Scope of Memorandum of Understanding. Except as otherwise specifically provided herein, this Memorandum of Understanding fully and completely incorporates the understanding of the parties hereto and constitutes the sole and entire understanding between the parties on any and all matters contained herein; provided, however, that nothing herein shall prohibit the parties from changing the terms of this Memorandum by mutual agreement. Any term and condition of employment not modified herein and not contrary to any rule or regulation as specified in the Personnel Rules of the City shall remain in full force and effect during the term of the Memorandum of Understanding. Except as modified by this MOU, it is understood and agreed that the City retains all of its rights, power and authority to direct, manage, and control the city to the full extent of the law. The exercise of powers, rights, authority, duties and responsibilities by the City, the adoption of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the specific and express terms are in conformance with the law. Any rights, powers, authority, and functions that the City possessed prior to the execution of this MOU are retained by the City except as specifically limited by this MOU. This Memorandum of Understanding shall supersede all existing memoranda of understanding between the City and the Union.
Scope of Memorandum of Understanding. 5.1. The Partners intend to work together to enable good growth in Hertfordshire, subject to each individual Partner making decisions in accordance with its own decision-making process and the right to exercise its powers accordingly. 5.2. Each individual Partner agrees that the following shall remain in the domain of each individual Partner: • decisions regarding housing and employment numbers, targets, and sites shall remain the responsibility of each Local Authority; • development management shall remain the responsibility of each Local Authority; and • discharging any function currently the responsibility of any Partner will remain the responsibility of that partner exercising that function.
5.3. The Growth Board will operate in accordance with its agreed Terms of Reference.

The stipend(s) will be available to all employees represented under the MOU and will be based on a three tier system: $1,000, $2,500 and $5,000. This Education Incentive Program is designed to promote higher learning and professionalism in the District and to increase the knowledge and industry expertise of the staff. As shown below, stipends may be awarded to staff who complete any CWEA certificate that does not fall within the employee’s current job description: Example: The $1,000 stipend may be awarded to staff who complete any CWEA grade I certificate that does not fall within the employee’s normal job description. A Collection System Maintenance worker who earns a CWEA Electrical/ Instrumentation Technologist Grade I, Mechanical Technologist Grade I, Environmental Compliance Inspections Grade I, Bio-solids Land Application Management Grade I, Laboratory Analyst Grade I or Industrial Treatment Plant Operations Grade I would be eligible for a $1,000 stipend per certificate earned. The same employee who earns any of the above listed certificates at a Grade II level, would be eligible for an additional $2,500 stipend. An additional $2,500 stipend would be available for those employees who earn a Grade III from the listed certificates above. An additional $5,000 stipend is available for those who earn a CWEA certificate listed above at a Grade IV level, (if applicable) or higher, (if applicable) in any of the listed fields. Employees who have earned any of the above certificates BEFORE JULY 1, 2017 will not be eligible for these stipends.
Scope of Memorandum of Understanding. This “Memorandum of Understanding” constitutes the entire agreement by the parties and correctly expresses all the rights and obligations of the parties, except for impasse submitted to higher authority and/or arbitration. The parties acknowledge that each has the opportunity to make demands and proposals with respect to all collective bargaining subjects. Each party agrees that for the life of this “Memorandum of Understanding” the other parties shall not be obligated to bargain with respect to any subject not covered in the “Memorandum of Understanding” or reserved by formal understanding as a subject for continued negotiations during the term of this Memorandum.
