SUPERINTENDENCE AND SUPERVISION. Developer shall keep on the construction site during the construction of the Extensions a competent superintendent and any necessary assistants, all satisfactory to the City Engineer. The superintendent shall not be changed except with the consent of the City Engineer unless the superintendent ceases to be in Developer’s employ. The superintendent shall represent Developer, and all directions given to the superintendent shall be as binding as though given to Developer. Instructions to Developer shall be confirmed in writing upon its request in each case. Developer shall give efficient supervision to the work, using its best skill and attention.

SUPERINTENDENCE AND SUPERVISION. ‌ 14.1. County’s instructions are to be given through Consultant, which instructions Contractor must strictly and promptly follow in every case. Contractor shall keep on the Project a full-time, competent, English-speaking superintendent and any necessary assistants, all of whom must be satisfactory to Consultant. The superintendent shall not be changed except with the written consent of Consultant, unless the superintendent proves to be unsatisfactory to Contractor and ceases to be in its employ. On a daily basis, Contractor’s superintendent shall record, at a minimum, the following information in a bound log: the day; date; weather conditions and how any weather condition affected progress of the Work; time of commencement of Work for the day; the Work being performed; materials, labor, personnel, equipment and Subcontractors at the Project site; visitors to the Project site, including representatives of County, Consultant, or regulatory representatives; any event that caused or contributed a delay to the critical path of the Project; any special or unusual conditions or occurrences encountered; and the time of termination of Work for the day. All information shall be recorded in the daily log in ink, unless otherwise approved by Consultant. The daily log shall be kept on or accessible from the Project site and shall be available at all times for inspection and copying by County and Consultant. 14.3. The Contract Administrator, Contractor, and Consultant shall meet at least every two (2) weeks (or as otherwise determined by the Contract Administrator) during the course of the Work to review and agree upon the Work performed to date and to establish the controlling items of Work for the next two (2) weeks. Consultant shall publish, keep, and distribute minutes and any comments thereto of each such meeting. 14.4. If Contractor, in the course of performing the Work, finds any discrepancy between this Contract and the physical conditions of the locality, or any errors, omissions, or discrepancies in this Contract, it shall be Contractor’s duty to immediately inform Consultant, in writing, and Consultant will promptly review same. XXXX shall keep on the Project site during its progress, a competent, full time, English speaking Superintendent or Supervisor (“Superintendent”) and any necessary assistants, all satisfactory to the CONSULTANT and PROJECT MANAGER. The Superintendent or Supervisor shall not be changed except with the written consent of PROJECT MANAGER, unless the Superintendent or Supervisor proved to be unsatisfactory to XXXX and ceases to be in its employ. The Superintendent or Supervisor shall represent XXXX and all direction given to the Superintendent or Supervisor shall be as binding as if given to XXXX and will be confirmed in writing by CONSULTANT. CONSULTANT shall publish, keep, and distribute minutes of, and any comments on, each such meeting. 3.4.4 XXXX shall supervise and direct the work competently and efficiently, devoting such attention thereto and applying such skills and expertise as may be necessary to perform the Work in accordance with the CONTRACT DOCUMENTS. XXXX shall be solely responsible for the means, methods, techniques, sequences and procedures of construction.
SUPERINTENDENCE AND SUPERVISION. 16.1 The orders of the City are to be given through the Project Manager, whose instructions are to be strictly and promptly followed in every case. The Contractor shall maintain a competent resident supervisor, who shall serve as the Designated Representative, and any necessary assistants on the Project site throughout the duration of the Project. The Designated Representative shall serve as the Contractor’s Superintendent on site and shall be responsible for continuous field supervision, coordination, and completion of the work. The Designated Representative shall not be changed except with the consent of the Project Manager, unless the Designated Representative proves to be unsatisfactory to the Contractor and ceases to be in its employ. The Contractor’s Project Manager shall represent the Contractor, and all direction given to the Designated Representative shall be as binding as if given to the Contractor. Directions will be confirmed in writing to the Contractor. Other directions will be so confirmed on written request in each case.

The Construction Manager shall be solely responsible for all construction means, methods, techniques, sequences and procedures and for coordinating all portions of the Work under the Construction Management Agreement. Construction Manager shall employ and maintain on the Project only competent personnel including during the progress of the Work a full-time competent English speaking superintendent and any necessary assistants, all satisfactory to the Owner. The Construction Manager shall employ the Key Employees identified in Exhibit “S” who shall not be replaced and who shall remain on the Project until Final Completion unless otherwise approved in writing by Owner. The person identified above in the first paragraph of Article 3 shall be deemed the Construction Manager's authorized representative (“CM’s Authorized Representative”) at the site and shall be authorized to receive and accept any and all communications from the Owner’s Representative. CM’s Authorized Representative shall not be changed except with the written consent of the Owner’s Representative, unless CM’s Authorized Representative proves to be unsatisfactory to the Construction Manager or ceases to be in its employ. CM’s Authorized Representative shall represent the Construction Manager and all direction given to CM’s Authorized Representative shall be as binding as if given to Construction Manager. The Owner shall be provided telephone number(s) for CM’s Authorized Representative.

The superintendent shall not be changed except with the consent of the Architect and the City unless the superintendent proves to be unsatisfactory to the Construction Manager and/or ceases to be in its employ; provided however, that the Architect and the City retain the right to require that the Construction Manager replace the superintendent at any time, such right not to be arbitrarily exercised. 8.31.2 The superintendent shall be fully authorized to act for the Construction Manager and receive whatever orders as may be given for the proper prosecution of the Work or notices in connection therewith.
