Landlord to Furnish. Landlord shall furnish, subject to ------------------- reimbursement pursuant to Article 5 above, (a) heating, ventilation and air conditioning to the Premises during the hours of 7:00 a.m. until 6:00 p.m. Monday through Friday and, upon request, 8:00 a.m. to 1:00 p.m. on Saturday (excluding holidays), (b) automatic elevator service to the floor or floors where the Premises are located at all times, and (c) water for drinking, cleaning and washroom purposes only at those points of supply shown on the approved plans for the Premises. Tenant shall be solely responsible for and shall promptly pay all other utilities and services supplied to the Premises. Tenant acknowledges and agrees that if the Premises currently share electrical house meters with other tenants, Tenant shall reimburse Landlord, along with its Monthly Basic Rent and Additional Charges, for Tenant's prorata share of the costs of such electrical service (calculated by dividing the Rentable Area of the Premises by the total rentable area covered by each such house meter), until the Premises are separately metered. When the electricity being supplied to the Premises is separately metered, Tenant shall be responsible for all costs of electrical service to the Premises, as shown on the separate meter serving the Premises. Tenant shall have the right to make its own arrangements for electrical service. Tenant shall, at its cost, be responsible for all janitorial service for the Premises. The electrical power supplied to the Premises (the cost for the use of which shall be paid by Tenant) shall be 600 amps of 277/480V 3 phase power beginning on the Commencement Date, and Landlord shall increase such electrical power supplied to the Premises to 1400 amps of 277/480 3 phase power as of January 31, 2000, and such increase shall be at Landlord's cost and expense except for the portion to be paid by Tenant pursuant to Section 7.1 above. If after Tenant has paid such portion pursuant to Section 7.1, Landlord receives any rebate or reimbursement from the utility provider as a direct result of Landlord's electrical upgrade (thereby reducing the cost to Landlord of such upgrade), then Landlord shall pay to Tenant a fraction of such rebate or reimbursement, which fraction shall be determined by dividing the amount paid by Tenant towards the cost of Landlord's upgrade by the total cost of the upgrade.

Tenant acknowledges and agrees that the Expansion Premises share an electrical meter with other tenants, and Tenant shall reimburse Landlord for Tenant's prorata share of the costs of such electrical service (calculated by dividing the Rentable Area of the First Expansion Premises (5,695) and Second Expansion Premises (19,305), as applicable, by the total rentable area covered by such electrical meter (48,690)). Tenant shall, at its cost, be responsible for all janitorial service for the Premises.
Landlord to Furnish. Landlord shall furnish during the Term, subject to reimbursement pursuant to Article 5 above, (a) heating, ventilation and air conditioning to the Premises during the hours of 8:00 a.m. until 6:00 p.m. Monday through Friday (excluding recognized national or state holidays), (b) automatic elevator service to the floor or floors where the Premises are located at all times, (c) electric power at a rate of two and 65/100 (2.65) wxxxx per rentable square foot per 24 hour day, Monday through Friday (excluding recognized national or state holidays) in the Building, (d) hot and cold water, if any, at those points of supply shown on the approved plans for the Premises, (e) janitorial service five nights per week (except labor holidays) in accordance with Exhibit E attached hereto, (f) replacement of all building standard fluorescent rubes, and (g) landscaping services for the Premises and regular refuse removal from the Premises.
Landlord to Furnish. Landlord shall furnish during the Term, (a) heating, ventilation and air conditioning to the Premises during Ordinary Business Hours at such temperatures and in such amounts as are reasonably considered by Landlord to be standard for comparable buildings of similar class, size, age and location, (b) automatic elevator service to the floor or floors where the Premises are located at all times, if applicable, (c) subject to the requirements of applicable law or governmental requirements, electric power sufficient for task lights, appliances and customary office equipment, (d) water for lavatory use and (e) janitorial service in accordance with the Specifications for Cleaning and Janitorial Services annexed to this Lease as Exhibit D.
Landlord to Furnish. Landlord shall furnish to the Premises electricity, gas, domestic water and sewage services in amounts and in the capacity as is available at the Premises on the Effective Date. Based on representations by the utility provider to Landlord, Landlord warrants that there will be a dual feed power source available to the Premises as of the Commencement Date. In the event that such dual feed power source is not available to the Premises as of the Commencement Date, Tenant may, at is option, by written notice to Landlord prior to the expiration of thirty (30) days after such Commencement Date, and as its sole remedy, elect to obtain and install a Power Generator (as defined in Exhibit J hereof) for the Demised Premises, which Power Generator shall be subject to the provisions of Exhibit J hereto and the other terms and conditions of this Lease, except that Landlord shall reimburse Tenant for up to $40,000.00 of the costs of installing such Power Generator.
