Proration of Annual Vacation Entitlement. (a) Absences due to sick leave, income continuance, or workers’ compensation injury. Annual vacation entitlement will not be reduced for absences due to the above reasons unless an employee who is absent for a period exceeding two (2) years for the above reason(s) is deemed totally disabled and does not return to work, except as provided below. In the year an employee resumes employment after an absence due to the above reasons of more than two (2) years, the annual vacation in the year of return will be prorated by one twelfth (1/12) for each month of absences in the year of return.
(b) Absences other than sick leave, income continuance, WCB, maternity leave and annual vacation. Where an accumulation of such absences exceed three (3) calendar months in any calendar year, annual vacation in the following calendar year will be reduced by one-ninth (1/9) for each full month of absence in excess of three (3) months.

(b) Where an accumulation of absences other than sick leave, income continuance, WSBC and annual vacation exceeds three (3) calendar months in any calendar year, annual vacation in the following calendar year will be reduced by 1/9 for each full month of absence in excess of three (3) months.

Proration of Annual Vacation Entitlement. (a) Absences due to A.V., Time Off Bank, WCB, RWWL, and maternity leave. Absences due to A.V., Time Off Bank, WCB, RWWL and maternity leave will not reduce subsequent vacation entitlements.
(b) Absences due to sick leave and income continuance. In any case, where an accumulation of such absences exceed 6 calendar months in a calendar year, vacation entitlement in the following calendar year will be reduced by one-sixth for each full month of absence in excess of 6 months.
(c) Absences other than in (a) and (b) above. Where an accumulation of such absences exceed 3 calendar months in any calendar year, annual vacation in the following calendar year will be reduced by one-ninth for each full month of absence in excess of 3 months.

(c) PRORATION OF ANNUAL VACATION DUE TO MATERNITY LEAVE It is understood that Article 14.09 (b) will not apply to the period of maternity leave described in Article 14.11 of the Collective Agreement. This understanding is without prejudice to the position of the Parties on the relationship of maternity leave to other provisions of the Collective Agreement.
