Transfer Provision. TRANSFERS -- Prior to the Annuity Date, the Owner may transfer all or part of an Account without the imposition of any fee or charge if there have been no more than 12 transfers made in the Contract Year. All transfers are subject to the following:
Transfer Provision. 12.3.1 A Contractor who is signatory to a construction collective agreement may request that certain persons in the employ of that Contractor be transferred to a Project covered by this Agreement. This provision shall only apply for purposes of securing:
a) Supervisory personnel covered by this Agreement;
b) Personnel with skills of a specialized nature;
c) Personnel with skills necessary for the effective operation of a Contractor's on the job training program;
d) Key personnel required for work on contracts of short duration and in which the craft or skills required to perform the work are generally limited to one or two trades.
12.3.2 A request for a transfer must be submitted to the Council and the Association, in writing, at least five (5) working days in advance of the time the person is required on the Project.
12.3.3 The transfer request shall indicate the following:
a) The name, social insurance number and trade qualifications of the person to be transferred;
b) The Appendix in this Agreement under which the person to be transferred would be working, and the corresponding classification;
c) Related experience relative to 12.3.1 (a), (b) or (c), as the case may be.
12.3.4 The Council shall consult with representatives from the applicable Local Union and within three (3) working days from the date of receipt of the transfer request, the Contractor shall be advised of the respective positions of the Association and the Council; and,
i) if the Council and Association mutually agree that the transfer meets the provisions of this Article, then the Contractor may proceed with the transfer;
ii) if the Council and Association mutually agree that the transfer does not meet the provisions of this Article, then the Contractor will be obliged to follow the procedures set out in Article 12.1.1;
iii) if either the Council or the Association does not agree that the transfer is in accord with the provisions of this Article, then the Contractor may refer the matter to the President of the Council and the Managing Director of the Association, or their respective delegates, who shall meet and attempt to resolve same. If agreement cannot be reached, the Contractor may request that the matter be resolved in accordance with Article 31.
12.3.5 When a person is transferred, the Association shall notify M.A.E.T. of the name and classification.

Transfer Provision. All of the benefits of this Formula Guard Agreement can be transferred to the next owner of the Watercraft within the Term of the Agreement. Incomplete forms will not be processed and the Agreement will be void. No transfer is valid until it is received and accepted by the Administrator. We will charge a $25 transfer fee for each transfer that exceeds the annual Certificate Year limit of 15. Transfers will be effected at the end of the Valuation Period in which We receive Your request for the transfer. TRANSFERS OF ACCUMULATION UNITS BETWEEN VARIABLE ACCOUNTS Both prior to and after the Annuity Date, You may transfer all or a portion of Your investment in one Variable Account to another Variable Account. A transfer will result in the purchase of Accumulation Units in a Variable Account and the redemption of Accumulation Units in the other Variable Account. The minimum amount which can be transferred between Variable Accounts is $100. The amount that must remain in the Variable Account is $100. If the remaining amount in the Variable Account is less than $100, then the entire amount of the Variable Account will be transferred. TRANSFERS OF ACCUMULATION UNITS TO AND FROM THE FIXED ACCOUNT Both prior to and after the Annuity Date, You may transfer all or any part of the Certificate Value from the Variable Account(s) to the Fixed Account of the Certificate. After the Annuity Date no transfers from the Fixed Account to the Variable Account are allowed. For transfers from the Fixed Account prior to the Annuity Date see ACCUMULATION PROVISIONS - FIXED ACCOUNT ACCUMULATION VALUE. During the Annuity Period, the amount transferred to the Fixed Account from a Variable Account will be equal to the annuity reserve for the Payee's interest in that Variable Account. The annuity reserve is the product of (a) multiplied by (b) multiplied by (c), where
(a) is the number of Annuity Units representing the Participant's interest in the Variable Account; (b) is the Annuity Unit Value for the Variable Account; and (c) is the present value of $1.00 per payment period as of the age of the Annuitant at the time of transfer for the Annuity Option, determined using the 1983a Annuity Mortality Tables with interest at 3.5% per year. From the date hereof until the second anniversary of the date of this Agreement (the "LOCK-UP PERIOD"), the Existing Members shall not Dispose of their Units to any person other than (i) the Company or (ii) Cherokee Investors, its assignee(s) or its designee(s).
