SERVICES TO COMMUNITY FACILITIES. (a) Comcast shall provide a Cable Service drop and Basic Service with any necessary cable box to one outlet at each Public Building listed in Exhibit A. In accordance with applicable law, Comcast will charge the fair market value for each such account, which fair market value shall match the then-current rate card for the level of service provided. Comcast shall notify the Township in writing regarding the amount of the monthly service fee for each account based on fair market value. The Township shall then notify Comcast, within thirty (30) days of receiving the notice from Comcast, whether it wishes the amount due each month to be invoiced for payment or deducted from the next franchise fee payment. The Township may upgrade the level of Cable Service received at then current rate card prices for the higher level of service. The Township may also elect in writing not to receive the service, in which case it will not be invoiced and no deduction will be taken from the Franchise Fee.
(b) In the event the FCC’s 2019 Third Report and Order In the Matter of Implementation of Section 621 of the Cable Act is reversed on appeal as to the issue of complimentary Cable Services as in-kind contributions in a cable franchise and such result becomes final, within thirty (30) days of the result becoming final, Comcast will discontinue the charge for Basic Service for the Public Building locations listed in Exhibit A and provide such service on a complimentary basis. Any additional levels of Cable Service, outlets, or service locations ordered by the Township shall continue to be subject to standard rates.
(c) During the term of the Franchise, the Township may change a Public Building location listed in Exhibit A upon 90-days written notice to Comcast, provided that the new location is within 125 feet of existing Comcast cable distribution plant.
SERVICES TO COMMUNITY FACILITIES. Comcast shall, at no charge to the Township, provide complimentary services as described herein below to all present and future public facilities including, but not limited to, the following: the Township Administration Building, police stations, fire companies, public works buildings, water and sewer authorities, all public and private school buildings, public libraries and one (1) other Township facility designated by the Township (“Permitted Free Locations”). No charge shall be made for installation or service, except that Comcast may charge for installation or service for more than one (1) drop in each Permitted Free Location.
(a) Within three (3) months of the Effective Date and upon request, Comcast shall provide or maintain one (1) cable Drop, outlet, converter box (and other required end user equipment) and Standard level Cable Services (or equivalent) package to each Permitted Free Location. No charge shall be made for installation, equipment, or service, except that Comcast may charge for installation and materials beyond one hundred twenty-five (125) feet aerial/underground distance from the cable plant and/or installation and service for more than one drop in each Permitted Free Location.
(b) Within three (3) months of the Effective Date and upon request, Comcast shall provide or maintain one (1) cable modem internet access service (Residential standard level equivalent) to the following Permitted Free Locations:
(i) one (1) municipal facility in the Township; (ii) all public and private schools (K- 12); and (ii) all public libraries. The cable modem internet access service may be networked by the Township though Comcast assumes no responsibility for any service degradation caused by such networking. No charge shall be made for installation or service, except that Comcast may charge for: (i) installation beyond one hundred twenty-five (125) feet aerial/underground distance from the cable plant; and/or (ii) service for more than one (1) drop in each Permitted Free Location and/or (iii) service problems caused by the Township’s networking.
(c) For the purposes of this section, the term “school” means an educational institution that receives funding pursuant to Title I of the Elementary and Secondary Education Act of 1965, 20 U.S.C. § 6301 et seq., as amended, and does not include “home schools” or “cyber schools,” or any other educational situation that does not meet specific criterion set forth herein. SERVICES TO COMMUNITY FACILITIES. Upon the Effective Date, Charter will offer, without charge and on a voluntary basis, one cable service Drop and Basic Cable Service (or equivalent) with any necessary equipment for viewing to one outlet at each Town facility listed on Exhibit A, provided that the locations are located up to one hundred fifty (150) feet from Charter’s existing distribution system.
SERVICES TO COMMUNITY FACILITIES. (a) Comcast shall provide a Cable Service Drop and Expanded Cable Service (or equivalent) with any necessary digital terminal adapter (DTA or equivalent) to one (1) outlet at each municipal location listed in Exhibit A, located within one hundred fifty (125) feet of existing Comcast distribution plant or where Cable Service is currently being provided. In accordance with applicable law, Comcast will charge its marginal cost for each such account. Comcast shall invoice the County in writing regarding the amount of the monthly service fee for each account based on its marginal cost. Comcast shall not deduct the cost of the services from the franchise fee. The County may upgrade the level of Cable Service received at then current rate card prices for the higher level of service. The County may decline to receive the service, in which case it will not be invoiced.
(b) During the term of the Franchise, the County may transfer the municipal locations listed in Exhibit A upon ninety (90) days written notice to Comcast, provided that any new location is within one hundred twenty-five (125) feet of existing Comcast cable distribution plant.
