Activities and Risks. Climbing on artificial climbing walls, and related activities (including, but not limited to, bouldering, challenge type activities and fitness or exercise classes) exposes participants to numerous risks which might result in physical and emotional injury, death or property loss or damage. These risks include, among others, the following: falling to the floor or pads; falling or swinging into the climbing wall and other structures and objects; being struck by falling climbers, hardware, tools, broken or dropped holds and other objects; entanglement in ropes; abrasions and/other injuries from contact with climbing walls, ropes, holds, loose holds, dropped holds, broken holds, pads, or the floor. Climbing and belaying equipment (if used) and structures may malfunction, be defective, or fail; and absorbing materials, including pads below the wall may not prevent all injuries from falls. Participants may participate out of control or beyond their limits or otherwise act in a negligent or intentional manner which contributes to the injury or death of themselves or another participant. Staff, visitors, belayers (when present) and other persons present may act negligently or engage in other wrongful conduct. Atlantic Bouldering Company may fail to warn participants or the natural guardians of certain inherent risks. These risks are inherent in a participant’s enrollment and climbing and related activities and they cannot be eliminated without altering the nature of the experience. Other risks may be encountered. If I am the natural guardian of a minor participant, I have explained the risks and possible outcomes to the child. I, and the child, understand them. I choose to participate nonetheless. If signing on behalf of the child, we both choose for the child to participate nevertheless. My, or the child’s, participation is voluntary.

Activities and Risks. Activities and amusements offered by the gyms include, but not exclusively: rock climbing, at the gyms and at remote outdoor locations, including bouldering, top roping, lead climbing and speed climbing; transportation to remote climbing sites and walking (including street crossings, to nearby second locations of certain of the gyms); slack lining; dry tooling; rope climbing; use of fitness equipment, use of weight rooms, classes in climbing, yoga, zumba, tabata, foam rollers, campus board, pilates, spinning, and strength and conditioning; rope swings, crate stacking, dodgeball, NERF guns, food services and simply moving about the gym and remote climbing sites. Participants share the responsibility for managing the risks of the activities, supervised or not, including not participating in an activity for which they feel they are not qualified or which includes harmful conditions. Participants must follow all gym policies, rules, and regulations at all times. I acknowledge that gym staff is, and has been, available, to answer any questions about the nature and physical demands of the activities and their associated risks. If I am a parent of a participating minor, I have explained these responsibilities to my minor child or xxxx. Risks of the gym activities include, among others, the following: (1) misuse of the climbing walls, equipment or facilities; (2) falls and abrupt and possibly harmful contact with persons, structures and objects (fixed and moveable), including climbing walls, ropes, flooring and other surfaces; (3) failure of the facilities, climbing walls, holds, harnesses, auto belays and exercise, fitness and other equipment; (4) mental or physical health problems of participants and others; (5) lack of training and conditioning; (6) carelessness and misjudgments, including negligence, of participants and gym staff, by improperly belaying and otherwise failing to follow proper procedures, instructions and operating policies; (7) injuries associated with activities in and about the outdoors, including hiking over sometimes uneven terrain, falling timber and rocks, harmful plants and animals and the forces of nature; (8) camping activities, including the use of cooking stoves and moving about the campsite; (9) accidents and illnesses, including allergic reactions, occurring in remote places where emergency medical care may be significantly delayed; and 10) accidents while being transported to remote sites or walking to nearby gym sites. Activities and Risks. The risk of injury from the activities involved in this program is significant and entails known and unanticipated risks, including the potential for physical and/or emotional injury, permanent paralysis and death, and or damage to myself, to property, and/or to third parties. Injuries may include breaks, sprains, bruises and other contusions and in extreme cases emotional upset, anxiety and even death. The description of risks above is not complete and other unknown or unanticipated risks, inherent and otherwise, may be encountered. Activities and Risks. The program in which the child will participate includes challenge course activities (a challenge course is a network of obstacles, cables, ropes, swings and platforms, some as high as 50 feet off the ground, over which participants may walk and swing, with or without the assistance of other