Works Report.
(a) Project Co shall continuously monitor the progress of the Works in relation to the Baseline Works Schedule and, within 10 Business Days following the end of each calendar month from Financial Close until the Final Completion Date, Project Co shall provide to the Contracting Authority Representative and the Independent Certifier a works report (each, a “Works Report”), which will include:
(i) an executive summary describing the general status of the Works and progress made over the relevant month;
(ii) a Current Progress Works Schedule and a Look-ahead Schedule, all in accordance with Schedule 12 – Works Schedule Requirements;
(iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes;
(iv) a narrative description of the status of any Proceeding at Risk Matter that has not been resolved pursuant to Section 14.6, in accordance with Schedule 27 – Dispute Resolution Procedure, or otherwise;
(v) an update on those matters set out in Schedule 33 – Works Report Requirements; and
(vi) any other information specifically requested by Contracting Authority on the progress of the Works, all in form and substance satisfactory to Contracting Authority, acting reasonably. For greater certainty, for all updates and revisions to the Project Works Schedules, Project Co must provide a revised critical path reflecting the updated or revised Baseline Works Schedule.
(b) Project Co shall use and interact with, and ensure that the Construction Contractor uses and interacts with, the On-line (web based) Project Management (“OCPM”) software system specified by Contracting Authority. It is contemplated that the OCPM software system will automate certain aspects of the processes identified in Schedule 10 – Review Procedure, Schedule 11 – Quality Management, Schedule 22 – Variation Procedure and Schedule 33 – Works Report Requirements and other processes as determined by Contracting Authority in its sole discretion.
Works Report. (a) Project Co shall continuously monitor the progress of the Works in relation to the Works Schedule and, within 15 Business Days following the end of each calendar month from Financial Close until the Final Completion Date, Project Co shall provide to the CAMH Representative and the Independent Certifier a works report (each, a “Works Report”), which will include:
(i) an executive summary describing the general status of the Works and progress made over the relevant month;
(ii) an updated Works Schedule, in both summary and detailed formats;
(iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes;
(iv) in accordance with Section 22.3, a LEED progress report; and
(v) an update on those matters set out in Schedule 34 – Works Report Requirements; all in form and substance satisfactory to CAMH, acting reasonably. For greater certainty, for all updates and revisions to the Works Schedule, Project Co must provide a revised critical path reflecting the updated or revised Works Schedule.
(b) Project Co shall use, and shall ensure that the Construction Contractor uses, the project management software system specified by CAMH.
Works Report. (a) Project Co shall continuously monitor the progress of the Works in relation to the Works Schedule and, within 15 Business Days following the end of each calendar month from Financial Close until the Final Completion Date, Project Co shall provide to the College Representative and the Independent Certifier a works report (each, a “Works Report”), which will include:
(i) an executive summary describing the general status of the Works and progress made over the relevant month;
(ii) an updated Works Schedule, in both summary and detailed formats;
(iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes; and
(iv) an update on those matters set out in Schedule 17 – Works Report Requirements, all in form and substance satisfactory to the College, acting reasonably. For greater certainty, for all updates and revisions to the Works Schedule, Project Co must provide a revised critical path reflecting the updated or revised Works Schedule.
(b) Project Co shall use and interact with, and ensure that the Construction Contractor uses and interacts with, the On-line Project Management (“OCPM”) software system specified by the College. (iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes;
(iv) an update on those matters set out in Schedule 17 – Works Report Requirements; and
(v) all in form and substance satisfactory to HMQ, acting reasonably. For greater certainty, for all updates and revisions to the Works Schedule, Project Co must provide a revised critical path reflecting the updated or revised Works Schedule.
Works Report. (a) Project Co shall continuously monitor the progress of the Works in relation to the Works Schedule and, within 15 Business Days following the end of each calendar month from Financial Close until the Final Completion Date, Project Co shall provide to the College Representative and the Independent Certifier a works report (each, a “Works Report”), which will include:
(i) an executive summary describing the general status of the Works and progress made over the relevant month;
(ii) an updated Works Schedule, in both summary and detailed formats;
(iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes;
(iv) a narrative description of the status of any Proceeding At Risk Matter that has not been resolved pursuant to Section 14.6(g), in accordance with Schedule 27 – Dispute Resolution or otherwise;
(v) in accordance with Section 22.3, a LEED progress report;
(vi) an update on those matters set out in Schedule 17 – Works Report Requirements;
(vii) a table setting out and responding to items of Project Agreement non-compliance and deficiencies in ongoing Works as identified by the College and/or Project Co; and
(viii) any other information specifically requested by the College on the progress of the Works; all in form and substance satisfactory to the College, acting reasonably. For greater certainty, for all updates and revisions to the Works Schedule, Project Co must provide a revised critical path reflecting the updated or revised Works Schedule.
