Technical Assistance and Capacity Building. 1. The Parties recognise that cooperation, information sharing, capacity building and technical assistance are important elements in promoting the objectives of this Chapter.
Technical Assistance and Capacity Building. [Targeted technical assistance and capacity building assistance to developing country Members, including LDC Members, shall be provided for the purpose of implementation of the disciplines under this Agreement. Technical Assistance and Capacity Building. The United States has considerable experience in and has numerous programs that assist other countries in trade capacity building efforts related to customs administration. For example, a U.S. Agency for International Development (USAID) program on Trade and Accession Facilitation for Afghanistan (TAFA) aimed to boost trade in that nation.52 More broadly, CBP works with other federal agencies including USAID and the Department of Defense to provide training and technical assistance to other countries to improve execution of their border operations.53 Through the APEC Committee on Trade and Investment, the United States works with its partners to promote trade facilitation and provide capacity building.54 The TFA requires that donor members, including the United States, provide the needed support to developing and LDC members. Each donor member is required to provide specified information on the assistance and capacity building given over the past year and committed to for the upcoming year.55 These members must also submit contact information for the agencies providing the aid and regularly update all information. In the 114th Congress, Senator Xxx Xxxxxx introduced a bill (S. 2201) that would instruct the executive branch to ensure coordination of U.S. capacity building efforts. The bill aims to create a whole-of-government strategy as part of the U.S. effort to achieve the ambitious goals of the TFA. It would establish an interagency coordinating committee, chaired by the Secretary of State and informed by a newly created trade capacity advisory committee comprised of public and non- public organizations, to develop a biennial strategic plan for trade capacity building efforts to be submitted to Congress. TFA Capacity Building Donor members agree to facilitate the provision of assistance and support for capacity building to developing country and least-developed country members on mutually agreed terms either bilaterally or through the appropriate international organizations. The objective is to assist developing country and least-developed country members to implement the provisions of Section I of this Agreement. (Section II, Article 21) Along with other TFA donor members, by promoting harmonized practices and sharing implementation experiences, from documentation templates and website formats to processes for collecting customs or coordinating domestic agencies, the United States can help advance effective implementation of the TFA. Technical Assistance and Capacity Building. Provision of technical assistance to develop the capacity of institutions involved in the establishment and operation of economic zones in the territory of the Recipient, including, without limitation, XXXX, BEPZA, BCC, the Public Private Partnership Office under the Recipient’s Prime Minister’s Office, the Recipient’s Board of Investment, the Department of Environment, the Recipient’s High Tech Park Authority, including technical assistance to: build capacity in the financial, engineering, legal, procurement, social and environmental areas; carry out full feasibility studies and demand surveys, including financial, economic, legal, social and environmental assessments; develop information memoranda to seek private participation, including the development of master plans for selected sites, encompassing environmental and social infrastructure, zoning and pricing; develop operational guidelines to monitor the performance of the firm that shall enter into a concession agreement with the Recipient for the purpose of developing the Kaliakoir hi-tech park and any future economic zones, and ensure compliance with all legal and regulatory requirements related to such transaction; and develop a suitable dispute resolution mechanism. Provision of technical assistance to develop a business-friendly environment and pilot business environment reforms, including the provision of technical assistance, inter alia, to: develop a one-stop shop system within XXXX, BEPZA, and the Hi Tech Park Authority to deal with registration, export and import licensing, customs clearance and other required regulations; develop a secured lending regime for movable property within the economic zones; develop a dispute resolution mechanism to settle commercial disputes of zone-registered companies or between economic zone companies and suppliers in line with the laws of the Recipient; and review the relevant legal and institutional frameworks, develop systems and build capacity to establish the foregoing services from within economic zones.

Technical Assistance and Capacity Building. During the Ministerial a proposal was announced for a voluntary fund to support developing country and least developed country members. The current pledges amount to USD$20 million, this is not enough to address the ongoing burdens this agreement will impose on developing countries. Failure to have an agreement on how support will be provided undermines the ability for developing country members to make decisions on obligations.

The Parties shall pursue technical assistance and capacity-building programmes through integrated strategies that incorporate economic, social, cultural, environmental and institutional elements that are unique to each Party. In this context and within the framework of development policies and reforms pursued by the Parties; the Parties' cooperation framework and orientation shall take into account the different levels of development as well as the economic needs of each Party and the difficulties faced in meeting their obligations under this Agreement.