persons), and activities on and around a climbing tower (the tower being a structure of heights up to 50 feet, with hand and foot holds placed for moving laterally, up and down, while supported by other participants. Participants in Challenge Course and Wall activities may be assisted (“belayed”) by mechanical devices or by other participants or staff, using cables or ropes. These activities require moderate to strenuous physical exertion, balancing, lifting, pulling, pushing and climbing, and reliance on other persons, equipment and man-made structures. Activities and Risks. Access to the Park is by boat only and may include boats operated by Park staff. Visitors are allowed to move about areas of the Park only within marked boundaries and may enter the water only in the designated swimming areas. Children under 16 must be accompanied by an adult at all times. The terrain of the Park may be uneven and unstable, particularly near the water. Poisonous plants and dangerous animals, including snakes, may be encountered. Persons entering the water do so at their own risk (no lifeguard will be present). Warnings and instructions, including by signs and Park staff, must be observed. The zip line tour, the structures and premises on which the tour is conducted and the equipment used expose participants to certain risks. Tour activities require moderate to vigorous physical exertion, and include travel along the zipline (cables) at heights of up to 150 to 200 feet. Zip lines may descend steeply, and will cross ravines and lake inlets. Travel from one zipline to another may be over steep and uneven ground and may be strenuous. Participants, assisted by staff, will be attached to the cable by means of a lanyard clipped onto the Participant’s harness. The Participant will then move, often with considerable speed, down and along that cable, to a stopping point at which, with staff assistance, Participant will disconnect from the cable and move to another line, or off the tour. Participants share the responsibility with staff for assuring that they are properly attached to a lanyard before beginning down the zipline. A harness which is not attached to a secure point provides no protection, and a fall and serious injury are almost certain to occur. Several ziplines cross bodies of water which are deep enough to require swimming to safety in the unlikely event of an equipment failure or other accident which causes the participant to land in that water. Participants may request personal floatation devices for tours on those ziplines. The risks of tours on such lines include water immersion and drowning. The Park offers watercraft for rental. Persons who rent or occupy the watercraft are solely responsible for their safety on the water. Boating activities will not be monitored by staff and rescue or even assistance should not be expected. Activities and Risks. The Park consists of more than 60 platforms installed in trees and connected by various configurations of cable, wood and rope to form bridges and zip lines over which participants will move at heights of up to 65 feet; Park activities are self-guided. They require balance, agility, focus and strength in varying degrees as one moves through the course. Participants in the activities share the responsibility with staff for compliance with safety procedures, including the use of a safety harness. The harness must not be removed or loosened – for any reason – while participant is off of the ground. Should the harness loosen or be removed while on the ground, the Participant must have the harness fit checked by staff prior to reentering a course. Staff must be notified if a harness loosens or safety clips do not function as described in an orientation. Before engaging in the activities, participants must read and understand all instructions, posted or otherwise conveyed, receive specific training in using the harness and other safety equipment, and understand and accept the risks involved. The Park may deny or terminate participation, or remove visitors from the premises at any time in its sole discretion. Among the hazards and risks of the activities and use of the premises and equipment of the Park are the following: sometimes uneven terrain; falls and abrupt and possibly harmful contact with other persons, structures and objects (fixed and moveable); carelessness and misjudgments of participants and staff of the Park, including by failing to follow proper procedures, instructions and the operating policies; the failure of structures and equipment; and the forces of nature, predictable and unpredictable. Participants may experience an increased heart rate and other symptoms of anxiety and stress due to, among other things, heights, physical exertion and reliance on others. Injuries may include breaks, sprains, strains, bruises and other contusions and in extreme cases emotional upset, anxiety and even death. Activities and Risks. I understand that the activities offered by the Absolute Pilates Studio (“the studio”) include the following: independent and group exercising, including the use of exercise equipment a variety of associated individual and group classes and otherwise moving about the studio and its outside perimeter (all, the “activities”).
