Superannuation Benefits. (a) An employer may make an application to the Commission for relief from the obligation to make severance payments in circumstances where:
(i) the employer has contributed to a superannuation scheme which provides a particular benefit to an employee in a redundancy situation; and
(ii) the particular benefit to the employee is over and above any benefit the employee might obtain from any legislative scheme providing for superannuation benefits (currently the federal Superannuation Guarantee levy) or an award based superannuation scheme.
Superannuation Benefits. (1) Subject to further order of a Court with jurisdiction, where an employee who is terminated receives a benefit from a superannuation scheme, he or she shall only receive under clause
Superannuation Benefits. An employee who is laid off shall retain all superannuation rights held by him at the date of his layoff, until he is recalled. Should the employee request a refund of his superannuation contributions he shall cease to be an employee.
Superannuation Benefits. All benefits provided by the Public Service Superannuation Act shall apply to retiring employees covered by the provisions of that Act to the extent provided by that Act.
Superannuation Benefits. Subject to further order of the Commission where an employee who is terminated receives a benefit from a superannuation scheme, he or she shall only receive under subclause 2.4.6 the difference between the severance pay specified in that subclause and the amount of the superannuation benefit he or she receives which is attributable to employer contributions only. If this superannuation benefit is greater than the amount due under subclause 2.4.6 then he or she shall receive no payment under that subclause.
Superannuation Benefits. (1) Where an employee, who is terminated receives a benefit from a superannuation scheme, the employee shall only receive under 5.3 the difference between the severance pay specified in that subclause and the amount of the superannuation benefit the employee receives which is attributable to Company contributions only.
Superannuation Benefits. A-5.01 Subject to the rules and regulations of the Plan, the Co-operative will provide eligible employees with the Co-operative Superannuation Society Pension Plan. Employee contributions will be matched by the Co-operative. The contribution rate by the Co-operative and the employee to be applied to an employee’s earnings will be seven and one-half (7.5%) percent less the Canada Pension Plan contribution rate. A-5.02 The Co-operative shall make employees aware of their eligibility to participate in the plan and shall provide each such employee with an application form.

a. the employer has contributed to a superannuation scheme which provides a particular benefit to an employee in a redundancy situation; and
b. the particular benefit to the employee is over and above any benefit the employee might obtain from any legislative scheme providing for superannuation benefits (currently the federal Superannuation Guarantee levy).
Superannuation Benefits. An employer may make an application to FWC for relief from the obligation to make redundancy payments in circumstances where:
(a) the employer has contributed to a superannuation scheme which provides a particular benefit to an employee in a redundancy situation; and
(b) the particular benefit to the employee is over and above any benefit the employee might obtain from any legislative scheme providing for superannuation benefits (currently the federal Superannuation Guarantee levy) or an Agreement based superannuation scheme.
Superannuation Benefits. Subject to further Award or Order by the Industrial Relations Commission, where an Employee who is terminated received a Benefit in the nature of severance pay from a Superannuation Scheme, the Employee shall only receive under clause