SERVICES TO COMMUNITY FACILITIES. (a) Comcast shall continue to provide a Cable Service drop and Basic Service with any necessary cable box to one outlet at each Public Building listed in Exhibit A. If Comcast intends to charge for the Cable Services required by this section, it will give the Township one hundred twenty (120) days’ written notice of the commencement of such charges. The charges shall be consistent with applicable law, which as of the Effective Date is defined as the “marginal cost” of such Cable Services. Comcast will disclose in writing the amount due and shall provide to the Township reasonable detail sufficient to substantiate the marginal cost and the amount due. Charges may include those for services and equipment, if any, at each location and all applicable fees and taxes. The Township may, at any time during the term of the Agreement and upon thirty

(a) Comcast shall, at no charge to the Township, provide or maintain one standard installation drop and outlet and the Expanded Basic Service (or equivalent) package, including any end user equipment needed for this Cable Service, to all Township-owned and/or operated facilities, all public and private elementary and secondary (K-12) schools, and all public libraries located in the Township. The Township may relocate or add new facilities during the term of this Agreement to receive such Expanded Basic (or equivalent) package, provided that such facilities meet the qualifications set forth herein.
(b) For the purposes of this Section, the term “school” means an educational institution that receives funding pursuant to Title I of the Elementary and Secondary Education Act of 1965, 20 U.S.C. §6301 et seq., as amended, and does not mean “home schools.”
SERVICES TO COMMUNITY FACILITIES. (a) Comcast shall, at no charge to the Town, provide one (1) complimentary standard installation, one (1) Outlet, up to three (3) digital terminal adapters (DTA's or equivalent) and complimentary Basic and Expanded Basic services to the facilities listed in Appendix 1. To the extent so provided by applicable law, the marginal cost of such service constitutes a Franchise Fee assessed upon Comcast and shall be deducted from franchise fees paid to the Town/, with the marginal cost of the services being disclosed to the Town in advance. Comcast shall notify the Town in writing regarding the amount of the monthly service fee for each account based on marginal cost. The Town shall then notify Comcast, within thirty (30) days of receiving Comcast’s notice, whether it desires the amount due each month to be deducted from the next franchise fee payment, to have service terminated, or to pay for service at current rate card prices. No charge shall be made for installations, except that Comcast may charge for installations more than two hundred twenty-five (225) linear feet Drop distance from the cable plant, and/or for more than one
(1) Drop in each Permitted Location.
(b) Comcast shall not be required to provide the complimentary Cable Service and equipment described in Section 7.1 (a) above to buildings owned by the Town and leased to third parties that are not providing government services, locations at which government employees are not regularly stationed, storage facilities or those locations that are not fit or designed for occupancy.
(c) If any equipment provided by Comcast under this Section is lost, stolen, or damaged through the fault of the Town, then the Town rather than Comcast shall be responsible for the cost of replacement or repair of the equipment.
(d) Cable Service may not be resold, except by the express permission of Comcast, or otherwise used in contravention of Comcast's rights with third parties respecting programming.
SERVICES TO COMMUNITY FACILITIES. Armstrong shall, at no charge to the Township, provide video services to the public facilities set forth in Exhibit “A” in accordance with the terms of this section. Any additions to the Exhibit “A” shall be at the mutual agreement of the Township and Armstrong.
(a) Within three (3) months of the Effective Date of this Agreement, one (1) cable drop, outlet and basic and expanded basic services (or equivalent) package to each building. No charge shall be made for installation or service, except that Armstrong may charge for installation and service for more than one (1) drop in each building.
SERVICES TO COMMUNITY FACILITIES. (a) Franchisee shall, at no charge to the Township, provide the following services to all present and future public facilities in Franchisee’s service area as contained in Exhibit “A”:

If Comcast intends to charge for the services required by this section, it will give the Township 120 days’ notice of the commencement of charges. The charges shall be consistent with applicable law – as of the Effective Date, defined as the “marginal cost” of providing such Cable Services. Comcast shall provide to the Township in writing reasonable detail sufficient to define the marginal cost and the amount due. Comcast shall arrange with the Township for invoicing or deductions from the franchise fee. Charges may include those for services and equipment, if any, at each location. Charges may include applicable fees and taxes and may be subject to adjustment at a time consistent with Comcast’s retail rate adjustments. The Township may remove locations or change the level of Cable Service indicated on Exhibit A with 30 days’ written notice to Comcast. The Township may elect in writing not to receive the Cable Service, in which case it will not be invoiced and no deduction will be taken from the franchise fee.
(b) During the term of the Franchise, the Township may change a Public Building location listed in Exhibit A upon 90-days written notice to Comcast, provided that the new location is within 125 feet of existing Comcast cable distribution plant.
