Accepted Innovative Suggestion definition

Accepted Innovative Suggestion means those Innovative Suggestions set out in the Second Schedule which have been accepted by the Government and form part of the Contract (by not having been deleted in the version of the Second Schedule attached to the Articles of Agreement).“Applicable Licence Period”means in relation to a Licence Area, the duration of the Licence for that Licence Area as stated in Clause 2.2 of the Conditions of Contract.“Business”has the meaning given to the term in Clause 3.1 of the Conditions of Contract.“Cap.”means a Chapter of the laws of Hong Kong.“Car Park”means in relation to a Licence Area, the car park to be operated on that Licence Area by the Contractor.“company” or “body corporate”means a body corporate – (a)incorporated under the Companies Ordinance (Cap. 622) or any of the former Companies Ordinance; or (b)incorporated by any other Ordinance; or (c)incorporated outside Hong Kong which has complied with the provisions of Part 16 of Companies Ordinance (Cap. 622) or equivalent provisions in any of the former Companies Ordinance.“Contract”means the contract to be entered into between the Government and the successful Tenderer comprising the following parts of the Tender Documents and other items as specified below (and in the case of (b) to (e) below, in the version as attached to the Articles of Agreement): (a) the “Articles of Agreement”; (b) the “Terms of Tender” and the Tender
Accepted Innovative Suggestion means an Innovative Suggestion and its specifications, subject to negotiations, if any, accepted by the Government; “Applicant” means a person who applies for the Employment Support Services under the Programme; “Case Manager” means the individual engaged by the Contractor for the purpose of providing Employment Support Services under the Contract and with the qualifications and responsibilities as provided in Service Specifications, particularly Clauses 7.6 to 7.13 and 11; “Case Manager in Charge” means the individual appointed by the Contractor to supervise the Case Manager(s) and with the qualifications as provided in the Service Specifications, particularly Clause 11; “Commencement Date” means the date on which the Services commence as specified by the Government Representative in the Tender Acceptance; “Contract Period” means the period during which the Contract remains subsisting as provided in Clause 1 of the Special Conditions of Contract save as being terminated pursuant to the provisions of the Contract; “Contract Price” or “Service Fee” means the amount calculated in accordance with the price proposal of the Contractor as accepted by the Government, which is payable by the Government to the Contractor as provided in Clause 4 of the Special Conditions of Contract and other provisions of the Contract for the full and proper performance by the Contractor of its obligations under the Contract; “Contract Year” means the First Contract Year, the Second Contract Year or the Third Contract Year; “Deliverables” means all the training, counselling, briefing and/or employer engagement materials used in relation to and/or in the course of the performance of the Services under the Contract;
Accepted Innovative Suggestion means an Innovative Suggestion and its specifications, subject to negotiations if any, accepted by the Government.“Barbecue Area”has the meaning given to the term in Clause 3(a) of the Conditions of Contract.“Cap.”means a Chapter of the Laws of Hong Kong.“Commencement Date”means the date on which the period commences as specified in Clause 2 of the Conditions of Contract (including any advancement or deferment pursuant to Clause 9 of the Conditions of Contract).“Conditional Acceptance of Tender”has the meaning given to the term in Clause 15(b) of the Terms of Tender.“Contract”means the contract made between the Government and the Permit Holder for the use of the Permit Area and subject to the terms and conditions set out in the Tender Documents and the tender submitted by the Permit Holder (to the extent accepted by the Government).“Estimated Total Monthly Fee”means an amount equal to 36 x Monthly Permit Fee.“Execution plans and Suggestions”means the execution plans and suggestions required in the Third Schedule, viz., the plans known as “Menus, Service Packages and Marketing Plans”, “Hygiene Maintenance Plan” and “Waste Management Plan “and “Innovative Suggestions”.“Fast Food Kiosk”has the meaning given to the term in Clause 3(a) of the Conditions of Contract.“Food Delivery Service out of the Venue”means the sale or supply of food and/or beverage for consumption at any location outside the Venue.“General Holiday”means every Sunday and any other day which is a general holiday by virtue of the General Holidays Ordinance (Cap. 149).“General Restaurant”has the meaning given to the term in Clause 3(a) of the Conditions of Contract.

