SCHOOL COMMITTEE RIGHTS. Nothing in this Agreement shall be deemed to derogate from or impair any power, right, or duty heretofore possessed by the Committee except where such right, power or duty is specifically limited by this Agreement, nor shall any outside action be binding upon the Committee except as covered in the grievance procedure, as stated in Article III of this Agreement.

SCHOOL COMMITTEE RIGHTS. Both parties recognize that under the laws of the Commonwealth of Massachusetts the Committee has the exclusive right, responsibility, and final authority for establishing the policies for the control, direction, and management of the School Department. Therefore, it is understood and agreed that this Agreement concerns those matters of wages, hours, and conditions of employment which have been expressly bargained for and are included herein and expressly reserves those powers, prerogatives, and authority not expressly abridged or modified by this Agreement to the Committee. Further, both parties agree that it is their responsibility to abide by the terms of this Agreement for its duration. It is agreed that management officials of the Committee shall at all times retain the right to direct employees, to hire, promote, transfer, assign and retain employees within the School Department, and to suspend, demote, discharge, or take other disciplinary action against employees for just cause, to relieve employees from duties because of lack of work or for other legitimate reasons, to maintain the efficiency of the operations entrusted to them, to determine the methods, means and personnel by which such operations are to be conducted, to conduct school system operations in a safe and most efficient manner, and to take whatever actions may be necessary to carry out the mission of the School Department, subject to the provisions of this Agreement. The just cause provision referred to in the previous paragraph shall not apply to non-renewal of non-professional teacher status nor to the dismissal of new teachers during the first ninety (90) days.
SCHOOL COMMITTEE RIGHTS. Except where specifically abridged by this Agreement, the School Committee and the Superintendent reserve and retain full rights, authority, and discretion in the proper discharge of their duties and responsibilities to control, supervise, and manage the Lexington Public Schools and their professional staff under governing law, ordinance, rules and regulations. ========================================================================================

SCHOOL COMMITTEE RIGHTS. Nothing in this Agreement shall be deemed to derogate from or impair any power, right or duty heretofore possessed by the School Committee or to change any rule or policy adopted prior to the date of the acceptance of this Agreement except where such right, power, duty, rule or policy is specifically limited or changed by this Agreement. It is agreed that no member of the Union shall contact the School Committee concerning any matter covered by this Agreement without first bringing the matter to the attention of the Superintendent. The School Committee is a public body established under the statutes of Massachusetts and has final responsibility for establishing the policies of the public schools, for management of said schools and for directing their operation. The listing of the following specific rights of management in this Article is not intended to be nor shall be considered restrictive of or as a waiver of the rights of the Committee not listed herein. Such inherent Committee responsibilities are not subject to arbitration and shall remain exclusively with the Committee except as they may be shared with the Union by specific provisions of this Agreement. Among such responsibilities as are vested exclusively in the Committee are the following: the right to hire, promote, transfer, assign, schedule and retain Employees in positions and to suspend, demote, discharge or take other disciplinary action against Employees for just cause, to relieve Employees from duty because of lack of work or other legitimate reasons, to determine the method, means and personnel by which such operations are to be conducted and to take whatever action may be necessary to carry out the work of the School Department in situations of emergency.
SCHOOL COMMITTEE RIGHTS. The Committee is a public body established under and with the powers provided by the Statutes of the Commonwealth of Massachusetts. As elected representatives of the citizens of Easton, charged with the responsibility for the quality of education in, and the efficient and economical operation of, the Easton School System, it is acknowledged that the Committee has final authority for the determination and administration of educational policy, the direction, employment and reemployment of staff members, and the operation and management of the public schools in Easton. Nothing in this Agreement shall be deemed to derogate or impair the powers, rights, or duties conferred upon the Committee by the Statutes of the Commonwealth or the Rules and Regulations of any pertinent agency of the Commonwealth. As to every matter not expressly covered by this Agreement and except as expressly or directly modified by the specific provisions of this Agreement, the Committee retains exclusively to itself all rights and powers that it has or may hereafter be granted by law, and shall exercise the same without such exercise being made the subject of grievance or arbitration.

SCHOOL COMMITTEE RIGHTS. Responsibility and accountability in all areas affecting members of this unit shall be limited only to the extent explicitly provided for in this Agreement. The School Committee retains all rights and duties except those explicitly provided for in the contract.

The School Committee has final responsibility for establishing the policies of the public schools of Franklin.