Landlord to Furnish. Landlord covenants and agrees that it will, without additional charge, other than as included in Operating Expenses, furnish the following services: (a) At least one elevator, for common use, subject to call at all times, including Saturdays, Sundays and Holidays (it being understood and agreed that the phrase "for common use, subject to call at all times" shall not preclude Landlord from requiring the use of a card key for operation of the elevators between the hours of 6:00 p.m. through 8:00 a.m. Monday through Friday and all day on Saturdays, Sundays and Holidays); (b) Janitorial and char services in accordance with the cleaning specifications (which are attached hereto as Exhibit F and made a part hereof) in a manner comparable to the manner in which such services are provided in comparable first class office buildings in Washington, D.C., Monday through Friday of each week after 6:00 p.m., except Holidays; (c) Central heating and air conditioning from 8:00 a.m. until 8:00 p.m. on weekdays and from 9:00 a.m. until 4:00 p.m. on Saturdays, exclusive of Holidays, during the seasons of the year and within the temperature ranges usually furnished in comparable office buildings in Washington, D.C. Landlord shall provide heat and air conditioning at other times at Tenant's expense, provided that Tenant gives Landlord notice by 1:00 p.m. on weekdays for after-hour service on the next weekday, two (2) business days' notice before a Holiday for service on such Holiday and two (2) business days' notice for after-hour service on Saturday or Sunday. Landlord hereby represents and warrants to Tenant that the Building has been designed to provide heating and air conditioning in accordance with the following specifications: Outdoor Conditions: Summer: 95° dry bulb, 78° F wet bulb Winter: 0° F dry bulb Inside Conditions: Summer: 75° F dry bulb (± 2° F) Winter: 72° F dry bulb (± 2° F) assuming the proper functioning of the heating and air conditioning equipment and proper distribution of such heating and cooling through the distribution system which Tenant will install as part of Tenant's Work, but Tenant acknowledges that Landlord's provision of the foregoing information is not, and is not intended to be, a representation, warranty or covenant on the part of Landlord that the heating and air conditioning system serving the Building and the Demised Premises will actually provide heating and air conditioning in the Demised Premises in accordance with such design specific...

Landlord to Furnish. Landlord covenants and agrees that it will, without additional charge, other than as included in Operating Expenses, furnish the following services during the Term at a level commensurate with the level at which such services are provided in Comparable Buildings. (i) At least one (1) elevator, for common use, subject to call at all times, including Saturdays, Sundays and Holidays, and (ii) at least four (4) elevators for common use, subject to call at all times from 6:00 a.m. until 8:00 p.m. Monday through Friday and from 9:00 a.m. until 4:00 p.m. on Saturdays, subject, as to this clause (ii), to temporary interruptions for maintenance, repairs and replacements (it being understood and agreed that the phrase "for common use, subject to call at all times" shall not preclude Landlord from requiring the use of a card key for operation of the elevators between the hours of 6:00 p.m. through 8:00 a.m. Monday through Friday and all day on Saturdays, Sundays and Holidays); (b) Janitorial and char services in accordance with the cleaning specifications which are attached hereto as Exhibit E 45 and made a part hereof in a manner comparable to the manner in which such services are provided in Comparable Buildings, Monday through Friday of each week after 6:00 p.m., except Holidays; (c) Central heating and air conditioning from 8:00 a.m. until 8:00 p.m. on weekdays and from 9:00 a.m. until 4:00 p.m. on Saturdays, exclusive of Holidays, during the seasons of the year and within the temperature ranges furnished in Comparable Buildings; provided, however, that on any weekday or Saturday on which it is reasonably capable of being anticipated that the temperature will exceed 90EF and on "Code Red" days (as such term "Code Red" days is utilized in the District of Columbia), Landlord shall operate the air conditioning serving the Demised Premises commencing at 6:00 a.
Landlord to Furnish. Landlord shall furnish during the Term, subject to reimbursement pursuant to Article 5 above, (a) heating, ventilation and air conditioning to the Premises during the hours of 7:00 a.m. until 6:00 p.m. Monday through Friday (excluding holidays), (b) automatic elevator service to the floor or floors where the Premises are located at all times, (c) electric power consistent with Tenant's usage in the Premises as of the date hereof at the Building electrical panels of each floor (excluding power for HVAC, lighting and Building emergency systems), (d) hot and cold water at all current points of supply in the Initial Premises and reasonable future points of supply, (e) janitorial service five (5) nights per week (except labor holidays) pursuant to the janitorial specifications attached hereto as Exhibit D, (f) replacement of all building standard fluorescent tubes, (g) basic recycling at central collection points on each floor, (h) at the request of Tenant, guard service at designated entrances and exits on a twenty four (24) hour a day, seven (7) days a week basis, and (i) refilling of soap, towel and tissue containers in the restrooms in the Premises. All services provided by Landlord hereunder shall be provided at a level and in a manner commensurate with other first class office buildings in the same geographic area. Notwithstanding anything to the contrary in this Section 18.1. Landlord shall not be obligated to provide any janitorial service to the computer rooms and storage space in the Parking Garage or the Building. Landlord shall at all times provide on-site property management consistent with similar buildings in the Pleasanton-San Ramox xxxa. For so long as Tenant leases at least seventy five percent (75%) of the rentable area of the Building, Tenant shall have the right to approve, which consent shall not be unreasonably withheld, conditioned or delayed, the property management company for the Building and the individual manager for the Building.
