The 'Seniority Employees' clause defines how employees with longer tenure or higher rank within an organization are treated under the agreement. Eligible seniority employees will be first preference for acceptance into this program. When seniority and ability are equal, seniority will prevail.
Seniority Employees. A seniority Employee who accepts a promotion, demotion, or a transfer within the bargaining unit, shall be placed on provisional status for sixty (60) calendar days with seniority accumulating. 1. An Employee placed on provisional status will have two (2) progress reports – the first will be done not later than the midway point of the sixty (60) calendar days, and the second prior to the end of the sixty (60) calendar day provisional period. 2. During the provisional period, the Employer will provide and document training and instructional supervision, as applicable, so as to acclimate the Employee to departmental procedures. 3. To aid placement efforts, the Employee shall be notified, in writing, of his/her successful completion of the provisional period or disqualification for the subject position, at least ten (10) calendar days prior to the end of the provisional period.
Seniority Employees. A. Any Active employee having seniority who is desirous of changing shifts may make application to management electronically for a transfer to the shift the employee prefers. If, after having made application, an employee from that shift and classification within the department in question is willing to trades shifts, both employees will be transferred to the shift of their choice and the time limits specified in Paragraph II.A.

Seniority Employees. Any seniority employee who shall fail to maintain proper standards of conduct or to discharge his responsibilities shall be subject to such disciplinary action as the Employer shall determine, consistent with the provisions of this Agreement. 1. In the event that the employer feels that disciplinary procedures in regards to an employee’s performance are necessary, the employee shall have the right to have a representative of the association present at the meeting where disciplinary action may take place. Upon the request for such representation, the action shall be delayed up to maximum of forty eight (48) hours to allow the representative to be present, and in no event shall the Employer be restricted from taking such protective action as the Employer may determine to be necessary to protect the rights of students and other pending the holding of the meeting. After completion of the probationary period, no seniority employee shall be disciplined without just cause. 2. At the meeting where discipline is issued, the employee shall be advised in writing as to the specific reason(s) for which disciplinary action is being taken. 3. The Association shall be notified in writing of the fact that an employee has been suspended or dismissed by the Employer. This provision will be satisfied by the Employer divulging the name of the involved employee, that he/she has been suspended or dismissed, and the effective date of the disciplinary action. 4. The Employer recognizes the merit of a policy of progressive discipline, which includes verbal warning, written warning, reprimand, suspension with pay and suspension without pay, with discharge as a last resort. Any disciplinary action taken shall be appropriate to the behavior which led to the discipline, recognizing that extreme infractions may result in immediate action which may bypass the earlier steps of the progression. 5. The district shall maintain only one personnel file for each driver. Each driver shall have the right to review the contents of his/her personnel file, and the right to be accompanied by an association representative when reviewing his/her file. A driver may submit a written response to any material in his/her file, the response to be attached to the relevant filed material.
Seniority Employees. An employee notified of layoff may exercise his/her district seniority to bump into any classification for which he/she is qualified. Bumping will take place at the time of layoff but will not become effective until bid day. If a layoff occurs mid- year, bumping will become effective at the time of the layoff.
