Warranty Maintenance. Unless otherwise agreed to by the parties, in writing, all war- ranty maintenance shall be completed by an OEM Approved Repair Facility authorized to perform warranty maintenance and acceptable to AEPC™.
Warranty Maintenance. 2.9.1. A Standard 2 year for the generator set shall be included to guarantee against defective material and workmanship in accordance with the manufacturer's published warranty from date of start-up. Optional warranties shall be available upon request.
Warranty Maintenance. Neither City nor Contractor makes any express or implied warranty of any nature regarding City’s equipment, including, but not limited to: merchantability or fitness for any particular purpose; design or condition; workmanship; freedom from latent defects; compliance with the requirements of any law, rule, specification, or contract, or its non-infringement of any patent, trademark, or license. Provided City or the manufacturer has supplied required City-owned warranty documents to Contractor, Contractor shall take all actions required to preserve any and all manufacturers’ warranties regarding vehicles and equipment. Any warranty reimbursements shall be payable to Contractor.
Warranty Maintenance. 6.1 The supplier warrants that all goods and services provided by supplier to Mojo are free of defects and errors and suitable for the intended use by Mojo, and the supplier is liable towards Mojo for all direct and indirect damages that are a result of such defects. Notwithstanding any other right of Mojo, the supplier shall upon Mojo’s first request immediately repair any defect and Mojo shall be entitled to suspend its contractual obligations until the repair is completed.
6.2 The supplier fully indemnifies Mojo of any and all claims of third parties that are a direct or indirect result of any defect to the goods or services provided by supplier. The supplier also fully indemnifies Mojo of all claims of third parties who claim to have any title or interest in goods or services provided by the supplier. The supplier warrants that Mojo can make use of the goods and services without any limitation or restriction.
6.3 The supplier shall, upon Mojo’s first request, provide maintenance to all delivered goods in accordance with applicable business standards.
Warranty Maintenance. Each Leased Item is covered by the warranty of the corresponding manufacturer of the Leased Item, the terms and conditions of which are stipulated in the service book attached to the Leased Item.
Warranty Maintenance. Buyer shall cause all the representations and warranties of Buyer contained in this Agreement to be true and correct on and as of the Closing Date.
Warranty Maintenance. 27.1 Standard: The System Integrator warrants that the Project, including the Digital Platform, all the system(s), materials and goods supplied pursuant to the Agreement, shall be free from any defect or deficiency in the material, design, engineering, and workmanship that prevent the system and/or any of its systems(s) from fulfilling the technical requirements or that limit in a material fashion the performance, reliability, or extensibility of the system and/or any of its sub-system(s). Commercial warranty provisions of products supplied under the Agreement shall apply to the extent they do not conflict with the provisions of this Agreement.
27.2 The System Integrator also warrants that the products, materials and other goods supplied under the Agreement are new, unused and incorporate all recent improvements in design that materially affect the system’s or subsystem’s ability to fulfill the technical requirements specified in this Agreement and the RFP.
27.3 In addition, the System Integrator warrants that: (i) all goods components to be incorporated into the system form part of the IA/OEM’s and/or subcontractor’s current product lines.
27.4 The warranty period shall commence from the date of Go-Live of the Project or of any major component or subsystem for which phased Go-Live is provided for in the Agreement and shall extend for as follows: <StandardHardware> <Tilltheendoftheagreement OR<6months>post completionoftheagreement> <COTSSoftware> <Tilltheendoftheagreement OR<6months>post completionoftheagreement> <BespokeSoftware> <Tilltheendoftheagreement OR<6months>post completionoftheagreement> ITPO or any of its department should approve signoff within fifteen (15) days from the submission of deliverables for Go-Live/phased Go-live (as relevant, depending on project requirement) by the System Integrator. In case the ITPO or any of its department fails to respond and provide feedback on the above stated submission, the deliverables will be deemed accepted for the commencement of warranty for the Project. However, in case ITPO confirms to vendor an alternative date, then the date would stand revised for deemed acceptance.
27.5 If during the warranty period any defect or deficiency is found in the material, design and performance/workmanship of the Project and other services provided by the System Integrator, the System Integrator shall promptly, in consultation and agreement with ITPO, and at the System Integrator’s sole cost repair, replace, or otherwis...

Warranty Maintenance. Buyer shall cause all the representations and warranties of Buyer contained in this Agreement to be true and correct on and as of the Closing Date. To the extent the conditions precedent to the obligations of Seller are within the control of Buyer, Buyer shall cause such conditions to be satisfied on or prior to the Closing Date and, to the extent the conditions precedent to the obligations of Seller are not within the control of Buyer, Buyer shall use its best efforts to cause such conditions to be satisfied on or prior to the Closing Date.
Warranty Maintenance. Buyer and Seller acknowledge that Seller both provides and has imposed on it by operation of law limited warranties with respect to certain vehicles sold by it and certain services functions performed by it (the "Limited Warranties") in addition to any factory warranties provided by Honda, and agree that Buyer shall not assume any obligations under the Limited Warranties which pertain to vehicles sold and service functions performed by Seller prior to the Closing Date; provided, however, that Buyer agrees that it will cause the performance of any and all maintenance and repair work necessary to comply with the terms of the Limited Warranties and factory warranties (at Buyer's normal retail rates) following receipt of approval of the applicable warranty insurer. In the event such approval is not received, Buyer shall seek such approval from Seller. All costs, losses and expenses incurred by the Buyer in executing such maintenance and repair work, including (without limitation) parts and labor, shall be the responsibility of the warranty insurer or Seller. In the event Seller approves such work, Seller shall have fifteen (15) days after receipt of Buyer's invoice to pay such costs and expenses.
