Telematics. All vehicles are supplied with Telematics devices and all costs for including the installation and operation of the Telematics unit is included in the Vehicle Lease charges
20.1 You may not postpone or cancel performance of the Telematics Services or part thereof except with our prior written consent.
20.2 We are entitled to determine the manner in which the Telematics Services are performed.
20.3 All Telematics Devices must be in full working order upon Off-Lease of the Vehicle.
20.4 The Parties acknowledge and agree that providing there is not a change to the Telematics Services which has a material detrimental impact on the features or functionality of the Telematics Services, we may at our discretion change the functionality of the Telematics Services as currently set out in this Clause 20.
20.5 All aspects of the Telematics Services will be delivered remotely.
20.6 Any new feature, improvement or modification implemented by us into the Telematics Services which are more generally available to all of our Customers shall be included in the Telematics Services.
20.7 You shall not (except to the extent permitted by applicable law):
20.7.1 access all or any part of the Telematics Services in order to build a product or service which competes with the Telematics Services;
20.7.2 attempt to obtain or assist third parties in obtaining, access to the Telematics Services;
20.7.3 copy the Software in whole or in part;
20.7.4 introduce any virus, code or software into the Software; or
20.7.5 use the Software otherwise than in accordance with this Agreement.
20.8 You shall use reasonable endeavours to prevent any unauthorised access to, or use of, the Telematics Services and notify us promptly of any such unauthorised access or use.
20.9 We give no guarantee or warranty as to the availability of the Telematics Services.
20.10 Ownership of the Telematics Devices shall remain with us at all times.
20.11 You shall not remove or tamper with or attempt to remove or tamper with the Telematics Devices.
20.12 If the Telematics Device is damaged beyond repair or destroyed or where its repair would be uneconomic, we shall provide you with a replacement Telematics Device.
20.13 We reserve the right to suspend the Telematics Services by reasonable notice to you in order to undertake maintenance work.
20.14 You acknowledge and agree that you will lose access to telematics data relating to a specific Vehicle at the time that Vehicle is Off-Lease.
Telematics. The Goods may include an equipment data recording and transmission system (“Telematics”) with different data levels depending on the service level agreed with XxXxxxxxx. Purchaser agrees that certain data including equipment details, operational data, time data and position data may be recorded, transmitted, stored, analysed and evaluated by XxXxxxxxx and its Affiliates and relevant suppliers, consultants and distributors for online reporting services and offering and recommending certain goods and services to Purchaser. Purchaser further agrees that XxXxxxxxx may use such data, along with other data, on an anonymous and aggregated basis, to test, develop, evaluate, improve and enhance its goods and services and to create derivative works based on such data. Such data shall be trade secrets of XxXxxxxxx. Subject to payment of the Contract Price and all agreed additional fees, XxXxxxxxx herewith grants Purchaser a non-exclusive and non-transferable right to use Telematics for the sole purpose of managing its equipment during the agreed term. Purchaser shall not copy or modify any part of Telematics or create any derivative works from Telematics, use or provide Telematics on a white-labelled basis or otherwise for the benefit of any third party or use any materials or communications facilities provided by XxXxxxxxx other than for the purposes of Telematics. XxXxxxxxx shall not publish or use any data which identifies Purchaser or any individual user to provide goods or services to other customers of XxXxxxxxx.

Telematics. At the written (including, but not limited to mailed letter, facsimile, email, or electronic entry at the Contract website), request of a Fleet Manager, the Contractor shall provide a Vehicle tracking system capable of monitoring the location, movements, status and behavior of Authorized User Vehicles. The Contractor shall list pricing for the Vehicle tracking system devices and related services in the Contract. Authorized User will be required to enter into an End User Agreement with the provider prior to initiation of services. OGS has not reviewed or approved this End User Agreement. An Authorized User seeking to acquire this offering must review the End User Agreement terms and conditions. An Authorized User is further responsible for having its counsel review and approve the End User Agreement prior to ordering. If any terms and/or conditions of the End User Agreement are not acceptable to Authorized User’s counsel, it is the responsibility of such counsel to negotiate any needed amendments. See Appendix C: Fleet Maintenance Services Documents, Number 1: Contractor and Pricing Information for specific information about the offered telematics system and the End User Agreement;
Telematics. 10.1 Drover may, at its sole discretion, install a telematics solution ("Telematics") in the Vehicle at Drover's own cost. Telematics allows Drover to GS track Vehicles as well as extract mileage, fuel level, acceleration and braking data, as well as remotely lock / unlock or immobilise Vehicles. By using the Vehicle, the Driver consents to the collection of such data.
Telematics. If you have elected to receive Telematics Devices and Telematics Services the terms will be set out in Schedule 1.
Telematics. Contractor shall provide manufacturer specific telematics program (e.g. JDLink) for the length of the warranty period. Machine alert conditions shall be made available by email to specific supervisors identified by the Central Garage. Provide an optional quote for the cost of continuing the telematics program after the warranty period expires.
Telematics. The Equipment may be equipped with a telematics device that enables The Home Depot or its fleet management provider to monitor the use and location of the Equipment. The telematics device is used to collect the Equipment’s location (determined by GPS systems), fuel consumption, mileage, and systems status information. The Home Depot may use the information for various purposes, including, but not limited to:
(i) locating lost or stolen Equipment; (ii) analyzing and improving The Home Depot’s rental program; (iii) enforcing the terms of this Agreement; or
(iv) providing Renter with support, assistance, or services. The Home Depot may share information collected with companies performing services for The Home Depot, and as deemed necessary by The Home Depot, (A) to comply with legal process or a request from a governmental entity, and (B) to protect The Home Depot's rights and property.

Purchaser agrees that certain data including equipment details, operational data, time data and position data may be recorded, transmitted, stored, analysed and evaluated by MWS Equipment and its Affiliates and relevant suppliers, consultants and distributors for online reporting services and offering and recommending certain goods and services to Purchaser. Purchaser further agrees that MWS Equipment may use such data, along with other data, on an anonymous and aggregated basis, to test, develop, evaluate, improve and enhance its goods and services and to create derivative works based on such data. Such data shall be trade secrets of MWS Equipment. Subject to
Telematics. At the Written request of a Fleet Manager, the Contractor Shall provide a Vehicle tracking system capable of monitoring the location, movements, status and behavior of Authorized User Vehicles. The Contractor Shall offer the Vehicle tracking system devices and related services at a price no greater than the price set by the manufacturer, and at the time of purchase proof of manufacturer price shall be provided to the Authorized User.
