulated for comment , however that process was not completed due to the site owner's filing for bankruptcy on May 14, 1997. On August 31, 2000, the Trustee of the bankruptcy estate filed notice of intent to abandon the property. Modine has not received any subsequent communication from the State of Washington, other governmental agencies or from any PRP groups representing this site since the filing of the notice of intent. In 1986, Modine executed a Consent Decree involving other PRPs and the Illinois EPA and paid $1,029 for its allocated share (0.1%) of the Alburn Incinerator, Inc. remediation costs. The US EPA signed a Covenant Not to Xxx in conjunction with the Consent Decree, but reserved its right to "seek additional relief" for any additional costs incurred by the United States at the site. In November 2003, Modine received a General Notice of Liability from the US EPA concerning the Alburn Incinerator Inc./Lake Calumet Cluster site. The US EPA requested Modine's participation as a PRP for the performance of additional activities that the US EPA has determined, or will determine, required to restore the Alburn Incinerator Inc./Lake Calumet Cluster site. In December 2003, Modine responded to US EPA stating that it would be willing to participate in settlement of the Lake Calumet site remedial costs as a "micro de minimis PRP". On April 27, 2004 and July 23, 2004, Modine signed participation agreements with other site PRPs to perform site investigations, collect pertinent site data, and develop a remedial work plan. Costs anticipated for settlement of the Alburn Incinerator/Lake Calumet Cluster site cannot be reasonably defined at this time and have not been accrued. Landfill Site. (a) The Concessionaire agrees that it shall dispose the Residual Inert Matter and the Rejected Waste at the Landfill Site. (b) The Concessionaire shall be responsible for the due operation and maintenance of the Landfill Site and for ensuring its availability and suitability for accepting the Residual Inert Matter and Rejected Waste. The Concessionaire shall cause the Landfill Site to be operated and maintained at its own cost and expense (including payment of all levies, charges and taxes whatever) and as per the requirements and conditions as prescribed under Applicable Law. (c) The Concessionaire shall bear the cost of transportation and off-loading of the Residual Inert Matter (but not of the Rejected Waste) from the Site to the agreed point at the Landfill Site, provided however, that the transportation and offloading by the Concessionaire of the Rejected Waste shall be at the cost and expense of the Participating ULBs. (d) The Concessionaire shall ensure that the Landfill Site is utilized in such a manner that it is capable of being used for the Term of this Agreement. In the event that the Landfill Site is closed for reasons attributable to operation of law and/or act of the state agencies/State Govt./Participating ULB then it shall be the obligation of State Govt. to provide an alternative site at a mutually agreeable location free of cost to the Concessionaire. If State Govt. fails to provide the said alternative Landfill Site, the Participating ULBs shall pay to the Concessionaire all transport and handling costs incurred by the Concessionaire in carrying and disposing the Residual Inert Matter and the Rejected Waste. (e) The Concessionaire shall be responsible for the operational and post- closure care of the Landfill Site, including laying down a final cover on the Landfill Site in accordance with the MSW Rules. (f) After the expiry of the Term of this Agreement, the Concessionaire shall hand over Vacant Possession of the Landfill Site to the State Govt. in good operable condition. (g) State Govt. hereby agrees that the Processing Facilities, and all other parts of the Regional MSW Facility, are undertaking the management, processing and disposal of MSW and are being specifically authorized to be constructed, developed, operated and maintained by State Govt. for the purposes of enabling it to handle and process the MSW generated within jurisdiction of the Participating ULBs. Landfill Site. Upon completion of the Landfill, in accordance with the provisions hereof, County shall execute a deed conveying the Landfill site to Xxxxxxxx with Special Warranty of Title for One Dollar ($1.00), exclusive of the transfer station and access thereto and an easement for reasonable and appropriate use consistent with the approved final use of the property by Xxxxxxxx after all gas has been vented or disposed of.
