Waiver of Health Insurance Coverage. Employees who are eligible to participate in the Foundation’s health insurance plans are entitled to waive their right to enroll and to participate in such plan, and may do so by submitting a signed “Waiver of Health Insurance Benefits Form,” which may be obtained from the Foundation’s Office of Human Resources. Full-time employees who are eligible for individual health insurance coverage shall receive $1000 for any year for which they waive such coverage. Full-time employees who are eligible for Parent & Child, Couple or Family health insurance coverage shall receive $1500 for any year for which they waive such coverage. Part-time A employees who are eligible for individual health insurance coverage shall receive $1000 for any year in which they waive such coverage. The foregoing amounts will be pro-rated if they are for less than the full calendar year. In order to waive a health insurance benefit, the employee must show proof of such health insurance benefit coverage elsewhere, in the manner and with the type of proof required by the waiver form. Eligible employees who waive coverage and later choose to participate in the health insurance plan may do so only during the next scheduled open enrollment period, unless a “qualifying event” (e.g., marriage, domestic partner registration, divorce, birth or adoption of a child) occurs. Employees who enroll for health insurance coverage as a result of a “qualifying event” shall no longer be eligible for the waiver benefit for that plan year. Employees must re-apply for the waiver during each open enrollment period.

Waiver of Health Insurance Coverage. Employees will be allowed to waive the health insurance coverage provided by the Board and, in lieu of receiving health insurance coverage, Employees will receive a cash benefit (in the form of additional compensation) in the amount of $333.33 per month ($4,000 per year), paid quarterly, when they waive health coverage. The Cafeteria Plan shall not contain any provisions requiring the contribution of amounts derived from the waiver of health insurance into any deferred compensation arrangement, including Code Section 403(b) annuities. Any election by an employee to defer such amounts into a Code Section 403(b) annuity shall be made by the employee individually, outside of the Cafeteria Plan, and in accordance with the rules under Code Section 403(b).

Waiver of Health Insurance Coverage. Effective January 1, 2002, the Employer shall remit an annual payment of $2500 to be paid bi- weekly to each employee who, with satisfactory proof of alternative Health Insurance coverage received in another plan, elects not to take any coverage under a City Health Care Plan. Waiver of Health Insurance Coverage. Employees who, upon providing satisfactory documentation of other health insurance coverage, opt to discontinue or reduce their coverage through the Agency shall receive $1,500 per annum if they convert from family to individual coverage, or $2,500 per annum if they opt out of family health insurance coverage under Paragraphs A or B of this Article. The payment to part-time employees who are eligible for health insurance coverage, who opt to discontinue or reduce such health insurance coverage shall be pro-rated based upon their regularly scheduled hours as of January 1 of each year.

The Board may unilaterally amend any provisions under the Cafeteria Plan in order to maintain its tax favored status (such as amendments necessitated by changes in the Code or the Treasury Regulations); provided that the Board may not unilaterally amend the Cafeteria Plan in a manner that will alter the eligibility of employees covered by this Agreement to participate in the Cafeteria Plan, or that will reduce benefit levels under the Cafeteria Plan; and, further provided, that the Board will give written notice to the Association of any amendment, including a copy of any such amendment, at least 30 calendar days before the amendment is to take effect.