More Definitions of Accepted Innovative Suggestion

Accepted Innovative Suggestion means an Innovative Suggestion and its specifications, subject to the results of negotiations between the Tenderer and the Government (if any), as accepted by the Government; “Agriculture, Fisheries and Conservation Department” or “AFCD” means the Agriculture, Fisheries and Conservation Department of the Government; “Alternative Authentication Method” or “AAM” means the use of an Identification Code for the submission of a Tender via the e-Tender Box in lieu of the use of a digital certificate; “billing period” means one or more period(s) within the Contract Period during which the Services are provided and are payable for each such period; “Central Tender Board” means the Central Tender Board of the Government; “continuous contract” has the meaning attributed to such term in the Employment Ordinance (Cap. 57); “Contract” means the contract made between the Government and the Contractor for the supply of the Services on the terms and conditions set out in the Tender Documents, the Tender submitted by Contractor (to the extent accepted by the Government), the Memorandum of Acceptance issued by the Government to that Contractor, and the attachments to any of the above; “Contract Deposit” means the sum of money deposited by the Contractor by cheque, cashier’s order or in the form of banker’s guarantee referred to in Clause 10 of the Terms of Tender and Clause 17 of the Conditions of Contract; “Contract Period” means, subject to early termination or extension provided for in the Contract, the period specified in Clause 1 of the Conditions of Contract; “Contract Price” means in relation to the Services, and in respect of a billing period during which such Services are provided, the amountpayable for such Services over that billing period on and subject to the terms and conditions of the Contract and is to
Accepted Innovative Suggestion means an Innovative Suggestion and its specifications, subject to negotiations if any, accepted by the Government;“Accreditations”has the meaning given to the term in the Marking Scheme;“desirablespecifications” (in upper or lower case)means those specifications in Part VII of the Tender Documents which are labelled [D] (if any);“essential requirements” (in upper or lower case)means those requirements set out in Annex C to the Conditions of Tender and the specifications set out in Part VII of the Tender Documents with label [E], and those set out elsewhere in the Tender Documents which are identified as essential and/or where it is expressly provided that a Tenderer’s failure to comply by the Tender Closing Date will lead to the Tenderer’s tender not being considered further;“Excess Proposals”means proposals submitted by a Tenderer for evaluation under the Marking Scheme of Schedule 11 of Part V;“Government”means the Government of the Hong Kong Special Administrative Region of the People’s Republic of China;“Government Representative”means the Director of Marine acting for and on behalf of the Government or any officer authorised to act on their behalf for the purposes of the Contract;“Hong Kong” or “HKSAR”means the Hong Kong Special Administrative Region of the People’s Republic of China;“Innovative Suggestions”means the proposals to be submitted under the heading of “Innovative Suggestions” of Schedule 11 of Part V for evaluation under those Assessment Criteria under Part (A) under the heading of “Innovative Suggestions” of the Marking Scheme;“Invitation to Tender”means this Government’s invitation to tender for the Contract on the terms and conditions set out in these Tender Documents;
Accepted Innovative Suggestion means an Innovative Suggestion and its specifications, subject to negotiations if any, accepted by the Government;“Collaborating Organisations”means collaborating parties including non-governmental organisations (NGOs) and non-profit-making organisations engaged by the Service Provider for provision of learning support and teaching services and participant recruitment in their districts;“Commencement Date”means the date for commencement of the Services and shall be 1 August 2021 or such other date as specified by the Government Representative in the Letter of Conditional Acceptance;“Completion of the Services”means completion of all the tasks set out herein to the satisfaction of the Government;“Contract”means the contract made between the Government and the Service Provider for the provision of the Services on and subject to the terms and conditions as set out in the Tender Documents;“Contract Deposit”means the contract deposit payable in accordance with Clauses 7.5 to 7.10 of the Terms of Tender and Clause 29 of the Conditions of Contract;“Contract Period”means the period as specified in Clause 1 of the Conditions of Contract; and subject to such early termination or any extension thereto as provided for in the Contract;“Contract Price”means the total sum of the price quoted by the Tenderer in the Price Proposal at Appendix C to the Terms of Tender for provision of the Services in four Programme Years;“Course”means the course developed and to be developed for the Capacity Building Mileage Programme required by the Government and to be provided by the Service Provider under the Contract;
