Spousal Carve-Out. Effective September 1, 2015, all Bus Technicians on the EACS group health insurance plan will be under the spousal carve-out requirements. If an employee has a spouse working elsewhere who is eligible for group health benefits at their place of employment, he/she must take the group health insurance at their place of employment, unless their cost for the single plan is greater than two (2) times the employee’s cost for the single plan at East Allen County Schools. If the spouse takes their employer’s group health insurance, the spouse may enroll in East Allen County School’s Group Health Insurance Plan, but the plan will pay only on a secondary basis.

Spousal Carve-Out. If the employee’s spouse is employed where the employee is eligible for single plan group insurance, the spouse will not be eligible for coverage under LMHA's hospitalization/major medical plan. The Employer reserves the right to exclude from the LMHA hospitalization/major medical plans spouses who would have health insurance available through their employer effective with the plan year commencing January 1, 2022, and the subject of spousal coverage shall be referred to the Health Care Cost Containment Committee to discuss the effects of said change in coverage. Side Agreement Mutual agreement will be established to have the AFSCME Regional Director serve as a contributing participant on an interim basis in meetings of the Health Care Cost Containment Committee upon their resumption.

A Medical Reimbursement Plan (Plan D) will be offered at no cost to all ineligible spouses who apply for Plan D coverage for the life of this Agreement.

Annual certification of spousal insurance eligibility at place of employment will be required to be submitted to the Treasurer’s Office no later than August 31 each year, on a form provided by the Treasurer’s Office. Once the spouse enrolls in insurance coverage at the spouse’s place of employment, the spouse may not re-enroll in insurance coverage through the District unless the spouse experiences a qualifying event as defined under the District’s insurance plan. If this occurs, the spouse may enroll in the District’s insurance plan within thirty-one (31) days of the date the spouse experiences the qualifying event as defined under the District’s insurance plan.

This requirement does not apply to any spouse who: Is not employed or is retired without access to a group retirement plan Is employed and working less than 30 hours per week; Is employed and not eligible for coverage under his/her/their employer’s plan. However, the open enrollment period for the spouse’s employer is not relevant to a spouse’s ability to join the plan. Is employed by the City of Huron;