(b) Project Co shall use and interact with, and ensure that the Construction Contractor uses and interacts with, the On-line Project Management (“OCPM”) software system specified by the College. (i) an executive summary describing the general status of the Works and progress made over the relevant month;
(ii) an updated Works Schedule, in both summary and detailed formats;
(iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes;
(iv) in accordance with Section 23.3, a LEED progress report; and
(v) an update on those matters set out in Schedule 34 – Works Report Requirements, all in form and substance satisfactory to NHS, acting reasonably. For greater certainty, the continuity of the critical path method network must be maintained for all updates and revisions to the Works Schedule.
(b) Project Co shall use, and shall ensure that the Construction Contractor uses, the project management software system specified by NHS.
Works Report. (a) Project Co shall continuously monitor the progress of the Design and Construction Works, including, without limitation, the 2017 Readiness Work and the Highway Work in relation to the Works Schedule and, within 10 Business Days following the end of each calendar month from Financial Close until the Final Completion Date, Project Co shall provide to the City Representative and the Independent Certifier and the Consultant a works report (each, a “Works Report”), which will include: Amended and Restated Project Agreement Ottawa Light Rail Transit Project REDACTED Execution Version CONFIDENTIAL AND PROPRIETARY Page 102 CAN: 26350049.2 BD-#30398459-v2
(i) an executive summary describing the general status of the Design and Construction Works, including, without limitation, the 2017 Readiness Work and the Highway Work and progress made over the relevant month;
(ii) an updated Works Schedule, printed in both summary and detailed formats (PDF), and in native P6 format (XER);
(iii) a narrative description of any Disputes related to the Design and Construction Works, including, without limitation, the 2017 Readiness Work and the Highway Work, including any action that has taken place over the relevant month to resolve such Disputes;
(iv) an update on those matters set out in Schedule 33 – Works Report Requirements; and
(v) a progress report comparing Project Co’s actual Construction Activities and procurement activities relating to the System with LEED rating requirements, all in form and substance satisfactory to the City, acting reasonably. For greater certainty, for all updates and revisions to the Works Schedule, Project Co must provide a revised critical path reflecting the updated/revised Works Schedule.
(b) Project Co shall use, and shall ensure that the Construction Contractor uses, the project management software system specified by the City.
Works Report. (a) Project Co shall continuously monitor the progress of the Works in relation to the Works Schedule and within 15 Business Days following the end of each calendar month from Financial Close until the Final Completion Date, Project Co shall provide to the CTC Representative and the Independent Certifier one works report in respect of all three Facilities (the “Works Report”), which will include:
(i) an executive summary describing the general status of the Works and progress made over the relevant month;
(ii) updated Works Schedules, in both summary and detailed formats;
(iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes; and
(iv) an update on those matters set out in Schedule 17 – Works Report Requirements, all in form and substance satisfactory to the CTC, acting reasonably. For greater certainty, for all updates and revisions to a Works Schedule, Project Co must provide a revised critical path reflecting the updated or revised Works Schedule.
(b) Project Co shall use and interact with, and ensure that the Construction Contractor uses and interacts with, the On-line Project Management (“OCPM”) software system specified by the CTC. It is contemplated that the OCPM software system will automate certain aspects of the processes identified in Schedule 10 – Review Procedure, Schedule 11 – Design Quality Plan and Construction Quality Plan, Schedule 22 – Variation Procedure and Schedule 17 – Works Report Requirements and other processes as determined by the CTC in its sole discretion.

(iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes; and
(iv) in accordance with Section 22, a LEED progress report, all in form and substance satisfactory to IO, acting reasonably. For greater certainty, the continuity of the critical path method network must be maintained for all updates and revisions to the Works Schedule.
(b) Project Co shall use, and shall ensure that the Construction Contractor uses, the project management software system specified by IO.
Works Report. (a) Project Co shall continuously monitor the progress of the Works in relation to the Works Schedule and, within 15 Business Days following the end of each calendar month from Financial Close until the Final Completion Date, Project Co shall provide to the Ministry Representative and the Independent Certifier a works report (each, a “Works Report”), which will include:
(i) an executive summary describing the general status of the Works and progress made over the relevant month;
(ii) an updated Works Schedule, in both summary and detailed formats;
(iii) a narrative description of any Disputes related to the Works, including any action that has taken place over the relevant month to resolve such Disputes; and
(iv) an update on those matters set out in Schedule 10 - Works Report Requirements, all in form and substance satisfactory to the Ministry, acting reasonably. For greater certainty, for all updates and revisions to the Works Schedule, Project Co must provide a revised critical path reflecting the updated/revised Works Schedule.
(b) Project Co shall use, and shall ensure that the Construction Contractor uses, a project management software system to store the Works Report and the Works Schedule. Project Co shall supply to the Ministry five (5) licenses that shall enable the Ministry and Province Persons to access and use such project management software system.