Accepted Innovative Suggestion means an Innovative Suggestion and its specifications, subject to negotiations if any, accepted by the Government; “AFCD” means the Agriculture, Fisheries and Conservation Department of the Government; “Commencement Date” means 1 May 2022, or such later date as may be specified by the Government Representative in the Letter of Conditional Acceptance; “Companies Ordinance (Cap.622)” means Cap. 622 of the Laws of Hong Kong and includes the predecessor Companies Ordinance which has the meaning assigned to it in section 2 of the Companies Ordinance (Cap. 622); “Contract” means the contract made between the Government and the Contractor for the provision of the Services on the terms and conditions set out in the Tender Documents, the tender submitted by the Contractor (to the extent accepted by the Government), the Memorandum of Acceptance issued by the Government to that Contractor and any attachments to any of the above; “Contract Deposit” means the deposit as more particularly described in Clause 12 of the Terms of Tender and Clause 20 of the Conditions of Contract; “Contract Manager” means the person appointed by the Contractor under as described in Clause 5 of the Conditions of Contract to perform the duties as specified in Clause 3(ii) of Contract Schedule 1; “Contract Period” means the period specified in Clause 1 of the Conditions of Contract subject to any early termination or extension provided for in the Contract; “Contract Area” means Tai Lung Experimental Station (TLES) , Tai Lung Veterinary Laboratory (TLVL), Tai Lung Construction Depot (TLCD) and Tai Lung Irrigation Office (TLIO) as delineated in the map in Contract Schedule 2; “Contractor” means the Tenderer whose tender has been accepted by the Government; “Contractor’s Employees” means the persons deployed by the Contractor to
Accepted Innovative Suggestion means an Innovative Suggestion and its specifications, subject to negotiations if any, accepted by the Government.“Agreement”means the Agreement entered into between the Government and the Licensee on the terms and conditions of Tender Document.“Bar”means the four (4) catering outlets on the Suite Level and being part of the Licence Areas as delineated and shown coloured purple in Annex C and detailed in Annex E(5), Annex E(6), Annex E(8) and Annex E(9).“Cap.”means a Chapter of the Laws of the Hong Kong.“Catering Business”has the meaning given to the term in Clause 3(a) of the Conditions of Contract.“Catering Services”means the private food and beverage services provided by the Licensee to Other Specific Areas and any other areas of the Venue as determined by the Government Representative according to the Third Schedule.“Commencement Date”means the date on which the period commences as specified in Clause 2 of the Conditions of Contract (including any advancement or deferment pursuant to Clause 8 of the Conditions of Contract).“Conditional Acceptance of Tender”has the meaning given to the term in Clause 15(b) of the Terms of Tender.“Contract”means the contract made between the Government and the Licensee for the use of the Licence Areas and subject to the terms and conditions set out in the Tender Documents and the tender submitted by the Licensee (to the extent accepted by the Government).“Contract Year”means every successive twelve (12) months’ period within the Licence period or the remainder of the Licence Period after the last complete twelve (12) months’ period (as the case may be).“Dish Washing Rooms”means two (2) dish washing rooms located on the Service Level as delineated and shown coloured blue in Annex D(1) and edged red in Annex E(3) and Annex E(4).“Estimated Total Contract Value”means an amount equal to 3 years x Minimum Annual Licence Fee.
Accepted Innovative Suggestion means an Innovative Suggestion and its specifications proposed by the Contractor, subject to negotiations if any, accepted by the Government in the version attached to the Memorandum of Acceptance for identification purposes; “AFCD” means the Agriculture, Fisheries and Conservation Department of the Government; “Alternative Authentication Method” or “AAM” means the use of an Identification Code for the submission of a Tender via the e-Tender Box in lieu of the use of a digital certificate; “Annex” means the annexs for the Contract hereto attached to the Tender Documents; “Appendix” means the appendices for the Contract hereto attached to the Tender Documents; “Arbitration Ordinance” means the Arbitration Ordinance (Chapter 609 of the Laws of Hong Kong); “Assessment Criterion” means an assessment criterion in the Marking Scheme for technical assessment of the Tenders received; and “Assessment Criteria” shall be construed accordingly; “Banking Ordinance” means the Banking Ordinance (Chapter 155 of the Laws of Hong Kong); “Business Registration Ordinance” means the Business Registration Ordinance (Chapter 310 of the Laws of Hong Kong); “Cleaners” means any one (1) or more of the cleaners deployed by the Contractor pursuant to Service Specifications for performing the general cleansing and related tasks; “Cleansing Supervisor” means one of the Cleaners appointed by the Contractor who directly monitor the delivery of Services by Cleaners under the Contract pursuant to Service Specifications; “Commencement Date” has the meaning given to it in Clause 1.1 of the Conditions of Contract, which may be postponed to another date specified by the Government in accordance with Clause 1.2 of the Conditions of Contract;

  • Alternative energy technology means equipment, component parts, materials, electronic devices, testing equipment, and related systems that are specifically designed, specifically fabricated, and used primarily for 1 or more of the following:

  • Competitive Process means either an Open Competition or an Invitational Competition;

  • Authorized nuclear pharmacist means a pharmacist who:

  • Client Application means an application developed by Licensee that a) utilizes the Runtime Product, b) is installed fully on an end user’s machine, with all report processing local to that machine, and c) adds significant and primary functionality to the Runtime Product.
