The President of the. Local shall be exempt from this clause and shall be the last employee to be laid off. a) If Extrusion is working but not secondary, then the sliding scale will be applied as long as the Union representatives hold seniority in the Occupational Group. Likewise, if all production is on layoff but skilled trades are working, then only the Union President or designate will be brought in. b) If Extrusion only is working, one (1) Union Representation per shift will be retained, i.e. 1 holds extrusion seniority, balance Group 40 and 1 Pool to maximum of 3 Pool or 3 Extrusion holding extrusion Occupational Group. 13.01 Postings for all Occupational Group jobs will appear on Bulletin boards, whether it will be for replacement or backup personnel. The posting shall include the number of people required except when it may not be possible due to new lines or cells ramping up. 13.02 A selection under this section will be based on seniority providing the applicant has the necessary qualifications and ability to satisfactorily perform the job. The Company agrees in the application of article 13 to provide interested employees with instruction during the trial period to assist them better familiarize themselves with the necessary processes and methods to properly perform the job. 13.03 A Vacancy shall be defined as an open position created by: (1) a need to increase the work force. (2) the termination, transfer or movement of an employee from an existing position. (a) Permanent job openings, except in pool, shall be posted for a period of 48 hours. (b) Before a final selection on a job posting the Company will forthwith advise the Union of its selection and will for a period of 48 hours hear representations from the Union with respect to the selection made. (c) All applicants not selected who have greater seniority than the successful applicant will be re-interviewed by the Plant Superintendent or his representative and following the interview, the Company will advise the Union Committee of its position and will for a period of 48 hours hear representations from the Committee and/or the rejected employee with respect to his rejection. (d) The successful applicant shall start training within 4 weeks of the selection being made and posted. The time limits may be extended by mutual agreement between the Company and the Union.

The President of the. Faculty Forum shall be awarded 24 load units of release time (or overload at the discretion of the Faculty Forum President) to be distributed over a two-year term, subject to payment for the released time by the Faculty Forum. A minimum of 8 load units must be taken each of the two years of the term. Payment shall be at the relevant overload rate.

(b) A condition requiring reduction or elimination of a department may be declared if the President finds that institutional operations within a reduced budget, or failure to reallocate funds, would result in a serious distortion of the academic or other essential programs and services of the University if retrenchment procedures were not implemented. Recognizing the requirements of University Standard 580-021-0315 for prior consultation with the Board of Trustees, the parties agree that factual disputes regarding the existence of a condition of financial exigency or the existence of a condition requiring reduction or elimination of a program or department shall not be subject to the grievance, contract dispute resolution, or arbitration articles of this Agreement. An allegation that procedures set forth in this Article were not adhered to is a proper subject for a grievance.

  • Leave, President, O.N.A Upon application in writing by the Association on behalf of the nurse to the Hospital, a leave of absence shall be granted to such nurse elected to the office of President of the Ontario Nurses' Association for a period of up to three (3) consecutive two (2) year terms. Notwithstanding Article 10.04, there shall be no loss of service or seniority for a nurse during such leave of absence. During such leave of absence, the nurse's salary and applicable benefits shall be maintained by the Hospital and the Association agrees to reimburse the Hospital in the amount of the full cost of such salary and applicable benefits. It is understood, however, that during such leave the nurse shall be deemed to be an employee of the Ontario Nurses' Association. The nurse agrees to notify the Hospital of her or his intention to return to work at least two (2) weeks prior to the date of such return.
