(1) Following the date of the act or omission giving rise thereto, or the date on which the employee knew or reasonably should have known of such act or omission if that date is later, the aggrieved member shall discuss the grievance with his/her immediate administrator, identifying it as a grievance, either with or without a representative of the UPI, at the grievant's(s') election. Procedure for Handling Grievances. Step 1. If a nurse has a grievance, the matter shall be reduced to writing indicating the nurse's statement of the dispute and identifying the provisions of the Agreement that have allegedly been violated. The grievance is waived unless it is presented to the nurse's Department Head in writing within twenty- one (21) calendar days after occurrence of the facts which are the basis of the grievance. Grievances relating to pay will be timely if received by the Director of Nursing Services within twenty-one (21) calendar days after the payday for the period during which the grievance occurred. The Department Head or designee shall meet with the grievant and, at the grievant's option, one Association representative within seven (7) calendar days of filing of the grievance. Together they shall attempt to resolve the grievance. The Department Head shall give a written decision to the grievant with a copy to the Association within fourteen (14) calendar days of the meeting. Grievances properly filed under Step 1 involving the same issue in more than one department may be moved by the Director of Nursing Services to Step 2 without a Step 1 meeting by written notice from the DNS to the ONA within seven (7) days of filing of the grievance.
Step 2. If the grievance is not settled at Step 1, it may be appealed by delivery of written notice from the grievant or the Association to the Director of Nursing Services within fourteen (14) calendar days from receipt of the written decision referred to in Step 1. The Director of Nursing Services or designee shall meet with the grievant and, at the option of the grievant, a representative of the Association to attempt to resolve the grievance. The Director of Nursing Services or designee shall give a written decision to the grievant with a copy to the Association within fourteen (14) calendar days after the meeting. If the parties are unable to resolve the grievance within three calendar days upon receipt by the Association of the written decision, the decision may be appealed by the grievant by delivery of written notice to the Hospital Administrator within fourteen (14) calendar days after receipt of the decision of the Director of Nursing Services.

(i) Within five (5) workdays of the occurrence causing the grievance or of the time the grievant should have reasonably known of the occurrence causing the grievance, the grievant shall, if he is not satisfied through informal discussion provided for in Step One, submit in writing to the Director of Public Safety, with copies to the Vice President of Human Resources, the claimed facts behind, and basis of the grievance and the desired remedy. Time limits, which begin after the written grievance is submitted, may be mutually extended by the parties only in writing.
(ii) SOA shall be notified by the Director of Public Safety in the event the grievant is not represented by SOA, and a representative shall have the right to be present, at this time and all subsequent steps in the grievance procedure, to present the views of SOA. The Director of Public Safety, or his/her designee which may be a representative from the Department of Human Resources or other University official, within ten (10) calendar days after receipt of the written grievance, shall meet with the grievant and the representative of SOA in an effort to resolve the grievance. The Director of Public Safety, or designee shall indicate his disposition of the grievance, in writing, within three (3) calendar days of said meeting to the grievant and SOA and Vice President of Human Resources.
